September 4, 2012 The Mayor and Council of the City of Calera held a special meeting on September 4, 2012 at 12:00 p.m. at Calera City Hall with the following present: Mayor: Council Members: Absent: Guests: Jon G. Graham Ernest Montgomery, David Bradshaw, Chris Bunn, Bobby Joe Phillips Mike Roberson, Ed Gentry Barbara Gray Mayor Graham called the meeting to order. Mayor Graham advised the purpose of the special called meeting is to canvass the election returns and issue certificates of elections.

Mayor Graham introduced the following Resolution: RESOLUTION NO. R-2012-21 CANVASS OF ELECTION RESULTS WHEREAS, that pursuant to a federal court order modifying the consent decree in United States of America v. The City of Calera, Alabama, et al., CV-08-BE-1982-S (N.D. Ala.), a municipal election for the City of Calera for mayor and a six member council was duly and legally held on August 28, 2012; and WHEREAS, the municipal governing body of the City of Calera met on this 4 th day of September, 2012, a quorum thereof being present, at 12:00 noon, and has canvassed the returns, and has ascertained and determined the number of votes received by each candidate; and WHEREAS, the said municipal governing body has ascertained and determined the result of said election as follows: Ed EZ Gentry Mayor Machine Number 1 124 Machine Number 2 152 Absentee 2 Total Vote 278 Jon G. That Jon G. Graham received a majority of the votes cast for the office of Mayor and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2012. 2. That Chris Bunn received the highest number of the at-large votes cast for the office of Council Member and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2012. 3. That Philip Busby received the second highest number of the at-large votes cast for the office of Council Member and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2012. 4. That Ernest Montgomery received the third highest number of the at-large votes cast for the office of Council Member and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2012. 5. That David Bradshaw received the fourth highest number of the at-large votes cast for the office of Council Member and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2012. 6. That Bobby Joe Phillips received the fifth highest number of the at-large votes cast for the office of Council Member and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2012. 7. That Alan Watts received the sixth highest number of the at-large votes cast for the office of Council Member and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2012.

made a motion to adopt Resolution No. R-2012-21. Council Member Bunn seconded said motion and upon vote, results were as follows: Adopted and approved this 4 th day of September, 2012. Jon G.
