REVENUE TALATI ASSOCIATION PROPOSED NAME (Proposed) Rules and bye-laws (In effect from Date: ) MEMORANDUM OF GUJARAT REVENUE TALATI ASSOCIATION (1) Name: Name of the Association shall be REVENUE TALATI ASSOCIATION (2) Office: The office of the Association shall remain at the disposal of the Secretary. (3) Aims & Objectives: (A). To maintain the honour and dignity and to uphold the interests of the In-Service Revenue Talati of Government of Gujarat State and to promote Co-operation amongst the members thereof. (B). To promote and further the rights of the members. (C). To safeguard the interests and to aim at the betterment of the In-Service Revenue Talati of Government Of Gujarat State for the attainment and furtherance of the above objectives. (D). To uphold the prestige, honour and interest of the profession and to co-ordinate with Government, individuals and institutions in their efforts to improve the conditions of In-Service Revenue Talati of Government Of Gujarat State. (4). Activities: (A). Hold periodical meetings and conferences of the members. (B). Consider and express its views on all the questions and the relevant laws of the state and of the country on the proposed legislation OR take such steps and relevant measures from time to time regarding fundamental rights of the members. (C). Borrow OR raise the funds of the Association. The funds of the Association shall be raised by the membership fees, subscription, and contribution, loans and gifts. Whenever raised with the approval of the respective General Body at state or district level. GUJARAT IN-SERVICE REVENUE TALATI` ASSOCIATION ARTICLES OF ASSOCIATION (1). Definitions: Unless the context otherwise requires clarification, expressions contained in these articles shall have the following meanings. i) 'Association' means Gujarat In-Service Revenue Talati Association-Gujarat State. ii) 'Year' means financial year. iii) 'Member' means the member of Gujarat In-Service Revenue Talati Association. iv) 'President, Hon. Secretary and Treasurer' means the President, Hon. Secretary and the Treasurer of Gujarat In-Service Revenue Talati Association. v) 'Executive Committee' means the committee for the Management of Gujarat In-Service Revenue Talati Association vi) 'General Body' means the meeting of all the members of the Gujarat In-Service Revenue Talati Association present at the duly convened meeting. 2
vii) viii) ix) District Branch means the district level body of members District Exe. Com. means the district level Executive committee. SHORT TERM means Gujarat In-Service Revenue Talati' Association (2). Eligibility of Membership: Any In-service Revenue Talati posted in Government of Gujarat State is eligible to become Member of the GUJARAT IN-SERVICE REVENUE TALATI ASSOCIATION. (3). Membership: Those who are eligible as stated in Article (2) and pay Life Membership Fee and Enrollment fees as decided by the General Body from time to time, shall be considered Life Members of the Association. (4). Rights Privileges of a Member: (a). To help and give suggestions to solve the problems of general nature Affecting:- i. Injustice in service and service benefits ii. Injustice in seniority, appointment, suspension etc. iii. Transfer. iv. Duties. v. Payment. vi. Accommodation: (i). Residence (ii). Office For above purpose to seek and provide legal advice. (b). Payment of Membership Fee shall be entitle the member, of all the privileges of membership of the Association for that period. (c. Member shall be entitled to receive circulars, GR and other important problems about service conditions, modern advancement OR in the uses OR abuses of drugs as per (Drugs control Dept) and other publications of the Association either free of charge OR at such rates as the Association (Executive Committee) may fix from time to time. (d). All the members shall have the right to attend and take part in the discussion at all General Body Meetings. (e). Members will have right to vote & contest the election of the Association. (5). Termination of Membership: (a). If the conduct of a member be deemed by the Executive Committee as prejudicial to the interest of the Association OR put Medical Profession in disrepute. (b). Membership may be terminated by resignation also. Member may at any time resign from membership by giving 30 days notice in writing to the Secretary. 3
(c). By conviction in a court of justice: (i). Any crime entailing normal turpitude. (ii). De-registration by the Medical Council. (6). Termination of privileges: On the termination of membership, a person shall automatically cease to hold such office OR appointment as he/she may be holding in the Association. (7). Re-join: (a). Any member who has ceased to be a member can be readmitted on fresh application OR request being made by him and payments of any dues outstanding against him on the date he/she had ceased to be a member. (b). A member, whose name has been removed under termination may be readmitted on request with the support of 15 members verifying to his conduct and approval by General Body. (c). May be readmitted after getting his name re-entered in the Medical Council Register. (8). Constitution: The Association shall consist of members whose names are on the register at the time when these rules come into operation and of the subsequent members who shall be those persons, who being eligible and pay Membership Fee as may be prescribed from time to time by the bye laws. (9). Year of the Association: The year of the Association shall be from 1 st April of one year to 31 st March of the following year. (10). Register: A register with the names, qualifications and address of the members of the Association shall be maintained. The members on the list of the register of the Association, will be eligible for the posts in the Association. (11). Management of the Association: The General control, management, the policy matters and all the affairs of the Association shall be managed by the Executive Committee. (A). Composition of Executive Committee: Initially, at the meeting of the In-Service Revenue Talati of Government of Gujarat a Core Team will be selected and the Core Team will elect President, Secretary, Treasurer and other office-bearers as found necessary from the Members of the Core Team. Office Bearers will form Constitutution Committee for formation of the constitution of the Association. 4
Then as decided by the General Body the following Executive Committee will be elected from among members at state level 1. President 1 (One) 2. Vice Presidents 5 (Five) 3. Secretary 1 (One) 4. Joint Secretaries 3 (Three) 5. Treasurer 1 (One) 6. Joint Treasurer 1 (One) 7. Executive Committee Members one from each district 26 (Twenty Six) 8. Auditors 2 (Two) 9. Immediate Past President 1 (One) Then as decided by the District level General Body the following Executive Committee will be elected from among members at district level ( At All Districts of Gujarat) 1. President 1 (One) 2. Vice Presidents 2 (Two) 3. Secretary 1 (One) 4. Joint Secretaries 2 (Two) 5. Treasurer 1 (One) 6. Joint Treasurer 1 (One) 7. Executive Committee Members 9 (Nine) 8. Auditors 1 (One) 9. Immediate Past President 1 (One) Candidate at district level must have paid all subscriptions and fees as prescribed by district General Body. In case of transfer from one district to another, s/he need not pay any yearly subscription or fees for that financial year if he produces no due certificate from previous district. 5
(B). Power of the Executive Committee: The Executive Committee will administer the affairs of the Association in accordance with the constitution of the Association. Ordinarily the Executive Committee will meet once in 3 months. Executive Committee's term can be extended for further one year by General Body and maximum Two extensions are permitted. The Executive Committee shall have the rights to appoint special sub-committee as and when found necessary. The President and Secretary shall be an ex-officio member of such sub-committees. (C)Term of Office of Executive Committee: Ordinarily the term of the office of the Executive Committee shall be of Two years but it will remain in office till the newly elected Executive Committee takes over the charge. The Secretary of the out going Executive Committee shall convene the first meeting of the elected Executive Committee within 21 days from the day of election of the new Executive Committee which will take charge of the office. (D). Duties and Powers of the office bearers: (I). President: (a). Shall be the chairman at all meetings, preside over the General Body Meetings and all other meetings of the Association. (b). Shall guide and control the activities of the Association. (c). Shall regulate the proceedings of the meetings and interpret the rules and decide doubtful points. (d). Shall in addition to his ordinary vote, have a casting vote in case of tie. Note: In the event of an emergency arising by reason of such causes as death, detention, resignation OR absence of the President the Senior Vice-President shall act as President. (II). Vice-Presidents: (a). Shall help in by making tours and addressing Members and other personnel. (b). The Senior Vice-President present shall act as President in the absence of the President. (III). Secretary (With Joint Secretaries): (a). Shall have overall charge of the office of the Association. (b). Shall organize, arrange and convene Executive and General Body Meetings in Consultation with the President and keep the record of the proceedings thereof. (c). Shall maintain a correct and up to-date register of all members of the Association. (d). Shall bring any matter, which he considers necessary in the interest of the Association to the notice of the Executive Committee. 6
(e). Shall have general supervision of accounts, pass bills for payments (and sign cheques). Shall get the accounts prepared by the Hon. Treasure a quarterly and annual statement of accounts duly audited by the auditors for the approval of the Executive Committee and the General Body. (f). Prepare the annual report. (g). The Hon. Secretary and Hon. Treasurer shall prepare and submit the budget estimates for the current year in the month of April every year before the Executive Committee for its consideration and approvals. Shall have the power to defray all necessary expenditure as approved in the Budget. (IV). Treasurer (With Joint Treasurer): (a). Shall collect OR arrange to collect the subscription, dues and other collections of Association and deposit it in the Bank Account of the Association. (b). Shall dispose of the bills for payment as sanctioned by the Hon. Secretary and Executive Committee (on its written order). (c). Shall have a right to point out any error OR discrepancy in the order from the Secretary for the payment and refer the order back with remarks. In the event of the disagreement between the Secretary and the Treasurer, the matter shall be referred to the President for final decision. (d). Shall be responsible for keeping up to-date accounts for the Association for audit purpose and put up the same before the Executive Committee. (e. Shall prepare an annual statement of accounts and a balance sheet showing the Financial position of the Association, get it audited and submit at The Annual General Body. (V). Auditors: (a). Shall audit the account at the end of the year and after verification, certify to its correctness. (b). Shall give suggestions for the proper keeping of accounts. (VI). Legal Advisor: A Hon. Legal Advisor may be appointed by the Executive Committee (As and when found necessary). (12). Properties and Fund of the Association: (a). The Funds of the Association shall be deposited in any of the Nationalized Banks in the name of GUJARAT IN-SERVICE REVENUE TALATI` ASSOCIATION. (b). The Bank accounts of the Association shall be operated jointly by the Treasurer and either the President or Secretary. (c). No Office-bearers or the Executive Committee shall make the Expenditure more than twenty five percent over and above the allotted budget by the General Body. 7
(13). Election of the Office Bearers: (a). The election of New Executive Committee shall be conducted ordinarily before one month of the end of tenure. (b). The notice for the election shall be given at least 3 weeks prior to the date of the General Body Meeting. (c). Member will not be eligible for election in the Executive Committee, if he remains absent in the Annual General Body Meeting without prior information. (Nomination papers must be duly proposed and seconded by the members of the Association). (d). Eligibility for the election in the Executive Committee is at least one year Membership. (Only those members will participate in the workings of the Election of the Executive Committee whose names appear in the membership register at the time of Annual General Body Meetings). No due certificate from respective/concerned district branch is mandatory for the nomination as candidates. (e). Withdrawal of the nomination from election shall be permitted up to 2 days before the General Body Meeting. (f). In case of absence of nominations, it will be invited at the floor of the General Body Meeting and office bearers will be elected in the same General Body Meeting. (14). Voting Procedures: (a). In case of contest the Hon. Secretary may prepare the Ballot Papers OR Authorized Slips for voting to be issued at the meeting. The members shall have as many votes as there are numbers of seats for such posts, but no candidate shall be given more then one vote. (b). At the commencement of the meeting, the President shall appoint Election Officers from among the members as required. The election officer shall be in charge and take the possession of Ballot papers / Authorized slips prepared by the Hon. Secretary and before issuing the said ballot/slips to the voter, the election officer shall put his signature on the ballot/slips for purpose of identification. (c). The counting shall be done by the above election officers soon after the voting at the same place and shall announce the names of the elected persons gaining majority of votes for the contest was held. (d). Arbitration:-If at any time any dispute is to be referred for arbitration, The Arbitrator shall be the President, and if he is involved, the Immediate Past President will be the Arbitrator. The Arbitrator shall give an opportunity to both/all the parties to file their representations. The Arbitrator shall give his award and it shall binding to all concerned. (15). Meetings: (I) General Rules: (a). The minutes of all the meetings shall be correctly maintained and duly confirmed at the following meetings. After confirmation it shall be signed by the President and the Secretary. 8
(b). The Chairman of the meeting may adjourn the meeting if deemed necessary OR due to lack of members present are in favour of adjournment. At the adjourned meeting only the unfinished business of the meeting shall be transected. (c). No business shall be transacted at a Special Requisition Meeting other than for which the meeting is called. (d). If the quorum is not satisfactory within an hour OR such time as decided by The President OR Chairman after adjournment, the meeting shall be dissolved, if called in the requisition of the members, but in any other case shall stand adjourned, to be called again after ½ an hour of this meeting, the members present whatever their number shall form the quorum and shall carry on the business. (II). Executive Meeting: The meeting of the Executive Committee of state shall be convened once in three months by the Hon. Secretary of which 15 days notice shall be given. Quorum: 1/3 (one third )of its Members (III). General Body Meeting: The Hon. Secretary shall call of the members whenever required, 21 days notice of which shall be given to the members. Any member desirous of moving a Proposition / Resolution at any ordinary meeting of the Association shall send such Proposition / Resolution in writing and duly signed, to the Secretary at least 2 days before the meeting. Quorum: 100 members of the Association shall form the quorum. (IV). Special OR Requisition Meeting: A special meeting of Executive Committee OR any General Body shall be convened by the Secretary within 7 days after the receipt of a written requisition duly signed by the:- (i). 5Members of the of the Executive Committee for Executive Committee Meeting. (ii). 50 Members of the Association for General Body Meeting. Quorum: For Executive Committee: 1/3 members (3 from requisite members) For General Body Meeting: 150 members (30 from requisite members) Shall form the quorum at any such meeting and if there be no quorum at such a meeting within ½ an hour of the specified time the meeting shall be considered as dissolved. (V). Urgent Meeting: An emergency meeting of the Association shall convened by the Secretary at the instance of the President OR in his absence by the Vice-President for the transaction of any business of an urgent nature. (16). No Confidence: A vote of no confidence can be moved only in a requisition meeting. When a vote of no confidence is passed by General Body it shall elect there and then five members to conduct the affairs of the Association, till such time OR as the fresh election takes place, these five members OR Adhoc Committee shall arrange to hold the fresh election within 30 days of such meeting. 9
(17). Vacancy in the Executive Committee: The vacancy in the Executive Committee at state or district level shall be filled by the Ex. Com. The term of such a member shall end together with the term of the existing Executive Committee holding the office. (18). Change in the Rules Bye Laws: No alteration, deletion OR addition in the rules and the bye laws of the Association shall be made except at the General Body convened for the purpose. A majority of ⅔ of the members present shall be necessary to make the change. (19). Papers: All the papers read before the Association shall be taken as the property of the Association and the same shall not be published without the sanction and approval of the Executive Committee. (20). The Business Order at the General Body Meeting: (A). To read and confirm the minutes of the last General Body Meeting. (B). To consider and adopt the Annual Report. (C). To consider and pass the balance sheet of the receipts and disbursement during the year. (D). Election of the Office Bearers. (If, applicable) (E). Out going Presidential Address (If, applicable) (F). New Year Budget-Meeting (G). Any other business with the Permission of Chair. (24). Dissolution: The Association may be dissolved by the resolution passed at the General Body Meeting called for specific purpose giving a notice of 21 days. The resolution can be considered as passed by ⅔ majority of the members present. It shall not be considered passed by a simple majority. On dissolution the assets and the liabilities will be disposed off as per the Resolution passed by the General Body by simple majority. (25). Jurisdiction: Shall be within the Gujarat State. 10
