BOROUGH OF BERNARDSVILLE Mayor & Borough Council Meeting Minutes April 12, 2010 This meeting was called to order by Council President McCrossan at 7:00 p.m. on Monday, April 12. Present were Council Members Joseph DeMarco, Charlotte J. Foster, Edward McDowell, Joseph Rossi and Kevin Sooy. Also present were Borough Attorney John R. Pidgeon, Esquire, Ralph Maresca, Administrator & CMFO, and Sandra Jones, Borough Clerk & Assistant Administrator. Mayor Lee C. Honecker arrived late. STATEMENT OF PRESIDING OFFICER Notice of this meeting was provided to the Bernardsville News, Courier News and the Star Ledger, filed with the Municipal Clerk and posted on the Municipal Bulletin Board on January 5, 2010. OPEN SESSION Mr. McCrossan opened the meeting to the public. Mr. DeMarco Yes Mr. McDowell Yes Mrs. Foster Yes Mr. Rossi Yes Mr. McCrossan Yes Mr. Sooy Yes A resolution entitled "GRANTING OPTIMUM LIGHTPATH PERMISSION TO INSTALL FIBER-OPTIC CABLE IN BOROUGH RIGHTS-OF-WAY" was tabled until April 26 at the request of Mr. Pidgeon (and number #10-73 was instead assigned to a resolution entitled "Setting Recreation Fees"). Sounds Around Town Caesar V. Mistretta, Executive Director of the Chamber of Commerce, was present to discuss "Sounds" on Friday, May 7 (or rain date on May 8) and related activities including: $ Use of Olcott Square to locate a musical group thereon, $ Sidewalk sales Thursday, 10:00 a.m. to 6:00 p.m., Friday until 10:00 p.m. and Saturday until 6:00 p.m. (or 10:00 p.m. if the rain date for the "Sounds" event is utilized). $ Placement of signs for the event in accordance with Vol. 2, Section 12-23.15b5. Mr. Pidgeon stated that the function does not meet the definition of a special event, but noted that the Chamber routinely submits a Hold Harmless Agreement and Certificate of Insurance for this activity. Mr. Sooy moved approval of the event scheduled for Friday, May 7 (as described in an outline submitted by Mr. Mistretta and distributed with the agenda for this meeting). Mr. McDowell seconded and the motion was approved by six yes votes. Special Events Ordinance Mr. Pidgeon provided a draft amendment to Section 4-12.2, requested by Mr. McCrossan, which would require additional documents to be filed in support of future applications for Special Events. Mr. Rossi objected, based upon increased cost to non-profits and especially the Chamber, which donates all proceeds from Unity Day to local organizations. Mayor Honecker arrived at 7:25 p.m. After discussion, Mr. Pidgeon was given direction for changes, to be prepared for a future meeting. Crosswalks Mayor Honecker reported that signs at crosswalks on Route 202 have been explored by Chief Valentine. The cost is approximately $300 per sign and seven signs are required. The Borough Clerk suggested using safety award money toward purchase of the signs. 2

Loitering Ordinance In response to a letter from John Paff, NJ Libertarian Party, and the Preempted Ordinance Repeal Project, and at the suggestion of the Borough Attorney, Council will repeal the loitering ordinance at the next meeting held on April 26. Chapter 33 of the New Jersey Criminal Code "provides a policy to comprehensively address street behavior and other conduct in public places which may disturb citizens and disrupt peaceful society" so the borough ordinance is unnecessary. Fire Lane Ordinance Mr. Pidgeon provided a memo dated February 5 recommending repeal of Borough code 8-14. It was agreed that an ordinance for this purpose shall be introduced on April 26. Ordinance Regarding Yard Waste Collection An ordinance entitled "ORDINANCE CONCERNING YARD WASTE COLLECTION AND AMENDING CHAPTER III OF THE BOROUGH CODE ENTITLED "POLICE REGULATIONS" was reviewed. Mr. Pidgeon reported the amendment will reflect revisions to the Borough s NJDEP Tier A Municipal Stormwater General Permit concerning the placement of yard waste (leaves and grass clippings). It was agreed to introduce said amendment on April 26. Mr. DeMarco will work with Public Works to develop improved procedures for leaf collection. (It was mentioned at this point that discussion on commercial vehicles will be scheduled for the May work meeting.) Requests from Bernardsville Fire Company Three requests submitted by Jim Pickell, President of the Fire Company, were discussed: $ Use of Pool for Family Picnic on Saturday, September 11 from noon until 8:00 p.m. It was noted that a one day alcohol permit for this event will be submitted to the A.B.C. $ Use of Train Station Parking Lot on October 23; a fund raiser parking cars the day of the Far Hills Races, Saturday, October 23. $ Display of a banner (like the Chili Cook Off sign) on the brick exterior of 1-3 Olcott Square advertising the Second Annual Family Summer Bash to be held June 5 from 6:00 p.m. to 11:00 p.m. at the firehouse. Council granted permission to the Fire Company for the three activities, pending receipt of certificates of insurance and hold harmless agreements. 3

Zoning/Housing Officer s Report Mr. Maresca reported meeting with Ms. Broyles and Mr. Mondok to request corrections to the report. It appears the problem was with the programming of the spread sheet and Ms. Broyles promised to correct same prior to the next monthly report. Mayor s Proclamation for Arbor Day Mayor Honecker read the following proclamation regarding Arbor Day. WHEREAS, in 1949 the legislature set aside the last Friday of April as Arbor Day to promote the planting of trees and to encourage the protection of our forests from fires and pests that destroy the beauty and usefulness of our woodlands; and WHEREAS, half of New Jersey's total land area is forested or tree covered; and WHEREAS, trees play an important role in the ecosystem in which we live, and trees reduce the erosion of our precious topsoil caused by wind and water, clean the air we breath and the water we drink, produce oxygen, provide habitat for birds and wildlife and reduce heating and cooling costs by moderating temperature; and WHEREAS, trees are a renewable resource giving us paper for fine literature, wood for homes, fuel for fires, and countless other wood products; and WHEREAS, trees provide increased property value, enhanced economic viability, and pleasing aesthetic qualities along streets and properties in municipalities; and WHEREAS, tree planting in yards and farms, in school yards and parks, and along streets and highways creates an enduring heritage for generations that follow; and WHEREAS, this is the fiftieth anniversary of the State Arbor Day Celebration in New Jersey; NOW, THEREFORE, I, Lee C. Honecker, Mayor of the Borough of Bernardsville, do hereby proclaim April 30, 2010 as Arbor Day in the community of Bernardsville, and urge all citizens to support efforts to protect our trees and woodlands to support our borough s urban forestry program, and further, I urge all citizens to plant trees to gladden hearts and promote the well being of present and future generation. It was noted that this year the Liberty Tree will be planted. 4

2010 Farmers Market Christa O Connor, Market Administrator, representing the Bernardsville Business District Corporation, requested permission to hold the annual Farmers Market in the Train Station lot, starting Saturday, June 12 and running through November 20 th, from 9:00 a.m. to 1:00 p.m., at a cost per farmer of $50 for the season. Mr. Sooy moved approval. Mr. McDowell seconded and the motion passed unanimously. Safe Shred Day The Borough Clerk confirmed that a residential shred day will be held on June 5 in Bernardsville, and paid for by Somerset County. This will be a joint function with Bernards Township and a second day is scheduled for October 9, with residents of both communities invited to participate at either location. Somerset County representatives will be present and volunteers will be requested in order to save money. At least one, perhaps two, road department employees will be needed on June 5. Traffic Study for Anderson Hill Road Mr. DeMarco discussed the need to hire an engineer, at a cost not to exceed $3,000, to complete this study quickly in order to incorporate same in road improvement plans. Mr. Rossi questioned the engineering choice. Mr. McDowell moved to authorize John Macdowall to hire a traffic engineer at a cost not to exceed $3,000. The motion was seconded by Mr. DeMarco and approved with five yes votes. Mr. Rossi abstained. CLOSED SESSION Council Member McDowell moved to adjourn to an executive session to consider the matters set forth below, and that the time when and circumstances under which the matters can be disclosed to the public is when it (they) are finally resolved: Contract Negotiations: Personnel Matters: Nova Crete Inspections Mrs. Foster seconded and the motion was approved by six yes votes. REOPEN AND ADJOURNMENT Moved by Mr. Sooy to reopen the meeting to the public. Mr. DeMarco seconded, and the motion carried unanimously. 5

Fire Prevention Temporary help Mr. Rossi moved to authorize Mr. Maresca to hire additional, temporary help for Fire Prevention, for up to 12 hours per week at a salary not to exceed $25/hour. Mrs. Foster seconded the motion, which was approved with six yes votes.
