RECOMMENDATION: That the City Council: Waive further reading and adopt toe proposed ordinance in Attachment 1. BACKGROUND: On August 17, 2017, the City Council voted unanimously to waive reading and introduced the proposed ordinance amending Title 4, Chapter 3, Article 10, Section 4-3.1002 "Parkways." The proposed ordinance amendment will result in no change to enforcement methods. Enforcement will remain largely complaint driven. Residents would continue to call the Town or Sheriff to report a parking violation. FISCAL IMPACT There is no substantive fiscal impact anticipated with this proposed ordinance amendment. Attachment 1 ORDINANCE 571 ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS AMENDING SECTION 4-3.1002 PARKWAYS OF TITLE 4, CHAPTER 3, ARTICLE 10 OF THE MUNICIPAL CODE, WHEREAS, the Town has no public facility designated as a "Parkway"; and, WHEREAS, the City Council finds that the parking of vehicles on Town paths should generally be prohibited in the interest of public safety; and NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: Section 1. AMENDMENTS Section 4-3.1002 ("Parkways") of Title 4 ("Public Safety"), Chapter 3 ("Traffic"), Article 10 (Stopping, Standing and Parking) of the Los Altos Hills Municipal Code is hereby amended to read as follows: 4-3.1002 Pathways. No person shall park a vehicle within or on any town pathway. Section 2. Severability. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this ordinance, including the application of such part or provision to other persons or circumstances shall not be affected thereby and shall continue in full force and effect. To this end, provisions of this ordinance are severable. The City Council of the Town of Los Altos Hills hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. Section 3. Effective Date; Publication. This ordinance shall take effect thirty (30) days after adoption. Within fifteen days after the passage of this. ordinance the City Clerk shall cause this ordinance or a summary thereof to be published once, with the names of those City Councilmembers voting for or against it in a newspaper of general circulation in the Town of Los Altos Hills, as required by law. RECOMMENDATION: That the City Council: Waive reading and introduce a proposed ordinance amending Title 4, Chapter 3, Article 10, Section 4-3.1002 ''Parkways" BACKGROUND: On June 15, 2017 the City Council, after some discussion, directed staff to prepare an amendment to Los Altos Hills Municipal Code Section 4-3.1002 so as to read: "Pathways. No person shall park a vehicle within or on any town pathway." Section 4-3.1002 of the Municipal Code currently reads as follows: No person shall stop, stand, or park a vehicle within any parkway. As currently worded, this Code section is not readily applicable since there are no designated parkways in Town. The Town. designates its system of recreational trails as pathways. The pathways system includes both roadside paths and off-road paths. DISCUSSION: Residents and members of the Town's Pathways Comll!ittee report increased numbers of vehicles repeatedly parking for extended periods of time on Town pathways. This may be the result of increased construction activity in Town. Under the proposed amendment, a vehicle would not be prohibited from stopping on a roadside path to deliver a package, drop off or pick up equipment or passengers but a vehicle could not remain parked. Section 4-3.803 of the Municipal Code already prohibits persons from riding or driving on pathways. Currently the Town uses California Vehicle Code Section 22500(f) to cite vehicles parked on pathways. eve 22500(f) states that a person shall not stop, park, or leave standing any vehicle whether attended or unattended; except when necessary to avoid conflict with other traffic or in. compliance with the directions of a peace officer or official traffic control device, in any of the following places: (f) sidewalk The Vehicle Code defines a sidewalk as follows: "Sidewalk" is that portion of a highway, other than the roadway, set apart by curbs, barriers, markings or other delineation for pedestrian travel. Sidewalks in most cities are distinguished by a raised concrete curb
and surface separated and elevated slightly from the vehicle travel lane portion roadway. Town pathways are designed and maintained as unpaved recreational trails. The Sheriff's office recommended adopting a specific local regulation that restricts vehicle parking on the Town's recreational path system. The proposed ordinance amendment will result in no change to enforcement methods. Enforcement will remain largely complaint driven. Residents would continue to call the Town or Sheriff to report a.parking violation. The Town does not have dedicated parking control officers. Mayor Waldeck requested an amendment provided that the street has a 40 mile per hour limit or streets that do not have a lot of traffic. The amendment was not accepted. City Attorney Mattas informed the Council that this will return as an ordinance amendment. B. Discussion and Possible Action to Direct Staff to Install a Crosswalk at the Intersection of Fremont and Concepcion (Mayor Waldeck) Mayor Waldeck presented the item. MOTION MADE AND SECONDED: Vice Mayor Radford moved to add three crosswalks at Fremont and Concepcion with minimal signage; or what the vehicle code allows as minimal signage. The motion was seconded by Mayor Waldeck.
