Rules and Regulations of the Event Reebok Fitness Camp Warsaw, June 7, 2015 GENERAL PROVISIONS 1. The event Reebok Fitness Camp (hereinafter referred to as the Event ) is organized by Rochstar Events spółka z ograniczoną odpowiedzialnością with its seat in Warsaw, at ul. Wał Miedzeszyński 384, 03-994 Warsaw, entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under number KRS 0000361135, NIP (taxpayer identity number): 113-28- 08-461, with the share capital amounting to PLN 5,000.00 (hereinafter referred to as the Organizer ). 2. The title sponsor of the Event is Adidas Poland Sp. z o.o., with its seat in Warsaw, at ul. Żwirki i Wigury 18A, entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under number KRS 0000032095, NIP (taxpayer identity number) 522-000-00-80, which is the company responsible for distribution and marketing of Reebok s brand (hereinafter referred to as the Sponsor ). 3. The purpose of the Event is to: 1) propagate physical exercise; 2) promote physical exercise and healthy lifestyle among women and men; 3) promote attractive space for recreational activities. 4. The Event shall take place on June 7, 2015 at the Horse Race Track Służewiec located at Puławska 266 in Warsaw (hereinafter called the Event Venue ). 5. The Event begins at 8:00 a.m. Reebok training, which takes place during the Event is scheduled for 10:00 a.m. The end of the Event is scheduled for 6:00 p.m. 6. Each and every person who meets the conditions specified in Clause 19 24 of the Rules has the right to participate in the Event. Persons participating in the Event shall be hereinafter jointly referred to as the Participants, and each of them individually the Participant. 7. The Organizer makes available these Rules and Regulations (hereinafter referred to as the Rules ) specifying, in particular, the rights and obligations of the Organizer, as well as the rights and obligations of the Participants related to their participation in the Event. Detailed information on the Event Venue and the provisions of the Rules are available on websites www.reebokfitnesscamp.pl (hereinafter referred to as the Site ) and http://www.eventim.pl/ 8. The Organizer informs that the Events does not constitute a mass event in the meaning of the provisions of the Act on the Safety of Mass Events dated March 20, 2009 (J.of L. 2009.62.504, as amended). 9. Each Participant is obliged to read the content of the Rules and to follow its provisions. 10. The Organizer provides medical care during the Event. 1
LIMITATIONS WITHIN THE SCOPE OF OBJECTS BROUGHT INTO THE EVENT VENUE 11. The Participants shall be prohibited from bringing into the Event Venue or being in possession of, during the Event, any weapons, explosives, fireworks, fire hazardous materials, as well as alcoholic beverages, abusive or psychotropic substances. It shall also be prohibited to bring or let into the Event Venue or be in possession of any sharp, heavy or hard objects, including those made of glass, metal or other objects that may be hazardous to other Participants or the Participant bringing them into the Event Venue, e.g., umbrellas, shoes, backpacks, or clothing containing hard or heavy elements, which can be detrimental to another Participant's health if accidentally come into contact with his/her body. 12. The objects mentioned in Clause 11, second sentence of the Rules above, may be placed by the Participant before the entry to the Event Venue, in the free of charge deposit, for the duration of the Event. 13. In case of revealing that any objects or animals were brought into the Event Venue, contrary to the prohibition referred to in Clause 11 of the Rules, the Organizer shall be entitled to remove such Participant from the Event Venue, unless, in case of objects mentioned in Clause 11, second sentence of the Rules, the Participant will immediately transfer them for deposit on the terms and conditions specified in Clause 12 above. PARTICIPANTS SAFETY 14. Each Participant shall be obliged to behave in a manner that does not pose a threat to the safety of other Participants and persons staying at the Event Venue, and in particular, observe the provisions of the Rules and legal regulations, as well as abide by the orders given by safety personnel and the Organizer s representatives. 15. In order to ensure safety of the Event throughout its duration, The Organizer shall appoint safety personnel and the Organizer s representatives, responsible for coordination and supervision of the course of the Event. 16. The Organizer shall also be authorized to refuse the entry or stay at the Event Venue to persons, whose behavior may pose a threat to the other Participants safety. 17. The Event may be immediately canceled or terminated if its start or course may pose a threat to the Participants safety. 18. In the event of noticing any hazard to persons or property at the Event Venue each and every Participant of the Event shall be obliged to: a) immediately notify the safety personnel or the Organizer s representatives; b) immediately carry out the orders given by the safety personnel or the Organizer s representatives; c) avoid panicking; d) unconditionally refrain from hindering the approach of the rescue services. 2
RULES OF ENTRY TO THE EVENT VENUE 19. Only a person who pays a fee in the amount of 69,00 PLN until April 30, 2015, 11:59 p.m. or in the amount of 79,00 PLN since May 1, 2015, 00:00 a.m. until June 7, 2015, according to the rules and regulations available after logging in on website http://www.eventim.pl is allowed to enter the Event Venue. 20. Participants who paid the fee specified in Clause 20 shall receive electronic confirmation of payment sent to the e-mail address provided by the Participant during logging in. Each Participant prints his/her own electronic ticket p@h (print @ home) (hereinafter referred to as the Ticket ) via customer s account on website www.eventim.pl. The Ticket shall be available for printing as of the date of crediting the bank account of Eventim Sp. z o.o. with the fee. The printed Ticket, bearing a unique code, authorizes the Participant do enter the event Venue. Based on the Ticket, the Participant shall also collect a starting pack, before the entry to the Event Venue, on the day of the Event, between 8:00 and 10:00 o clock a.m. To receive a starting pack and enter the Event Venue, each Participant is obliged to present the identity card or the statement specified in Clause 23 below along with other identifying document. 21. Upon presenting the Ticket each Participant shall receive an identity wrist band, authorizing the Participant to stay at the Event Venue without restraints, as well as to multiple entries and exits to and from the Event Venue. 22. The starting pack received by the Participant may not be used in any advertising or promotional campaigns (including as a prize in contests or lotteries), and for any other commercial or trade purposes of third parties, without the prior consent of the Organizer. 23. The Event is designated mainly for adults. Minors at the age of 13 to 18 are allowed to participate in the Event: a. under custody of statutory agent or other person authorized to take care of the minor (hereinafter referred to as the Guardian ) and upon presenting a statement on Guardian s responsibility for a minor, signed by the Guardian or b. upon presenting a statement on Guardian s consent to a minor s participation in the Event, signed by the Guardian. Statements are available on Site. REGISTRATION ON SITE 24. Participants holding a Ticket may register on Site and create their own, individual profile of the Participant of the Event (hereinafter referred to as the Profile ). The Profile may be created on Site, in tab Registration, upon entering by the Participant the individual code placed on the Ticket. Creating the Profile is necessary in order to generate the Participant s starting number and it allows the Participant to prepare individual training schedule, according to the rules specified in Clause 25 below. 25. Each Participant obtain, within the Profile, the possibility to register to separate trainings, taking place during the Event. The Participant may register his/her participation in any number of trainings provided that there are still places available for that particular training. The Organizer informs that the number of places for each training is limited and the priority to participate in each, particular training depends on the order of registration in the computer system on Site. The registration for trainings is not mandatory the Participants who do not register on Site for any 3
training until June 7, 2015 shall receive, upon presenting a Ticket, a training schedule generated automatically according to the number of available places left in each zone. 26. The registration of the Profile and the registration for trainings taking place during the Event is available for all Participants holding the Ticket, starting from May 15, 2015. Participants who acquire the Tickets after May 15, 2015 may register the Profile and register for trainings taking place during the Event after 24 hours from receiving the Ticket. SAFETY OF THE TRAINING AND HAZARD INFORMATION 27. The Organizer informs that each Participant taking part in the Event should understand his/her individual physical capacity and decide on their own on any personal medical counter-indications for physical exercise as well as long-term, intensive physical training during the Event. Therefore, each Participant should cautiously and responsibly take a decision on participating in the Event, in particular in training. All information concerning the Participants injuries, contusions or medical states, both former or existing or occurring during the Event, which may pose a threat to the Participants health or life, should be reported immediately to coaches or medical services. 28. The Organizer informs that a decision to perform the entire Reebok training during the Event can be made solely by the Participant or the Participant s Guardian. 29. The Organizer does not provide insurance (e.g. against accidents) covering conditions, accidents, contusions, losses or damages that may result in connection with physical exercises performed during the Event. 30. The Organizer informs that each Participant should, on his/her own, secure their possessions from loss or leave valuable property in the deposit available at the Event and should not leave them unattended during the Event. 31. The Organizer informs that participation in the Event may entail risk and danger of accidents, personal and bodily injuries, as well as loss or damage of property. OTHER LIMITATIONS 32. It shall be prohibited to carry out any commercial or noncommercial activity (e.g., flash mobs, gathering signatures) at the Event Venue during the Event without the prior written consent of the Organizer. It shall be prohibited to make any slogans or shouts that would provoke or induce disturbance of public order and safety. COMPLAINTS 33. Any and all complaints related to matters connected with the participation in the Event may be sent within 14 days of the Event completion, in particular in a written form, to the correspondence address of the Organizer: Rochstar Events Sp. z o.o., ul. Racławicka 99, 02-634 Warsaw or the e-mail address: biuro@rochstar-events.com. The Organizer shall recognize the complaints within 14 days of their delivery to the Organizer. 4
MISCELLANEOUS PROVISIONS 34. The Organizer shall be authorized to record the Event for filing and advertising or promotional purposes of the Organizer or the Sponsor. The Organizer or the Sponsor, respectively, may use such recording or a part thereof, including the one containing the image of a Participant or another person staying at the Event Venue, without any limitations as to the time or territory, without any obligation to pay consideration for the use of the image, in all fields of exploitation, including those specified in Article 50 of the Act on Copyright and Related Rights, in particular, through its fixation, reproduction, trading and dissemination. 35. The headings in the Rules were inserted for the reader's convenience only. 36. The Rules shall come into force as of the day of its announcement. 37. Warsaw, March 9, 2015. 5
