CALL TO ORDER A meeting of the Fresno County Airport Land Use Commission (ALUC) was called to order by Chairman Magsig at 2:00 p.m. Commissioner Duarte was asked by Chairman Magsig to lead everyone in the flag salute. Action/Discussion Items A. Minutes of October 19, 2015 Meeting of the Fresno County Airport Land Use commission. A motion was made by Commissioner Remy and seconded by Commissioner Duarte to approve the minutes from October 19, 2015. A vote was called for and the motion carried. B. Verizon Antenna Tower E Central Avenue [COUNTY OF FRESNO] Brenda Veenendaal reported on this item. The County of Fresno and Verizon Wireless submitted a request for approval to install a facility with 100 monopole and associated equipment including coax and cabling, outdoor cabinets, and a standby generator on a 50 by 50 lease area on a 15.18-acre parcel in the AE-20 (Exclusive Agricultural, 20-acre minimum parcel size) Zone District. (APN 333-260-30) The subject parcel is located on the northeast corner of the East Central Avenue and South Columbia Avenue intersection, approximately four miles north of the nearest city limits of Reedley.

ALUC Action Summary February 1, 2016 Page 2 Ms. Veenendaal handed out an e-mail that Joel Glick, City of Reedley Community Services Director and Reedley Airport Manager, submitted with a request that a Beacon light be installed on the cell phone tower for aviation safety. Commissioner Gregory asked if there was anything in the Reedley plan that would preclude the antenna in that location. Ms. Veenendaal said that there was not. Commissioner Gregory also asked if they would have to come back to the ALUC if they decide to raise the antenna. Ms. Veenendaal said yes they would have to come back because the height would then be a consideration. A representative with Fresno County, Eric VonBerg, presented slides of the land use and project site in the zoning area. A representative with Verizon, Jennifer Hightower, also spoke on the site. Commissioner Magsig commented that the Community Service Director from the City of Reedley requested that a beacon light be placed on the cell phone tower to alert aircraft at this location; Mr. Magsig asked whether or not Verizon was okay with this condition. Ms. Hightower said that they were opposed to the request. Commissioner Duarte asked if she could explain why they opposed the light installation. Ms. Hightower then explained that it was because a light is not required by the FAA, and it is an added expense. A motion was made by Commissioner Gregory and seconded by Commissioner Duarte to approve staff s recommendation on the cell tower without the beacon requirement. A vote was called for and the motion carried with four votes (three absent). C. N. Street Apartments Project Firebaugh [CITY OF FIREBAUGH] Brenda Veenendaal reported on this item. The proposal being reviewed is to build and operate a 40-unit apartment complex on a 2-acre site on the East Side of Highway 33, approximately 2,800 fee northwest of Clyde Fannon Road. The site is approximately 2,860 feet north/northwest of the north end of Runway 30 at Firebaugh Municipal Airport, however according to the attached Firebaugh Municipal Airport Safety Zone Map the project is located within the Horizontal Zone. According to ALUC policy, multi-family developments are an acceptable land use in the zone. Associated planning actions include the preparation of an Initial Environmental Study and Mitigated Negative Declaration, a General Plan land use amendment, a zone change, site plan review, Planning Commission review and approval and City of Firebaugh staff review. Attached for ALUC review are the following documents: Firebaugh City Council Staff Report City of Firebaugh Initial Environmental Study and Positive Negative Declaration (CEQA) Firebaugh Municipal Airport Safety Zone and Noise Contours map (ALUC map) Project Location Map Assessor Parcel Map Site Plan Elevation Drawings A motion was made by Commissioner Gregory and seconded by Commissioner Duarte to approve with the N. Street Apartments Project provided the following conditions adhere to the ALUC Handbook guidelines: 1. Noise levels 2. Part 77 requirements 3. Avigation easements A vote was called for and the motion carried.

City of Fresno Plan Amendment A-15-007, Rezone R-15-016 for General Plan Clean Up and Zoning Map Update [CITY OF FRESNO] Brenda Veenendaal reported on this item. Plan Amendment Application No. A-15-007 proposes to amend the Fresno General Plan, the Bullard, Fresno High, McLane, Roosevelt, West Area, and Woodward Park Community Plans, the Tower District Specific Plan, the Fresno Yosemite Airport Land Use Compatibility Plan and the Sierra Sky Park Land Use Policy Plan, as noted in the City of Fresno General Plan Land Use Map Amendment and table below. The Plan Amendment application was filed for consideration of additional general plan clean-up items, including implementation of Master Environmental Impact Report mitigation measures and technical adjustments to meet general plan goals and policies. Environmental Assessment No. A-15-007, R-15-016 recommends approval of an Addendum to Final Master Environmental Impact Report SCH No. 2012111015 (MEIR) certified by the Fresno City Council on December 18, 2014 for the Fresno General Plan and Development Code, pursuant to California Environmental Quality Act Guidelines Sections 15162 and 15164. Rezone Application No. R-15-016 proposes to update the Zoning Map of the City of Fresno to be consistent with the City of Fresno General Plan Land Use and Circulation Map adopted on December 18, 2014, and as subsequently amended. All conditions of zoning will remain in effect. Zoning Map is available on line at www.fresno.gov/mapupdate. In addition, City of Fresno staff addressed the ALUC's October 19, 2015 Zoning Map recommendations via a PowerPoint presentation. Sophia Pagoulatos with the City of Fresno addressed the questions and concerns from the last meeting and gave an updated presentation of the Zoning Map. Commissioner Gregory asked if there was a way to incorporate language to find out which safety zones they are in and that are required to conform to the conditions that are imposed by the plans to the various airports. Ms. Pagoulatos says that only one out of the six is clear of the safety zone. Jeff Reid, Representative with Robertson Properties Group, informed the Commissioners that Robertson Properties is one of the properties affected by 19 and that the City of Fresno did not consult with the owner before the change in the land use and they were not aware of what the City of Fresno was doing. Robertson Properties is planning to do general commercial and is asking the ALUC to differ on 19. Timothy Cone also spoke on the clear zone matter. Mr. Cone commented on how changing the clear zone could attract conflicts and safety problems in the future. After much discussion, a motion was made by Commissioner Gregory and seconded by Commissioner Remy to approve the project with the condition that future applications are subject to the ALUC Land Use Capability plan as the prevailing consideration if it is in conflict with any portion of the general plan within airport areas of influence. A vote was called for and the motion carried. E. City of Fresno Plan Amendment A-16-001, Housing Element Update [CITY OF FRESNO] Brenda Veenendaal reported on this item. Plan Amendment Application No. A-16-001 was filed by the City of Fresno Development and Resource Management Director and pertains to property located within the Fresno General Plan Planning Area. Plan Amendment Application No. A-16-001 proposes to amend the text of the Fresno General Plan by updating Chapter 10, the Housing Element. The Housing Element is the City s policy document for meeting its housing needs, including housing affordable to low- and moderate-income families and special needs groups. The document intends to 1) provide direction for future planning programs to ensure that sufficient consideration is given to housing goals and policies; 2) establish and portray community goals and policies relative to housing through the identification of existing, stated and implicit goals, and the identification of housing needs and problems; and 3) establish and identify programs intended to implement and attain the community s goals and policies, taking into consideration the feasibility of those programs, and act as a meaningful guide to decision-makers

More information about the Housing Element and the Housing Element Public Draft is available online at www.fresno.gov/housingelement. Sophia Pagoulatos with the City of Fresno gave a review on the Plan Amendment A-16-001, Housing Element Update. Ms. Pagoulatos also distributed a handout on the plan. Commissioner Duarte asked a question regarding the tiny housing now going in, and how it would possibly affect the densities for land use compatibility plans. Ms. Pagoulatos responded. A motion was made by Commissioner Duarte and seconded by Commissioner Remy to approve staff recommendation, to the extent that if tiny houses or any other type of dwelling structure increases densities in given areas, they do not exceed what is allowed in our ALUC Plan. A vote was called for and the motion carried. F. Caltrans Division of Aeronautics Grant Application [VEENENDAAL] Brenda Veenedaal reported on this item. ALUC staff received news in early January that the California Transportation Commission approved a transfer of funds at their December meeting for a State of California Division of Aeronautics (Caltrans) grant to fund 90% of the preparation of an Airport Land Use Compatibility Plan for all the public use airports within Fresno County. This grant provides $270,000 with a $30,000 grant match required from the region. Caltrans staff indicates that the next step in finalizing the grant funding is to submit an Acquisition and Development Grant Application and resolution from the Fresno COG Policy Board by May 10, 2016. Staff has received the Application Form and will request that this item be placed on the March meeting cycle for a resolution from the Policy Board at their meeting on March 24, 2016. 3. Public Presentations This portion of the meeting is reserved for persons wishing to address the ALUC on items within its jurisdiction but not on this agenda. Note: Prior to action by the ALUC on any item on this agenda, the public may comment on that item. Unscheduled comments may be limited to 3 minutes. None 4. Other Business A. Items from Staff 1. Form 700's: The Annual Statement of Economic Interest form, Form 700, deadline is April 1, 2016. In addition, all Assuming and Leaving Form 700's are due within 30 days of assuming or leaving a designated position within an agency. Fresno County launched a new software system called "edisclosure" for Form 700 filings. Staff submitted a list of Commissioners and their proxies to the County that included contact information. On Friday, February 5th you should have received electronic notification from their office to file the Form 700's. Items from Members Commissioner Duarte recommended Daniel Coen to fill a vacant seat on the ALUC. In addition, it was mentioned that Commissioner Card and his proxy Commissioner Duarte would like to switch positions, so Commissioner Card would be proxy for Commissioner Duarte.
