ORINANCE NO. 17- AN ORINANCE OF THE CITY COUNCIL OF THE CITY OF WEST HOLLYWOO AOPTING A ZONE MAP AMENMENT IN CONJUNCTION WITH THE PROPOSE EVELOPMENT AGREEMENT, FOR THE PROPERTY LOCATE AT 9015 SUNSET BOULEVAR, WEST HOLLYWOO, CALIFORNIA The City Council of the City of West Hollywood hereby ordains as follows: SECTION 1. An application for Zone Map Amendment (ZMA) 011-005 was filed on June 16, 2011 by Andrew Bilanzich of Ace Outdoor Advertising to place the property located at 9015 Sunset Boulevard (Rainbow Bar & Grill) into a evelopment Agreement Overlay istrict. The application was deemed complete on July 14, 2011. While this proposal was originally included in the City's preliminary comprehensive sign review project, the City has determined that this project should be processed individually and in advance of that review project. SECTION 2. A public hearing was duly noticed for the Planning Commission meeting of ecember 15, 2016 in accordance with Municipal Code requirements. At that meeting the Commission reviewed the staff report, considered all the pertinent testimony, and adopted a resolution recommending that the City Council amend the City of West Hollywood Zoning Map. SECTION 3. The City Council properly reviewed and considered this matter at a public hearing on January 23, 2017. Public notice of the hearing was advertised in the Park La Brea News/Beverly Press newspaper on January 12, 2017 for the January 23, 2017 hearing date. The public hearing was also noticed by mailing to West Hollywood neighborhood groups, and representatives seated on West Hollywood Advisory Boards and Commissions on January 12, 2017. SECTION 4. The proposed site currently has a General Plan map and Zoning Map designation of Sunset Specific Plan (SSP). Concurrent approval of this Zone Map Amendment to add a evelopment Agreement Overlay Zoning istrict is required for approval of the evelopment Agreement. The Zoning Map Amendment is included as Attachments A (Existing) and B (Proposed). SECTION 5. Pursuant to the California Environmental Quality Act (CEQA), an Initial Study and a Mitigated Negative eclaration were prepared regarding this project. The primary issue of concern was the potential for the project to create a new source of substantial light or glare that would trespass onto neighboring properties. A Lighting Impact Report was completed by Francis Krahe & Associates, Inc. in July of 2016. The report found that the proposed new light fixtures along the bottom of the east and west sides of the double-sided billboard would not result in lighting levels beyond the threshold and the lighting impact would be less than significant. Furthermore, with shielding installed on the lights, the adjacent properties would not have direct views of the light sources and glare impacts would be less than significant. In order to confirm that the proposed project's light and glare impacts are less than significant, a condition

Page 2 of 5 has been included to verify the effectiveness of the lighting design. In accordance with CEQA Section 21082.1, the City Council independently reviewed and analyzed the Final MN and the administrative record relating to the proposed project. The Final MN constitutes an accurate and complete statement of the environmental impacts. The City Council adopted the Mitigated Negative eclaration as outlined in Resolution No. 17-4905. SECTION 6. The City Council of the City of West Hollywood hereby finds that the Zone Map Amendment is consistent with the Goals, Objectives and Policies of the General Plan and Sunset Specific plan because the signage maintains good urban design and the signage improvement enhances the economic viability for the property and the Sunset Strip and enhances the visual mixture on Sunset Boulevard creating a more vibrant environment. Specifically, the Amendment would create opportunity for the provision of distinctive and characteristic outdoor advertisement for which the Sunset Strip has come to be known and is envisioned and supported in the City's long range planning documents. The Zone Map Amendment for this project does not frustrate the City's ability to meet its General Plan and Sunset Specific Plan Goals because the underlying project includes features that support the overall intent of encouraging unique and innovative billboards along Sunset and creating a vibrant environment on Sunset (e.g. distinctive pole structure, seating and unique orientation of the billboard). SECTION 7. The City Council hereby finds that the Zoning Map Amendment is required with the adoption of a evelopment Agreement. The policy decision regarding the merits of the change rests with the evelopment Agreement portion of the request; thereby rendering the Zoning Map Amendment a function of the corresponding evelopment Agreement. SECTION 8. Based on the foregoing, the City Council of the City of West Hollywood hereby approves and adopts Zoning Map Amendment 011-005 which is attached hereto as Attachment B.
