Harmar Township Municipal Building Township Board of Supervisors PUBLIC HEARING AND REGULAR BUSINESS MEETING Thursday, January 19, 2017 PRESENT Patricia A. Janoski Robert W. Seibert, Jr. Robert Exler Emiliano Cresta Lee Biermeyer Donna Piper Charles Means Matthew Pitsch Chairperson Vice Chairperson Supervisor Absent Supervisor Secretary/Treasurer Solicitor Senate Engineering CALL TO ORDER The Chairperson called the Board of Supervisor s Regular Business Meeting of December 15, 2016 to order at 6:03 pm. The Pledge of Allegiance was recited. PUBLIC HEARING The Chairperson turned the Public Meeting over to Charles Means, the Township s Solicitor. There was no one present in attendance to provide testimony. Mr. Means stated that the Hearing for the zoning ordinance amendment was duly advertised. Mr. Means further stated that the purpose of the amendment is to address the height of nonbuilding structures and the limits to be placed will equal those as addressed in the ordinance by district for the height of building structures. Mr. Means further stated, the Township s Planning Commission has recommended approval; and the County Department of Planning and Economic Development has reviewed the proposed amendment and comments were received by the Township on January 19, 2017. There were no public comments on the amendment. The Board of Supervisors had no comments. The Chairperson adjourned the Public Meeting at 6:06. The Chairperson called the Regular Monthly Business Meeting to order at 6:06. PUBLIC COMMENTS Mr. Paul Messish addressed the Board in regard to junk. He stated that some areas have been cleaned-up and others areas have not. He stated that there needs to be more hours devoted to enforcement. Dr. Piper explained that the Codes/Zoning Officer is present one day a week and the Codes/Building Inspector is present in the afternoons fives day a week. 1

Pg. 2 Township Board of Supervisors Meeting Minutes January 19, 2017 Diana Driesslein of 2262 Freeport Road was present to speak about the garbage at the townhouses near the Hulton Bridge. Mr. Seibert suggested that she leave her name and number with Dr. Piper and that Dr. Piper will speak with the Codes Officer Jerry Chalmers asked if the Township is doing anything extra with regard to the MS-4 requirements. Matt Pitsch, Township Engineer stated that 90% of the outfalls have been located and mapped and the Township is working on the Management Plan and Public Education components. Marlene Covallo of Highland Woods was present to address the Board about the road in the development that leads to the pool and asked why the Township stopped winter maintenance activities. Mr. Seibert suggested that Dr. Piper research the development plans to ascertain Township responsibilities. Ms. Covallo was to leave her contact information with Dr. Piper. Kevin Funkhouser, Fire Chief of Allegheny Valley Fire Department present a summary of the departments activities in 2016 as follows: 288 emergency calls, 21 structure incidences and various other calls concerning basements, trees, downed wires, false alarms. The Chief stated volume hours of service at 5945 and other community service activities to include Annual Clean- Up in April, Fire Safety Day at Acmetonia, Trick-or-Treat, and Santa Clause day. The Chief also announced that the Department has intentions to purchase a new Rescue Engine truck with 100% department funds. Margaret Cook of Guys Run Road thanked the Harmar Police Department for implementing the Toy Drive for children of low income families this past Christmas; and thanked Mr. Seibert for his monetary donation for the purchase of toys. Mr. Messich also asked the Board to look at the trees in Acme Park that need trimmed and specifically the tree on the corner where the new playground structure was recently installed. BOARD COMMENTS Mr. Seibert stated that the Township ended the year with a comfortable financial surplus. Once a comprehensive analysis has been completed, he would like to see the Township move approximately $250k to the capital improvement fund. APPROVAL OF MINUTES Mr. Biermeyer made a motion to approve the minutes of the December 15, 2016 meeting. Mr. Exler provided the second and the motion carried unanimously. Mr. Seibert made a motion to approve the minutes of the January 3, 2017 organization meeting, Mr. Exler provided the second and the motion carried unanimously. 2

Pg. 3 Township Board of Supervisors Meeting Minutes January 19, 2017 TREASURER S REPORT Mr. Biermeyer made a motion to approve the Treasurer s Reports for December 1 December 31, 2016. Mr. Exler provided a second and the motion carried unanimously. SOLICITOR S REPORT Solicitor Means presented documents pertaining to the request by Pitt Ohio to have the bond document amended due to a mathematical error at the time of submission. Mr. Means recommended that the Board amend the bond calculations per the Resolution presented under New Business. ENGINEER S REPORT 2016 Paving Project: Mr. Pitsch reported that a written punch list for the project was sent to the contractor (A. Folino) and that Folino had requested a site meeting. 2015 Paving Project: Mr. Pitsch reported that he and the Road Foreman met with representatives from Russell Standard at the Highland Woods development. Russell Standard has agreed to make repairs to the deficient areas. Church Road Manhole: Mr. Pitsch reported that he has obtained quotes for work to be done on sealing the sanitary manhole on Church Road (Old Route 910). OLD BUSINESS Ordinance #419 Zoning Ordinance Amendment (Article IV, Section 4.4) for the height limitation of structures (other than buildings): Mr. Exler made a motion to adopt the ordinance as proposed. Mr. Biermeyer provided the second and the motion carried unanimously. Trumball Request for Release of Performance Bond for Site Grading of Turnpike Bridge on Rich Hill Road: Mr. Seibert made a motion to release the performance bond. Mr. Exler provided the second. Mr. Seibert asked if the Municipal Engineer is recommending release of the bond. Mr. Pitsch explained that he had conducted a final inspection and is recommending release. The motion carried unanimously. Peoples Gas Request for Release of Road Opening Bond for the gas line relocation on Rich Hill Road at the Turnpike Bridge site: Mr. Seibert made a motion to release the road opening bond. Mr. Biermeyer provided the second. Mr. Pitsch explained that he had conducted a final inspection and is recommending release. The motion carried unanimously. 3

Pg. 4 Township Board of Supervisors Meeting Minutes January 19, 2017 NEW BUSINESS Carbon Steel Inspections Zoning Amendment Authorize to advertise Public Hearing: Mr. Means explained that the County requires 45 days to review the proposed amendment and the timing of the proposal would not allow for a Public Hearing until March. Mr. Seibert made a motion to authorize the Public Hearing on Thursday, March 16, 2017. Mr. Exler provided the second and the motion carried unanimously. The Chair addressed representatives of Carbon Steel Inspection who were present at the meeting. Carbon Steel Inspections representatives were in agreement with the Public Hearing date and had no further comment. Service Agreement for Municipal Building Generator: Mr. Seibert made a motion to approve the annual maintenance contract as proposed. Mr. Biermeyer asked if the generator is diesel. Dr. Piper called upon Mr. Chalmers who was present in the audience and was a member of the Board of Supervisors when the generator was purchased and installed. Mr. Chalmers stated that the generator runs on natural gas. Mr. Biermeyer provided a second to Mr. Seibert s motion. The motion carried unanimously. Soccer Complex Pavilion: Mr. Seibert asked for an Engineer s Report. Mr. Pitsch reported that the project was advertised and three bids were received. The highest bid came in at $160,020, the second bid came in at $102,800 and the lowest bid at $81,500 was submitted by Pampena Landscaping. Mr. Seibert made a motion to award the bid to Pampena. Mr. Exler provided the second and the motion carried unanimously. Insight Pipe Contracting to Perform Repairs to Sanitary Sewer Manhole on Church Road (Old Route 910): Mr. Seibert made a motion to approve the quote from Insight Pipe Contracting in the amount of $5,900 plus ancillary fees for the work necessary to repair infiltration. Mr. Biermeyer provided the second and the motion carried unanimously. Resolution to authorize the Chair to sign drawings and documents necessary to accept and record right-of-way and easements as requested by PADOT for the Little Deer Creek Bridge on Jacoby Road: Mr. Seibert asked if demarcation of the Township line and ownership of the bridge has been established. Dr. Piper reported that no drawings have yet been submitted on PADOT s behalf. Mr. Pitsch stated that he assumes that PADOT is taking responsibility since right-of-way drawings are forthcoming. Mr. Seibert stated that grant have been pursued but never awarded because ownership has always been an issue. Mr. Seibert suggested that the Resolution be tabled until drawings are submitted for review. Mr. Chalmers, former Township Supervisor, suggested that the Township use paving materials that contain fiber. Dr. Piper asked if the paving with fibers has been approved by PADOT. Mr. Chalmers stated that he believes that they have been approved. Resolution #3-2017 to Authorize Fees for Services Performed by the Elected Tax Collector: Mr. Seibert made a motion to approve the resolution before the Board. Mr. Exler provided the second and the motion carried unanimously. 4

Pg. 5 Township Board of Supervisors Meeting Minutes January 19, 2017 Resolution #4-2017 to Recognize the Lower Valley Ambulance Service as a Civic/Service Organization in Harmar Township: Mr. Seibert made a motion to approve the Resolution as proposed. Mr. Biermeyer provided the second and the motion carried unanimously. Zoning Officer to Compile a Comprehensive Listing of Nonconforming Uses per the Harmar Township Zoning Ordinance: Mr. Seibert made a motion to authorize the Zoning Officer to compile a comprehensive listing of nonconforming uses per the Harmar Township Zoning Ordinance. Mr. Exler provided the second and the motion carried unanimously. SEIU Bargaining Committee: Mr. Seibert explained that the Public Works Department Union Contract expires at the end of this year. Mr. Seibert suggested that he sit on a Committee with one other Board member to negotiate the contract. The Chair volunteered to also sit on the Committee. Mr. Seibert made a motion to establish the Bargaining Committee as Seibert and Janoski. Mr. Biermeyer provided the second and the motion carried unanimously. Authorization of 2017 Newsletter: Mr. Seibert made a motion to authorize a spring newsletter. Mr. Exler provided the second and the motion carried unanimously. Municipal Records Disposal Request #1-2017: Dr. Piper explained the procedures followed by Township Administration when disposing of public records that are not required to be retained based upon the PHMC Municipal Retention and Disposition of Public Records Manual. Mr. Biermeyer made a motion to approve the request for disposition. Mr. Seibert provided the second and the motion carried unanimously. Resolution #5-2017 to Authorize Amendment No. 2 for the Irrevocable Standby Letter of Credit issued in connection with the Developer s Agreement for the 910 Properties II, LLC (aka Pitt Ohio): Mr. Seibert made a motion to approve the amendment as recommended by the Township s Solicitor, Charles Means. Mr. Exler provided the second. Mr. Means explained that there was a mathematical error in the original letter of credit. The motion carried unanimously. Mr. Exler addressed Diana Driesslein of 2262 Freeport Road and asked that she leave her contact information with Dr. Piper. ADJOURNMENT There being no further business before the Board, Mr. Seibert made a motion to adjourn at 7:05 pm. Mr. Biermeyer provided the second and the motion carried. 5
