Brunson Commerce Park MUPUD, PUD Amendment, DRC#17-136 Planner Cornelison stated this is a PUD Amendment request that is comprised of two parcels. The subject property is located at 1544 Ree Ln. Planner Cornelison stated the PUD Amendment mostly keeps with the original design standards with the exception that the applicant is revising the permitted and conditional 11/15/17 PAB MINUTES 1
uses adding uses such as: veterinary clinics, commercial bakeries very minor changes and all the development standards such as setbacks and lot width will remain exactly the same, the applicant is just bringing some additional uses and clarifying uses via this amendment. Staff recommends approval for the following reasons: 1. Compliance with the intent of the MUPUD zoning district as outlined in Section 14-2-52(A) of the Land Development Code. 2. Compliance with the allowable uses as outlined in Section 14-2-52, as the proposed amendments are consistent with the surrounding uses. 3. Compliance with Comprehensive Plan Future Land Use Element Policy 1.2.3.2 for Commercial General land use as a transition of land use is established. 4. Compliance with Comprehensive Plan Transportation Circulation Element Policies 2.1.2.4, 2.2.1.1, 2.2.1.4, and 2.2.1.5 as traffic levels do not exceed the quality of service standards. Vice Chairman Kapp asked if this project will remain a park. Planner Cornelison stated that this would remain a park. Member Buxton asked what the purpose of this request is. Planner Cornelison stated that the applicant has requested this for this project and there will be some separation standards because there is residential to the north and the applicant added some additional uses that were not previously used for this site. Orange Street Right-of-Way Vacation, Vacate ROW, DRC#17-150 Planner Harris stated that this is a Vacation of Right-of-Way a.08 (3,300-sqft) right-of-way section of Orange Street west of Robinson Avenue. The subject property is located at Orange Street west of Robinson Avenue. Planner Harris stated that this project was initiated by the City of Kissimmee as the Rightof-Way is not needed and will not be utilized as the continuation of Orange Street is not a feasible option due to the development on the west of Central Avenue. 11/15/17 PAB MINUTES 2
Planner Harris stated that the adjacent property will absorb the Right-of-way if it is vacated. Staff recommends approval for the following reasons: 1. Consistent with Right-of-Way Objectives and Policies of the Comprehensive Plan: Objective 2.2.4, Policies 2.2.4.2 and 2.2.4.3; 2. Consistent with Multimodal Transportation District Policies of the Comprehensive Plan: Policies 2.1.1.1, 2.1.2.2 and 2.1.2.4; 3. Consistent with Multimodal Street Network Hierarchy Policies of the Comprehensive Plan: Policies 2.1.1.3 and 2.1.2.1; 4. Consistent with Access to Destinations and expansion of bicycle/pedestrian facilities Policies of the Comprehensive Plan: Policies 2.1.3.1 and 2.1.3.2; 5. Consistent with applicants justification; the Commission directed Main Street Corridor Study; future development; emergency responses; city services; and other Land Development Code & Comprehensive Plan documents; 6. Compliance with Land Development Code Sections 14-1-50 55 procedures and requirements for vacation requests has been followed. Staff recommends approval subject to the following 1 condition. 1. There shall be a blanket access, drainage, and utility easement that must remain over the vacated right-of-way. The blanket easement must be recorded with Osceola County Clerk of Courts prior to advertisement for City Commission agenda. Member Buxton made a motion for approval subject to 1 condition. Section 14-2-54 Vine Overlay District (VO); Section 14-2-54 (D) Mixed-Use Development Requirements; Section 14-2-54 (F) Sight Design Matrix; and Section 14-2-240 Terms Defined To clarify the mixed-use developments and when a requirement is Project, District or Station Area specific. Amending Section 14-2-54 Vine Overlay District (VO), Section 14-2-54 (D) Mixed-Use Development Requirements; and renumbering and adding table 14-2-54-1 and renumbering and revising table 14-2-54-2, including footnotes; and Section 14-2-54 (F) Site Design Matrix; and Section 14-2-240 Terms Defined by adding related definitions. The proposed Amendments are consistent with the Vine Street Vision and will: 1) To provide for clarity in enforcement of the mixed-use criteria for the Vine Overlay District; and 2) Provide the public with easier to understand requirements for mixed-use projects along the Vine Street corridor.
