District Court 2nd Judicial District Prosecutor File No. 0620408476 Court File No. 62-CR-18-8471 COMPLAINT Order of Detention The Complainant submits this complaint to the Court and states that there is probable cause to believe Defendant committed the following offense(s): COUNT I Charge: Criminal Sex Conduct-3rd Degree-Victim Mental Impair/Helpless Minnesota Statute: 609.344.1(d), with reference to: 609.17.1, 609.344.2(1) Maximum Sentence: 7.5 years or $15,000 fine or both Offense Level: Felony Offense Date (on or about): 11/03/2018 to 11/04/2018 Control #(ICR#): 18057212 Charge Description: On or between November 3, 2018 and November 4, 2018, in the County of Ramsey, Minnesota, the defendant, Jeffrey Mark Eldred, did attempt to engage in sexual penetration with another person, knowing or having reason to know that the victim was mentally impaired, mentally incapacitated, or physically helpless. 1

STATEMENT OF PROBABLE CAUSE On November 16, 2018, NK (DOB: 11/18/1987) made a report with the Ramsey County Sheriff s Office regarding a criminal sexual conduct incident that had occurred a couple of weeks earlier. On November 3, 2018, NK went on a date with JEFFREY MARK ELDRED (DOB: 12/20/1985) who she had met on the Tinder dating application. NK went to Eldred s residence at 1383 Willow Creek Lane, Shoreview, Ramsey County. NK said they drank and made out while naked in Eldred s bed. NK did not want to drive after she had been drinking alcohol so she slept in Eldred s bed. NK awoke to Eldred putting his penis in her face. Eldred tried to put his penis in her vagina at least 10 times throughout the night. NK told Eldred no each time, but Eldred would try again a short time later. On November 4, 2018, NK asked Eldered about what had happened during the evening, but he claimed not to recall the incident. Eldred was acting normally so NK decided to hang out with him. Eldred let NK use his computer for her class. NK saw at least 40 videos on Eldred s computer that appeared to show Eldred putting his penis in different women s mouths and vaginas as they slept. NK could not get the videos to play, but she took photos of the videos which she showed to law enforcement. The videos were apparently identified with initials of the woman who was in them. NK reported the incident to police because she was worried that it was going to continue happening to other women. On November 21, 2018, police executed a search warrant at Eldred s residence. Eldred was advised of his constitutional rights and agreed speak to Investigator O Hern. Eldred was advised that police were investigating a sexual assault allegation involving NK. Eldred said they met on a dating website. He said on November 3, 2018, they were drinking wine on the couch and went into the bedroom where they had consensual sex. Eldred claimed they had sex multiple times that evening. After NK took a shower, she told him she no longer wanted to have sex that evening. He said the next morning they hung out and he let her use his work computer. When asked if they had any conversation about what happened the night before, Eldred said they did not, but he said he did not know why she left so suddenly. Investigator O Hern told Eldred that NK had seen photographs and videos of women on his Gmail account. When asked to explain the videos, Eldred said they were of his on-again/off-again girlfriend NJ. Eldred claimed they would get drunk and take videos, but NJ was aware of the videotaping. When asked about the videos with other initials, Eldred claimed there was someone from New York but he did not recall her name. Eldred explained that he emailed himself everything because he did not want the items on his phone because he was still married at the time. Eldred was not arrested when the search warrant was executed because law enforcement was still investigating the incident. Police recovered Eldred s current cell phone while executing the warrant. Investigator Wallet was given the cell phone for processing. The cell phone contained a naked video of NK and sexually explicit videos of NJ (DOB: 07/14/1986). It was apparent that neither woman knew they were being videotaped. Analysis of Eldred s phone revealed a video from 12:53 AM on November 4, 2018. NK is shown naked and asleep. NK woke up and asked him why he turned the flashlight on her. Eldred replied, I want to see it, as he made a video of NK s vagina. The phone also contained several videos of NJ where she appeared to be sleeping while Eldred digitally penetrated her or had his penis by her sleeping face. NJ met investigators for an interview and she explained that she dated Eldred off-and-on for the past year. NJ explained they usually stayed at her house. When asked if she was aware that Eldred had been videotaping her while she was passed out, NJ said she was not. NJ said one time they were at a conference in Arizona and she found something weird on her phone the next day after they had gotten really 2

drunk. Eldred claimed she had asked him to take pictures of her. She asked Eldred if he had any photos of her and he claimed he did not. NJ said that Eldred claimed to have deleted the items, but he would later threaten to send the naked photo of her to NJ s new boyfriend. NJ was shown a photo where Eldred had ejaculated on her face. She identified herself in the photo and said she did not recall anything about it. NJ said, He literally has a picture of his dick next to my face passed out. He took a picture of that. Who fucking does that? That is so fucked up. NJ said the photo was from when they were at a hotel in Bloomington from September 23, 2018. NJ said she never agreed to let Eldred take a video of her. Later that day, Eldred began texting NJ saying he sorry and asking her if she was going to press charges. Eldred claimed he was blacked out and begged NJ not to press charges. NJ then called Eldred. Law enforcement recorded the conversation. Eldred denied having sex with multiple people or videotaping them. He said he only had sex with her on one video and he was sorry about that. Eldred denied he was raping the women and said he did not share the videos with anyone else. Eldred said he was sorry that he had not deleted them. Eldred claimed he was going to sue NK. Eldred claimed NK gave him a blow job and that was it. Eldred claimed he did not rape NJ but said he was black-out drunk with her. Eldred told her he had gotten a new phone and said he no longer had access to anything on his phone. NJ told Eldred to no longer contact her. Within minutes of the phone call, Eldred resumed texting NJ. On November 21, 2018, deputies arrested Eldred at his residence after he had contacted NJ and deleted items from the cloud. Deputies recovered an iphone from Eldred. Eldred was advised of his constitutional rights and again agreed speak to law enforcement. Eldred said he got the cell phone that day so he could talk to NJ. When asked if he had communicated with NJ in an attempt to dissuade her from cooperating with the investigation, Eldred asked for an attorney. Law enforcement continues to attempt to identify the women in the videos and to determine where the videos of NJ were taken.
