Article 8 (3) third paragraph of Council Decision 2005/681/JHA of 20 September 2005 establishing the European Police College (CEPOL) and repealing Decision 2000/820/JHA 1, reads: "Cooperation agreements with bodies of non Member States of the European Union can only be concluded after the approval of the Council has been obtained" 2. 3. The CEPOL Secretariat has submitted the text of the afore-mentioned draft cooperation agreement for approval to the Council on 19 March 2010. 4. At its meeting on 6-7 April 2010, the Police Cooperation Working Party discussed to the aforementioned draft Cooperation Agreement as set out in doc. 7786/10 and agreed to request, subject to COREPER's approval, CEPOL to amend this draft Agreement by inserting in the last line of the first recital on page 7 (doc. 7786/10) a reference to "trafficking in narcotics and organised crime" so that the last part of this sentence would read as follows; "such as counter-terrorism, trafficking in narcotics and organised crime, illegal immigration and border control or trafficking in human beings". 5. In conformity with Art. 19.7(k) and 1.5 of the Council Rules of procedures, COREPER approved the wording of the letter set out in doc. 8646/10 which was sent to CEPOL. 6. The CEPOL Governing Board agreed by written procedure to the proposed amendment and has submitted the text of the revised Cooperation Agreement, as set out in annex, for approval to Council. 7. On this basis, COREPER is requested to invite the Council to approve the draft cooperation agreement as set out in annex in order to allow CEPOL to conclude this draft agreement with the Turkish National Police Institute. 9942/10 EB/dk 2 DG H 3A EN

THE GOVERNING BOARD, Having regard to Council Decision 2005/681/JHA of 20 September 2005 establishing the European Police College (CEPOL) ( 1 ), and in particular Article 8(3) thereof; Having regard to the opinion of the Strategy Committee ( 2 ); Having regard to the opinion of the Council of the European Union ( 3 ) Whereas: (1) The Governing Board authorised the Director to negotiate a cooperation agreement with the Turkish National Police Institute at its 19 th meeting on 23-24 February 2010 ( 4 ). (2) It is appropriate the Cooperation Agreement, which will in particular support CEPOL s objectives and tasks as laid down in Articles 6 and 7 of Council Decision 2005/681/JHA, is concluded. AGREEMENT BETWEEN THE TURKISH NATIONAL POLICE INSTITUTE AND THE EUROPEAN POLICE COLLEGE The Turkish National Police Institute, and the European Police College, hereafter referred to as CEPOL, - being aware of the mutual interest to enhance the effectiveness of the police forces in the fight against crime, especially cross-border crime, in Europe by conducting common trainings for senior police officers to increase knowledge of national police systems, of European cooperation instruments and mechanisms, as well as of a wide range of specific subjects, such as counter-terrorism, trafficking in narcotics and organised crime, illegal immigration and border control or trafficking in human beings; - having regard to the Council Decision 2005/681/JHA of 20 September 2005 (hereafter referred to as Council Decision) establishing CEPOL, and in particular to Art. 8 thereof; - having regard to all decisions made by the CEPOL Governing Board including the adoption of a Policy Paper on external relations, - have agreed as follows: 9942/10 EB/dk 7
Art. 1 Purpose of the Agreement The purpose of this Agreement is to define the relations between the Turkish National Police Institute and CEPOL and to establish the arrangements necessary for the facilitated co-operation between the Turkish National Police Institute and CEPOL. Art. 2 Areas of co-operation The co-operation as established in this Agreement shall a) clarify the modalities of participation of the Turkish National Police Institute in the Working Group Meetings; b) allow the participation of Turkish Senior Police Officers in CEPOL training sessions; c) define possible supporting activities of the Turkish National Police Institute in the organisation of CEPOL training courses; d) further harmonise standards on police training with regard to cross-border co-operation between police forces; e) enhance the exchange of best practices and grant the Turkish National Police Institute access to the electronic network; f) determine the costs to be met by the Turkish National Police Institute and by CEPOL; and g) indicate the Turkish national contact point. Art. 3 Status of the Turkish National Police Institute The Turkish National Police Institute shall be invited to send a representative to attend the External relations Working Group meetings for as long as Turkey has the status of Candidate Country or becomes an acceding country. CEPOL meetings may be organised in Turkey; costs for such meetings will be reimbursed by CEPOL, according to its rules. 9942/10 EB/dk 8
Art. 4 Participation in training courses Senior police officers of Turkey may participate in the training courses provided by CEPOL. In case costs for participation of Turkish trainees in the training courses are charged, they shall be indicated in the registration form and covered by the Turkish participants. Art. 5 Support for training activities of CEPOL The Turkish National Police Institute may contribute to CEPOL training courses by supporting EU- Member Countries organising a CEPOL training course including to provide police experts for CEPOL training courses upon request. Any costs incurred directly or indirectly for services provided by the Turkish National Police Institute in supporting training activities of CEPOL shall be reimbursed by CEPOL according to its rules. Art. 6 Harmonised standards on police training The Turkish National Police Institute shall support the development and implementation of common curricula as set out in Art. 7 of the Council Decision and may integrate these into the national training programmes to the extent possible and necessary. 9942/10 EB/dk 9
Art. 7 Exchange of best practices and senior police or training Officers The Turkish National Police Institute and CEPOL shall exchange best practices and research findings. Relevant exchanges and secondments of police officers and/or senior training staff members shall be facilitated. Continuous dialogue and exchange of best practices shall be enhanced by granting the Turkish National Police Institute access to the electronic network of CEPOL. The Turkish National Police Institute shall be part of the CEPOL e-net. Art. 8 Turkish National contact point The Turkish National Police Institute Foreign Relation Department acts as the Turkish national contact point for the areas of co-operation with CEPOL. Art. 9 Amendment of the Agreement The Turkish National Police Institute or CEPOL may propose to each other to amend this Agreement. Amendments to this Agreement shall enter into force after the respective internal procedures have been completed. Art. 10 Termination of the Agreement This Agreement may be terminated by each party with 6 months notice. 9942/10 EB/dk 10
