Background/Alternatives: At the April 4, 2017 City Council Meeting, the City Council passed and approved Resolution 17-08 issuing a temporary 90 day moratorium on the acceptance, review and processing of applications for wireless telecommunication towers in all residential and commercial zoning districts within the City of Green River, Wyoming. The Planning and Zoning Commission has discussed draft language, however, the study of the potential changes and proposed amendments to the City of Green River Code Book of Ordinances, Appendix B (Zoning) is still in process. Therefore, the Planning and Zoning Commission has not yet made a formal recommendation to present to the Governing Body for consideration. Staff is recommending extending the moratorium to December 31, 2017 to allow staff and the Planning and Zoning Commission adequate time to provide a recommendation necessary to protect the interest of the community and the interest of the wireless telecommunication providers. RESOLUTION 17-08 A RESOLUTION EXTENDING UNTIL DECEMBER 31, 2017 THE TEMPORARY MORATORIUM ON THE ACCEPTANCE, REVIEW AND PROCESSING OF APPLICATIONS FOR WIRELESS TELECOMMUNICATION TOWERS IN ALL RESIDENTIAL AND COMMERCIAL ZONING DISTRICTS WITHIN THE CITY OF GREEN RIVER, WYOMING. WHEREAS, the Governing Body of the City of Green River passed Resolution 17-08 on April 5, 2017, establishing a temporary 90 day moratorium on the establishment, location or permitting of new wireless telecommunication facilities within all residentially and commercially zoned areas of the City of Green River; and, WHEREAS, the purpose of the moratorium was to allow the City adequate time to review and possibly amend its land use regulations to adequately address issues relating to the placement, construction, and modification of personal wireless communication facilities to adequately address local concerns, provide the public with access to wireless services for its safety, convenience and productivity and in compliance with the Telecommunications Act; and, WHEREAS, the study of the potential changes and proposed amendments to the City of Green River Code Book of Ordinance, Appendix B (Zoning) is still in process, and the Planning and Zoning Commission has not yet made a formal recommendation necessary to protect the health, safety and welfare of the residents of the community and the interest of the wireless telecommunication providers. WHEREAS, the City of Green River Code of Ordinances currently has no reference to telecommunication towers and service facilities with respect to placement, height, construction or modification; and, NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF GREEN RIVER, STATE OF WYOMING: Section 1: The moratorium imposed by Resolution 17-08 is hereby extended on the establishment, location or permitting of new wireless telecommunication facilities within all residentially and commercially zoned areas of the City of Green River until December 31, 2017.
