MINUTES OF A REGULAR MEETING SIGNAL HILL CITY COUNCIL April 21, 2009 7:00 p.m. A Regular Meeting of the Signal Hill City Council was held in the Council Chamber of City Hall on April 21, 2009. CLOSED SESSION 6:00 p.m. a. A closed session was held pursuant to Government Code Section 54957, to consider disciplinary action of a public employee. b. A closed session was held pursuant to Government Code Section 54956.9, regarding existing litigation amendment to the water rights judgment for the central and west basin. CALL TO ORDER 7:02 p.m. ROLL CALL PRESENT: PLEDGE OF ALLEGIANCE Vice Mayor Wilson led the audience in the Pledge of Allegiance. CLOSED SESSION REPORT City Attorney reported on closed session items. a. Council voted 3-0 to receive and file report on the disciplinary action of a public employee. b. Council discussed water rights and existing litigation. No reportable action was taken. Page 1 of 8
PUBLIC BUSINESS FROM THE FLOOR Denise Damrow, President of the Friends of Signal Hill Library announced the upcoming Author Talk on Monday, April 27 th at 7:00 p.m. at the Signal Hill Park Community Center. Denise Damrow reminded everyone of the Annual Chamber of Commerce Golf Tournament on Friday, May 15 th at Skylinks Golf Course. Denise Damrow, on behalf of Friends of Signal Hill Cultural Arts spoke of the art exhibit featuring photographer, Brenda Lee now displayed at the Signal Hill Library. Tom Poe spoke about Project Pantry, a food drive to be held on Saturday April 25 th to support food banks in the local area. PRESENTATIONS/INTRODUCTIONS a. Vice Mayor Wilson, Chief Sonoff and MADD Representative Tammy Pascoe, presented the MADD award to Officer Keren, Officer Serna and Sergeant Sagmit. b. Vice Mayor Wilson presented a special commendation to Dispatcher Michael Mills for his handling of an incident that occurred on March 10, 2009. c. Vice Mayor Wilson presented a proclamation to Lila Grace Harmon for her attainment of the Wohelo Award from Campfire USA. d. Vice Mayor Wilson presented Signal Hill s Outstanding Older American award to Hazel Gim Wallace. e. Dr. Hazel Wallace reported on vector control efforts in the area. PUBLIC HEARING a. Introduction of an Ordinance Amending Signal Hill Municipal Code Chapter 13.03 by Repealing Chapter 13.03 and Adding a New Chapter 13.03: Water Conservation Program and Making a Finding to Enforce Water Use Restrictions Under Level 1 Water Supply Shortage City Manager reported that notice was published in the the Signal Tribune on April 10, 2009. City Manager introduced the Public Works Director who presented the staff report with the Deputy Public Works Director and Management Analyst. Page 2 of 8
Vice Mayor Wilson opened the public hearing at 8:57 p.m. and asked anyone in favor or opposed to come forward. There being no further testimony, Vice Mayor Wilson closed the public hearing at 8:57. It was moved by, and seconded by COUNCIL MEMBER NOLL to waive further reading and introduce the Ordinance. City Attorney read the Ordinance No. 2009-04-1399: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIORNIA, TO AMEND THE CITY OF SIGNAL HILL MUNICIPAL CODE CHAPTER 13.03 UNDER ORDINANCE NO. 91-01-1087 WITH THE WATER CONSERVATION PROGRAM HEREIN It was moved by, and seconded by COUNCIL MEMBER FORESTER to waive further reading and adopt the resolution. City Attorney read the title of the Resolution No. 2009-04-5758: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, FOR THE PURPOSE OF DETERMINING WHETHER A WATER SHORTAGE EXISTS AND FOR MAKING APPROPRIATE FINDINGS OF THE NECESSITY OF ENFORCING THE WATER CONSERVATION PROGRAM AND ADOPT WATER USE RESTRICTIONS PROVIDED IN THE CITY OF SIGNAL HILL MUNICIPAL CODE CHAPTER 13.03 Page 3 of 8
CITY MANAGER REPORTS Council Member Forester requested moving Item B up for discussion due to the exponential amount of time taken for the Public Hearing and out of respect for Robert Copeland s time. a. Sustainable City Committee Mission Statement City Manager introduced Robert Copeland, Chair of the Sustainable City Committee. Robert Copeland submitted for approval the Mission Statement for the Sustainable City Action Plan It was moved by, and seconded by COUNCIL MEMBER NOLL to approve the Mission Statement. b. MIG Contract for Signal Hill Park Master Plan City Manager presented the staff report. Page 4 of 8
It was moved by, and seconded by COUNCIL MEMBER FORESTER to authorize the MIG contract for the Signal Hill Park Master Plan. CONSENT CALENDAR a. Resolution Declaring Final Acceptance of the Phase II Enhanced Vapor Recovery Project, No. 778 Summary: Fleming Environmental Inc. has completed the Phase II Enhanced Vapor Recovery Project, No. 778, to the satisfaction of the Public Works Department. Staff is recommending final acceptance of the work performed by Fleming Environmental Inc. Recommendation: Waive further reading and adopt the Resolution No. 2009-04- 5759 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, DECLARING WORK TO BE COMPLETED IN CONFORMANCE WITH THE PLANS AND SPECIFICATIONS FOR THE PHASE II ENHANCED VAPOR RECOVERY PROJECT, NO. 778, IN THE CITY OF SIGNAL HILL, IN ACCORDANCE WITH THE CONTRACT ENTERED INTO BETWEEN FLEMING ENVIRONMENTAL INC. AND THE CITY OF SIGNAL HILL b. Authorization for Attendance to California Contract Cities Conference Summary: The City Council will consider authorizing Vice Mayor Wilson to attend the California Contract Cities Association Conference. Recommendation: Authorize Vice Mayor Wilson to attend the California Contract Cities Association Conference by approving a budget transfer in the amount of $750 from Account No. 001.050.515.420 to Account No. 001.050.515.423. c. Monthly Financials Summary: A briefing was presented to City Council on the City s financial condition as of March 31, 2009. Recommendation: Receive and file. d. Schedule of Investments Summary: The Schedule of Investments is a listing of all surplus funds invested for the City and the Redevelopment Agency as of the date shown on the report. Recommendation: Receive and file e. Warrant Register Dated April 21, 2009 Summary: The Warrant Register is a listing of all general checks issued since the prior warrant register and warrants to be released upon City Council approval. Recommendation: Authorize payment of Warrant Register dated April 21, 2009. f. Minutes of the Following Meeting(s) Regular Meeting of April 21, 2009. Recommendation: Approve. Council Member Noll requested that Item B of the Consent Calendar be pulled for discussion. Council Member Noll requested the Deputy City Manager report on Item B on the Consent Calendar. Deputy City Manager presented the staff report. It was moved by and seconded by COUNCIL MEMBER FORESTER authorize Vice Mayor to attend the California Contract Cities Association Conference. PUBLIC BUSINESS FROM THE FLOOR Neena Strichart, Publisher of the Signal Hill Tribune wished the City of Signal Hill a Happy 85 th Anniversary. COUNCIL AGENDA NEW BUSINESS Council Member Forester reported on his attendance at the Earth Day at the Los Angeles County Sanitation District. Vice Mayor Wilson reported on his attendance at Legislative Days in Sacramento, sponsored by the League of California Cities. Vice Mayor Wilson congratulated the City of Long Beach on a successful Grand Prix weekend. Vice Mayor Wilson announced to residents how to receive a recycling basket. Vice Mayor Wilson announced spring clean-up week is this week (April 20 24) and a good time to get rid of bulky items.
