Police Jury Room July 16, 2001 Abbeville, Louisiana Minutes of a regular meeting of the Vermilion Parish Police Jury held on July 16, 2001, with Mr. Ritter Trahan presiding. The following members were present: Mr. Terry Bessard, Mr. Ernal E. J. Broussard, Mr. Minos Broussard, Mr. Kenneth DeHart, Mr. Carroll Duhon, Mr. Luther Buster Hardee, III Mr. Louis Joe Hardy, Mr. Pervis Pee Wee Meaux, Mr. T. J. Prejean, Jr., Mr. Ritter P. Trahan. Absent: Mr. Purvis Abshire, Mr. Hubert Faulk, Mr. Mark Poche Mr. Edval J. Simon, Jr. President Ritter Trahan called for any other bids in the audience to be submitted relative to the bid call shown on the agenda. Upon motion of Mr. Pervis "Pee Wee" Meaux, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Jury closed the receipt of all bids for tonight s meeting. Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Jury authorized the opening of the only bid received relative to the called Notice To Bidders: 3 Recompacted Clay Liner Subtitle D Improvements For The Solid Waste Plant James Industrial Constructors - $64,350.00 Upon motion of Mr. Terry Bessard, duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Police Jury approved the award of the contract with James Industrial Constructors for the construction of a 3 Recompacted Clay Liner for the Subtitle D Phase 3 Improvements at the Solid Waste Plant contingent upon the bid documents being in order.

Upon motion of Mr. Louis Joe Hardy, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the reading of the minutes of the July 2, 2001 meeting were dispensed with and were accepted. President Ritter Trahan read the following announcement: (1) The Louisiana Chapter of the National Institute of Governmental Purchasing will hold its 6 th Annual Educational Conference & Expo on July 25 27, 2001 in New Orleans. (2) The Gulf Intracoastal Canal Association will hold its 96 th Annual Convention on August 22 24, 2001 in New Orleans. (3) Lorman Education Services will sponsor a one-day seminar on Employment and Labor Law In Louisiana on September 19, 2001 in Lafayette. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury approved the following resolution authorizing Sellers and Associates, to develop a reapportionment plan:

Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Police Jury approved the issuance of the following permits and Letters of No Objections: A) Letter of No Objection Texaco Exploration & Production Purpose: To install two (2) 4-Inch Flowlines to Serve S. L. 334, Well No. 110 located approximately 10 miles southwesterly from Cypermort Point, La. falling in Vermilion Bay in Iberia Parish. B) Letter of No Objection Northstar Design Solutions, Inc. Purpose: Bell South Telecommunications telephone cable installation along Jude Road. C) Project Permit No. 1183-D Applicant: BHP Petroleum Americas Election District No. 02 Purpose: For the temporary construction of a board road and drill site to re-enter an existing well bore in order to plug and abandon the Cecil W. Henry Well No. 001. D) Project Permit No. 1184-D Applicant: Resource Acquisition Corp Election District No. 13 Purpose: Installation of a drill barge with appurtenant structures and a well protection structure to drill the VPSB A Well #48. Mrs. Liz Girouard with Sellers & Associates, Inc., advised the Police Jury that the specifications for the Pecan Island Fire Truck are ready. Bids will be received on August 15, 2001 at the Public Works Committee Meeting. Mrs. Liz Girouard is requesting that the specifications be reviewed by the Pecan Island Volunteer Fire Department s Chief and Police Juror, Mr. T. J. Prejean, Jr. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Minos Broussard, and unanimously carried, the Public Road Committee Recommendations were amended to include that the following ordinance be adopted to establish a 45 mph speed limit on Placide Road from Lormand Road east to the bridge:

O R D I N A N C E 2001-O-13 WHEREAS, it has been brought to the Police Jury s attention that a considerable amount of speeding is existing and causing very hazardous conditions on Placide Road; and SECTION I: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose a 45 mph speed limit on said road from Lormand Road east to the bridge; and SECTION II: BE IT HEREBY FURTHER ORDAINED, that a maximum penalty of $100.00 and/or a 10 day jail sentence may be imposed at the discretion of the court. SECTION III: BE IT HEREBY FURTHER ORDAINED, that Honorable Sheriff Raywood Lemaire be and is hereby requested and/or directed to enforce the speed limit by the use of radar and/or regular patrolling. * * * * * * * * * Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, Item No. 4 of the Public Road Committee Recommendations was amended to add the following state highway driveway permit installation: D) Harvey Broussard La. Hwy 82 Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Minos Broussard, and unanimously carried, the Public Road Committee Recommendations were approved as amended, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC ROAD COMMITTEE JULY 11, 2001 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON JULY 11, 2001, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that the company managing the Abadie Oaks Subdivision sewer treatment operation be notified of an infiltration problem into the system in the area of the Eric Trahan residence.

It is further recommended that the Board of Health and Public Service Commission be advised of the problem and requested to review the matter also. 2. It is recommended that the Police Jury Road Committee Recommendations acknowledge that Mr. Ronald Broussard attended the meeting to inquire about the status of sugar cane operation changes. It is further recommended that Mr. Brian Simon, Chairman of the Parish Sugar Cane Advisory Board be requested to attend the next Police Jury meeting to advise the Jury of the status of their Committee s efforts to address the complaints about sugar cane operations. 3. It is recommended that Sellers and Associates, Inc. be authorized to submit an application for Rural Development Funds to renovate/repair the FRS Maintenance Building at the Public Works Complex. It is further recommended that the parish legislative delegation be advised that the project is the Jury s priority project for this year s program funding. 4. It is recommended that the following state highway driveway permit installations be approved: A) Brent Landry La. Hwy 82 B) Jimmie Guillory La. Hwy 82 C) John Landry La. Hwy 330 5. It is recommended that the Police Jury accept the resignation of Mrs. Linda Hardee from the Vermilion Parish Library Board, and that a letter of commendation be sent to Mrs. Hardee thanking her for the years of service given to the parish. It is further recommended that Mrs. Karen Trahan be appointed to fill the unexpired term of Mrs. Hardee through October 17, 2001. 6. It is recommended that the requisitions shown on the attached sheet be voided in view of their being beyond the 60 day validity period. 7. It is recommended that the invoices shown on the attached sheets be approved to be paid.

8. It is recommended that authorization be given to purchase a new 8 hydraulic pull behind mower from Quality Equipment Co., Inc. in the amount of $3,640.00 being the lowest of quotes received. Cost to be prorated from Election District #12 allocation in Road District Sub 4 of 2. Prejean, Jr., duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Public Works Committee Recommendations were approved as presented, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC WORKS COMMITTEE JULY 11, 2001 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC WORKS COMMITTEE MEETING HELD ON JULY 11, 2001, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that Police Jury establish the following policy regarding the disposal of horses and emus which have died and could be infected with the encephalitis virus: A) It is prohibited to dispose of any horse or emu carcass at the Solid Waste Plant because of potential encephalitis virus contamination. B) The animal owner shall be ultimately responsible for the disposal of any horse or emu carcass, regardless of the manner of death. C) It shall be allowable for Police Jury forces to enter onto a persons property to bury a horse or emu suspected of having died from encephalitis subject to the following conditions:

I) That the burial site is easily accessible for existing Police Jury equipment. II) Landowner executes a waiver of liability document in behalf of the Police Jury regarding the access to to the property. III) That the Police Jury has equipment available to do the work at that time. 2. It is recommended that Mr. Kevin Leleaux be reclassified to a Grade 8 level and classified as a mechanic apprentice (has no formal mechanic trade school training or education). 3. It is recommended that a new study of the communication equipment used to notify the parish fire department be made to address areas of poor reception or limited reception. The study results are requested to be available for the next Public Works Committee meeting. 4. It is recommended that the invoices shown on the attached sheets be approved to be paid. It is recommended that the Police Jury refer any additional action on signage at the Vermilion Parish Courthouse to the 2002 Budget process. 2. It is recommended that quotes be obtained and award a contract to replace the carpet in the lobby area of the District Attorney s Office and the two elevator coaches. Respectfully submitted, Pervis "Pee Wee" Meaux, Chairman Legal Counsel, Mr. Paul Moresi, III, made comments regarding the Police Jury s current insurance coverage and the fact that large deductibles are now being paid by the Jury. He advised that the insurance company can pursue reclaiming cost for attorney fees where a frivolous lawsuit was filed. Will pursue with insurance counsel on some cases currently under consideration where sanctions would be allowable to try and recover the costs paid by the Police Jury. Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury nominated Mr. Ray Landry, Administrator of Abbeville General Hospital and Mrs. Winnie Broussard, President of Hospital Service District No. 1., as prospective board member candidates to the new Vermilion Parish Economic Development Board.

Upon motion of Mr. Louis Joe Hardy, duly seconded by Mr. Luther "Buster" Hardee, and unanimously carried, the Police Jury nominated Ms. Betty Broussard as a prospective board member candidate to the new Vermilion Parish Economic Development Board. Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Police Jury approved the following road additions to the 2001 Resealing Program with costs to be paid from the Election District 13 allocation in Road District No. 7: Junius, Arapaho, Sioux and Navaho Roads. Upon motion of Mr. Terry Bessard, duly seconded by Mr. Kenneth DeHart, and unanimously carried, that there being no further business to be presented, the meeting was duly adjourned.
