WHEREAS, the Atlantic County Department of Public Safety desires to accept federal funding to reimburse the County for costs associated with the incarceration of undocumented criminal aliens, and WHEREAS, the U.S. Department of Justice, Bureau of Justice Assistance, has funding available for this purpose. NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Atlantic that: 1. The County Executive is hereby authorized to accept a grant from the U.S. Department of Justice, Bureau of Justice Assistance, for funding in the amount of $124,553.00, for reimbursement of costs associated with the incarceration of undocumented criminal aliens for the period commencing July 1, 2016 through June 30, 2017, pursuant to the State Criminal Alien Assistance Program. BOX 1149, PLEASANTVILLE, NJ 08232. WHEREAS, an emergency affecting the public health, safety and welfare requires the County to enter into an agreement with Rich Fire Protection for the installation of a new fire sprinkler system in the youth shelter located at 201 Shore Road (rear), Northfield, NJ, and WHEREAS, pursuant to a November 1, 2018 lease agreement Center for Family Services (hereinafter "CFS") leases and occupies the first floor of the building for the operation of a youth shelter, and WHEREAS, on December 20, 2018 the City of Northfield Building Department notified the County that it will not issue a Certificate of Occupancy for the leased youth shelter space unless and until a new fire sprinkler system is installed, and WHEREAS, there is an immediate need for these services as a result of the lessee being unable to actively use the space until the new sprinkler system is installed, and WHEREAS, the failure to have fully functioning fire sprinkler system in the youth shelter could cause a health and safety threat to the occupants of the youth shelter, and I, Sonya G. 43 WHEREAS, the County obtained quotes from two (2) vendors with Rich Fire Protection being the lowest responsive bidder, and WHEREAS, the Director of Facilities Management has certified to the purchasing agent the surrounding facts, and that an emergency existed, and WHEREAS, pursuant to LPN 2006-7 of the Local Finance Board, the provisions of the Pay to Play law, N.J.S.A. 19:44A-20.12 are deemed waived with respect to the award of emergency contracts pursuant to the requirements of the Local Public Contracts Law, and WHEREAS, the County of Atlantic's Qualified Purchasing Agent, pursuant to N.J.S.A. 40A: 11-6, being satisfied that an emergency existed, recommends a contract be awarded to Rich Fire Protection. NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Atlantic that: 1. The action of the Qualified Purchasing Agent in awarding an emergency contract to Rich Fire Protection for the installation of a fire sprinkler system in the youth shelter located at 201 Shore Road (rear), Northfield, NJ, in an amount not to exceed $63,999.00, for the term commencing January 3, 2019 and terminating March 30,2019 is hereby ratified. 2. Within 30 days after adoption of this resolution the Qualified Purchasing Agent. shall file an Emergency Procurements Report with the Director of the Division of Local Government Services. 3. Attached hereto is a certification of funds prepared by the County Treasurer which states that there are available and sufficient legally appropriated funds for the purpose of this contract.
