CITY OF TOLLESON CITY COUNCIL MEETING MINUTES TUESDAY, AUGUST 23, 2016 7:00 P.M. CALL TO ORDER Mayor Gámez called the Tolleson City Council Meeting to order at 7:00 P.M. INVOCATION/PLEDGE OF ALLEGIANCE The Invocation was delivered by Assistant City Manager Lopez, and the Pledge of Allegiance was led by Vice Mayor Laborin. ROLL CALL Mayor Adolfo Gámez, Vice Mayor Linda Laborin, Council Members Lupe Bandin, Clorinda Erives, Kathie Farr, Albert Mendoza and Juan Rodriguez were present. Page 2 of 14 City Management Department: Noel Schaus Revitalization Manager Community Services Department: Barbara Caraballo Library Coordinator Assistant City Manager Lopez introduced Noel Schaus who is the new Revitalization Manager at the City of Tolleson. She has eleven years of experience with the Arizona Department of Housing, and she is from Washington. She studied Spanish in Mexico and is very fluent, which is a big plus for Tolleson s Housing Program. Noel has been researching potential projects and Community Development Block Grant (CDBG) funding; she will present to Council in September. Library Coordinator Barbara Caraballo is currently at a conference in training and will be introduced to Council at a later date. 2. Tolleson Community Coalition Update President Mario Hernandez of the Tolleson Community Coalition (TCC) presented a PowerPoint presentation summarizing their first year as an organization, revealing all of the partnerships that have been made within the community. Their mission is to strengthen the community s commitment to education by providing much needed financial support. There are currently two positions they are interviewing for: Treasurer and Secretary. Event participation includes the Whoopee Daze Festival, 4 th of July Celebration, Latin Jazz & Mariachi Festival, Tardeada Latina and Luces de Navidad. The profits from the liquor sales are given back to the community. In 2015-16, $44,555.45 was the total revenue. Operational costs totaled $10,928.05, and $19,760.08 was donated to the community in various ways. Donations included student and staff appreciation: $5,650.00 for Tolleson Elementary School District, and $6,148.47 for Tolleson Union High School. The Tolleson CAP Office received $4,000.00 for rental assistance, and the Tolleson Public Library was given $2,000.00 to purchase laptops for the Coding Club. Upcoming projects and goals in 2016 include establishing a partnership with Veterans of Foreign Wars (VFW) to fundraise for their new building and to establish a youth mentorship program between youth and professionals amongst the community. The TCC would like to sponsor two paid internships for individuals who are residents of Tolleson that are looking for a career path in city government. President Hernandez stressed the importance of bringing Tolleson s youth back to the community to begin their careers. Also, two scholarships will be created for leadership purposes and individual professional development. Each potential recipient will have to apply. Another project is the Tolleson Teacher s Closet where donations will be accepted to fill a supply closet
Page 3 of 14 so teachers of Tolleson Elementary Schools and Tolleson Union High School can select various items they need for the school year. The TCC plans to establish the Community Volunteer Reward Program to encourage parents to volunteer at the events in order to contribute towards their child s school or extracurricular activity. Mayor Gámez proposed offering assistance to seniors as well and thanked the TCC for all of their hard work. Council Member Rodriguez thanked President Hernandez for presenting, and he liked the fact that donations are being kept within the schools of Tolleson. Council Member Erives would like to sign up for the youth mentoring program. Council Member Bandin suggested creating a rotating Hall of Fame to show the community who has been successful with the help of the mentoring program. BUSINESS FROM THE FLOOR - PUBLIC HEARINGS AND ACTION 1. City Manager Medrano Jr. expressed his appreciation of the TCC because they are driven by volunteers; they are there because they want to be there.

Page 5 of 14 Following the Public Hearing, Council Action: Approve/Deny Zoning Change Application #16080001 as submitted by Daniel Chacara of Integral Homes LLC, 14613 West Hidden Terrace, Litchfield Park, Arizona 85340, requesting rezoning of approximately 12 acres of property located at the northeast corner of 91st Avenue and Jefferson Street in Tolleson, Arizona 85353 (APN 101-12-613) from existing zoning designation of Light Industrial (I-1) to new zoning designation of Planned Area Development (PAD) for a proposed private gated community of 80 single-family residences. The public hearing opened at 7:24 P.M. and closed at 7:47 P.M. Daniel Chacara of Integral Homes LLC presented a site plan of approximately twelve acres of property located at the northeast corner of 91st Avenue and Jefferson Street, which is the purpose of the zoning change request. He is requesting an existing zoning designation of Light Industrial (I-1) to new zoning designation of Planned Area Development (PAD) for a proposed private gated community of 80 single-family residences. This community would be called the Vineyard, and Mr. Chacara would also like the street named Harvest Lane instead of Jefferson Street. There will be five parks; the largest one is north of the community due to the proposed public utility easement. The existing line will be eliminated and moved to the side of the street. Mr. Chacara plans to use the existing waterline in the center of the property; however, he has a new waterline proposal that will flow among the main street towards 91 st Avenue. This patio home style neighborhood will have backyards that are 40 feet wide and 35 feet long with a 20 foot setback for the garage. Options include a three bedroom floor plan with a front porch totaling 1,375 square feet or a four bedroom floor plan of 1,612 square feet. In previous developments, houses sold before they were even listed, and they sell fast. Homes have built-in features, granite countertops, stainless steel appliances, walk-in closets, double-wide sliding doors, back patios, etc. Houses will not be identical due to the cobblestone and brick stone décor and different pitch elevations. The development will be built in four phases: sewer, water, 91 st Avenue improvements, and 20 homes per phase. City Engineer Gilmore noted the application is for a zoning change, and the Planning & Zoning Commission recommended approval unanimously subject to the nine recommended stipulations for both applications. Mayor Gámez didn t think this particular piece of land would be used for homes, and he was very impressed with the design. Mr. Chacara wants to make these houses affordable for those families that can t pay for the big, expensive homes. The price range will be around $170,000 for the three bedroom layout and $190,000 for the four bedroom layout, even if the housing market increases.
Page 6 of 14 The gates will have automatic devices for emergency vehicles, and there will be a Homeowners Association (HOA) to have the common areas taken care of: cut the grass, water the trees, maintain the light poles, etc. HOAs can be pricey due to the expenses it takes to manage the community. Therefore, Mr. Chacara is looking into establishing their own nonprofit HOA to keep the fees down for residents. Council Member Rodriguez expressed his dissatisfaction with private developments and HOAs. However, he was very pleased with the site plan because it will bring more residents to the community. He didn t think this empty lot could be developed since it is between Home Depot and the apartments. He emphasized every square inch of property matters. He suggested including Tolleson into the name. Mr. Chacara revealed that the sign will display The Vineyard at Tolleson. Council Member Rodriguez thanked Mr. Chacara for not giving up on the community of Tolleson. Since there are seven warehouses east of the development, a gate will be integrated to stop trucks from driving through the neighborhood. Council Member Farr confirmed no houses will touch one another. Parking will be permitted on both sides of the 40 foot wide street. City Engineer Gilmore noted that street names usually follow the grid, and exceptions have been historical names. Mayor would like to have the street name discussed and voted on at a later date. Mr. Chacara hopes to break ground in October, and the project should take fourteen to twenty months to complete. He mentioned the process is faster due to the quick inspections that the City provides; they should complete five houses every six weeks. Motion made to approve Zoning Change Application #16080001 with City Engineer Gilmore s nine stipulations by Vice Mayor Laborin and seconded by Council Member Rodriguez. Motion carried 7-0. 4. The proposed site (APN 101-12-613) is approximately 12 acres and is currently zoned PAD (Planned Area Development). Following the Public Hearing, Council Action: Approve/Deny Site Plan Application #16080002 as submitted by Daniel Chacara of Integral Homes LLC, 14613 West Hidden Terrace, Litchfield Park, Arizona 85340, for a proposed private gated community consisting of 80 single-family zero lot line residences, to be located on the northeast corner of 91st Avenue and Jefferson Street in Tolleson, Arizona. Mr. Chacara stated this application is a reiteration of what was previously explained in the zoning change public hearing. From one house to the next, the space will be six to nine feet. Every resident is going to have a side gate. City Engineer Gilmore pointed out the same nine stipulations will apply. Motion made to approve Site Plan Application #16080002 with City Engineer Gilmore s nine stipulations by Council Member Bandin and seconded by Council Member Mendoza. Motion carried 7-0. 5. Public Hearing Soliciting comments from interested parties in reference to Zoning Code Amendment Application #16080003 as submitted by Doug McCord of Architectural Resource Team, 99 East Virginia Avenue, Suite 120, Phoenix, Arizona 85004, requesting zoning code amendment to Planned Area Development District ( 12-4-80 through 12-4-84) to decrease parking requirements and allow parking stalls within the building setbacks to allow flexibility for future restaurant/retail development for the properties located at 8343 and 8363 West Van Buren Street in Tolleson, Arizona 85353 (APNs 101-12-619 and 101-12-620), which are currently zoned Planned Area Development (PAD). Following the Public Hearing, Council Action: Approve/Deny Zoning Code Amendment Application #16080003 as submitted by Doug McCord of Architectural Resource Team, 99 East Virginia Avenue, Suite 120, Phoenix, Arizona 85004, requesting zoning code amendment to Planned Area Development District ( 12-4-80 through 12-4-84) to decrease parking requirements and allow parking stalls within the building setbacks to allow flexibility for future restaurant/retail development for the properties located at 8343 and 8363 West Van Buren Street in Tolleson, Arizona 85353 (APNs 101-12-619 and 101-12-620), which are currently zoned Planned Area Development (PAD). The public hearing opened at 7:52 P.M. and closed at 8:03 P.M. Doug McCord of Architectural Resource Team explained these two properties are combined as one totaling 24,000 square feet on the southwest corner of 83 rd Avenue and Van Buren Street. It s for retail and residential development with two potential spots for drive-thru restaurants. The goal is to create a large gathering space for people to enjoy with trees, shade, lots of landscaping and water features. They fit as much parking as they could with full fire access around the property. People can eat inside or outside.
Page 8 of 14 Requested parking calculation is as follows: For 85% restaurants and 15% retail, the total parking required per Zoning Ordinance is 250. The total parking proposed per PAD modification is 177. For 50% restaurants and 50% retail, the total parking required per Zoning Ordinance is 173. The total parking proposed per PAD modification is 177. City Engineer Gilmore revealed that the Planning and Zoning Commission recommended approval with the eleven stipulations. He continued by stating it will be on the record that the buyer is aware there will be less parking than required by City Code. Council Member Rodriguez confirmed the parking is only for this development and not the warehouses. He would like to make sure retail is the primary focus and stated the product is exceptional because it is designed for people to enjoy. People can congregate and feel safe because the Police Department is across the street. Economic Development Director Earp added this development will complement the surrounding warehouses because the workers will have more places to eat during their short lunch breaks. Soliciting comments from interested parties in reference to Site Plan Application #16030001 as submitted by Melanie Hodge of Hansen-Rice, Inc., 1717 East Chisholm Drive, Nampa, Idaho 83687, for the proposed expansion and renovations to the existing Albertson s Tolleson Distribution Center located at 400 South 99 th Avenue, Tolleson, Arizona 85353. The site (APNs 101-12-263 & 101-12-634) is approximately 85 acres and is currently zoned I-1 (Light Industrial). Following the Public Hearing, Council Action: Approve/Deny Site Plan Application #16030001 as submitted by Melanie Hodge of Hansen-Rice, Inc., 1717 East Chisholm Drive, Nampa, Idaho 83687, for the proposed expansion and renovations to the existing Albertson s Tolleson Distribution Center located at 400 South 99 th Avenue, Tolleson, Arizona 85353. The site (APNs 101-12-263 & 101-12-634) is approximately 85 acres and is currently zoned I-1 (Light Industrial). The public hearing opened at 8:07 P.M. and closed at 8:14 P.M. The General Manager of Albertsons displayed their appreciation of the 23 year partnership with the City of Tolleson. City Engineer Gilmore stated this site plan application is for a warehouse expansion and recycling center. There were numerous iterations in fine tuning the draft site plans until this point. Albertsons will have full improvements done on 99 th Avenue with block walls and landscaping. They are requesting to have a secondary access road on the north side into Van Buren Street for employees. Staff is supportive of the site plan subject to the eleven stipulations. Mr. Stephen Krager is purchasing property on the southwest corner and questioned if the stipulations still apply if there is not an easement because he believes it does not exist. Albertsons just learned about the easement and believes it still exists even though other sources say otherwise. It is south of Van Buren Street between the two properties where the proposed secondary access road would be to Albertson s property. City Attorney Schmidt stressed since the status of the easement is uncertain at this point, approval of this site plan application does not guarantee Albertson s right to build the road. Therefore, this site plan will be approved without the secondary access road if the easement is not acquired. Motion made to approve Site Plan Application #16030001 by Vice Mayor Laborin and seconded by Council Member Erives with City Engineer Gilmore s eleven stipulations and the following added stipulation:
Page 10 of 14 If an easement for secondary access road through adjacent property to the north, connecting Albertsons to Van Buren, is not acquired, then alternative emergency access shall be provided to the satisfaction of the City Engineer. Motion carried 7-0. CONSENT AGENDA ACTION ITEMS Items on the Consent Agenda are of a routine nature and are intended to be acted upon in one motion. Council Members may pull items from Consent if they would like them considered separately. a. Approve Minutes: Special City Council Meeting Minutes of July 5, 2016 and Work Study & Regular City Council Meeting Minutes of July 12, 2016. b. Approve Claims and Bills. (Documentation may be reviewed at City Hall during regular business hours.) c. Approve Cooperative Purchasing Agreement between the City of Tolleson and Econolite Control Products, Inc. for the Vendor to provide traffic signal poles and components, and authorize the City Manager to execute said documents on behalf of the City. The City shall pay Vendor for the initial term and for each subsequent renewal term, if any, an annual aggregate amount not to exceed $100,000.00 for materials. The maximum aggregate amount for this Agreement, including all renewal terms, shall not exceed $300,000.00. d. Approve Cooperative Purchasing Agreement between the City of Tolleson and Sierra Transportation and Technologies, LLC for the Vendor to provide traffic signal poles and components, and authorize the City Manager to execute said documents on behalf of the City. The City shall pay Vendor for the initial term and for each subsequent renewal term, if any, an annual aggregate amount not to exceed $25,000.00 for materials. The maximum aggregate amount for this Agreement, including all renewal terms, shall not exceed $75,000.00. e. Approve Cooperative Purchasing Agreement between the City of Tolleson and World Wide Technology for the Vendor to provide network equipment and services, and authorize the City Manager to execute said documents on behalf of the City. The City shall pay Vendor for the initial term and for each subsequent renewal term, if any, an annual aggregate amount not to exceed $100,000.00 for materials and services. The maximum aggregate amount for this Agreement, including all renewal terms, shall not exceed $500,000.00. f. Approve Professional Services Agreement between the City of Tolleson and Hach Company for the Vendor to provide water and wastewater approved testing equipment and related maintenance and support services, and authorize the City

The City shall pay Vendor for the initial term and for each subsequent renewal term, if any, an annual aggregate amount not to exceed $60,000.00 for materials and services. The maximum aggregate amount for this Agreement, including all renewal terms, shall not exceed $180,000.00. g. Approve Subordination of City Waterline Easement and Access Agreement by the City of Tolleson, Arizona, an Arizona Municipal Corporation, and authorizing the Mayor to execute said Agreement on behalf of the City. In order to permit Old Dominion, as the owner of the property encumbered by said Waterline Easement, to record said USA Easement, the United States has required that the City subordinate the Waterline Easement to the USA Easement. h. Approve Overhead and Underground Power Distribution Easement between the City of Tolleson, Arizona, an Arizona Municipal Corporation, as Grantor, and Salt River Project Agricultural Improvement and Power District, an agricultural improvement district organized and existing under the laws of the State of Arizona, as Grantee, and authorizing the Mayor to execute said Agreement on behalf of the City. The Grantee is hereby authorized to permit others to use the Easement for additional facilities jointly with or separately from the Grantee for their purposes. i. Adopt Resolution No. 2303 of the Mayor and Council of the City of Tolleson, Arizona, approving the modification to Intergovernmental Agreement between the City of Tolleson and the State of Arizona acting through the Arizona Department of Revenue regarding the administration of taxes imposed by the City; authorizing the Mayor to execute and deliver the modification to said Agreement. j. Adopt Resolution No. 2305 of the Mayor and Council of the City of Tolleson, Arizona, approving the Intergovernmental Agreement between Tolleson Union High School District No. 214 and the City of Tolleson relating to services of School Resource Officers; and authorizing the City Manager to execute and deliver said Agreement. k. Approve Purchase Order No. 67535 payable to K&K Systems in the amount of $50,000.00 for four solar-powered, portable and changeable message signs for City traffic and event advisories ($12,500.00 each). l. Woodruff Construction The construction services to be performed under each contract will include but are not limited to the following: street repair, construction, lighting and landscaping; facade construction; masonry and stucco restoration; painting, awning replacement; sign removal and replacement; trim work; utility removal; lighting improvements; landscaping; window repairs; fencing; door repairs; trash enclosures and receptacles; security improvements; parking lot resurfacing and striping; building demolition; and other interior building improvements. City Manager is hereby authorized to execute contracts for small municipal construction projects in amounts not to exceed $250,000.00. REGULAR AGENDA ACTION ITEMS MAYOR/CITY MANAGER S REPORT OF CURRENT EVENTS 1. Alternative Expenditure Limitation (Home Rule Option) Primary Election Tuesday, August 30, 2016 2. General Election Tuesday, November 8, 2016 (Any candidate receiving a majority of all votes cast at the Primary Election will be declared elected without running at the General Election.) 3. Legislative Update There are no updates at this time. The League of Arizona Cities and Towns is currently working on a Resolution packet. 4. Community Events & Programs Update Tardeada Latina Celebration Saturday, September 17 th (1 P.M. to 12 A.M.) and Sunday, September 18 th (1 P.M. to 9 P.M.) in Downtown Tolleson Paseo de Luces. Assistant City Manager Lopez revealed the event will include performances by David Lee Garza y Los Musicales and Reality Band.
Page 13 of 14 There will be a car show, mariachis and amateur boxing with Iron Boy Promotions 15 to 20 fights with three minute rounds. On October 29 th, a Pro Boxing event will be held with Iron Boy Promotions at Veterans Park. There will be two beer booths to help fundraise for the Veterans new building. The event is free; however, tickets for VIP seating will be sold. Council Member Rodriguez was concerned because not everyone agrees with boxing, and it s at a public venue. He expressed concern having the City facilitate an event for an outside promotion company. He recalled when the promoter for the R. Kelly concert came before Council before they applied for the permit. He stated this is the first time Council is hearing about the event; the information should have been presented to Council before final plans were made. Council Member Rodriguez continued by stressing that every event represents Council and the City. Mayor Gámez noted Tolleson is a big sports city and agreed that Iron Boy Promotions should come before Council to present the details. City Manager Medrano Jr. reiterated the boxing event at Tardeada Latina would serve as an introduction to this event. Staff saw an opportunity to televise and shine the global light on the City of Tolleson so they tackled it. Council Member Rodriguez believes rules need to be set for these types of events. He agreed it is an administrative task; however, it should have been an informational item on the agenda. Council Member Bandin added there needs to be a line drawn that differentiates the types of events. As Assistant City Manager Lopez pointed out, the City works with promoters all of the time for famous singers at events. Whether it s boxing or singers, both have promoters. Community Health Expo and Pet Expo Saturday, October 22 nd at Veterans Park from 10 A.M. to 2 P.M. ADJOURNMENT The Paint-A-Thon and Pride Day will be held on October 22 nd as well. The City is working with the Maricopa County Housing Department to identify which houses to paint. This year, the City would like to pick residences in need of yard clean-up as well. The City s hospitality suite at the League s Annual Conference will be held tomorrow at 7:30 P.M. at the Fairmount Scottsdale Princess Resort. It will be used to introduce Tolleson to all of Arizona.
