National Pan-Hellenic Constitution Morehead State University Article I NAME & PURPOSE Name: The name of this organization shall be the Morehead State University National Pan- Hellenic Council, hereinafter, called the MSU NPHC. Sovereignty: The MSU NPHC is the supervisory and governing body of the men s and women s social fraternities/sororities who are members of the National Pan-Hellenic Council at Morehead State University. It shall have the power to establish and administer rules, guidelines, and policies that enhance and promote the welfare of its member chapters and aids in achieving its purpose. Purpose: Its purpose shall be to promote unity among all Greek chapters, encourage Greek life to non-members, promote social and recreational activities among its membership, promote scholarship among its members, and uphold the interests of its members and the University to the end that conditions of its member chapters and their relations with the University may be improved. This organization will work in harmony with the University in order to help achieve its academic mission. Powers: The National Pan-Hellenic Council shall have the power to adopt rules and regulations governing all areas listed in this Constitution. It should also be considered the governing body of all affiliate members and is the umbrella organization for its members. Principle Mailing Address: The principle mailing address of this organization shall be: Article II ORGANIZATION/MEMBERSHIP The MSU National Pan-Hellenic Council Morehead State University 150 University Blvd. #1291 Morehead, KY 40351-1689 Membership: Only chapters whose organizations are recognized by, their national organizations may participate with the MSU NPHC. In order to remain active as a collegiate council, MSU NPHC must have no fewer than two participating member organizations active with the council, unless permission to continue to function is granted by the Office of Greek Life. Only chapters operating on the campus of Morehead State University are eligible to participate with MSU NPHC. The regular membership of the MSU NPHC shall be composed of a voting and alternate delegate from each chapter affiliated with NPHC. These representatives shall be selected by their respective fraternity or sorority to serve for one year beginning with the first MSU NPHC meeting of the fall semester. Chapters with a Cumulative GPA under a 2.50 may not hold any programs unless they are educational or community service based and may not participate in any MSU NPHC sponsored step show activities. 1

Colony Membership Definition: A colony is a probationary body of MSU NPHC. It is considered a Greek organization that is awaiting official recognition from the university. If the colony prospers and meets the requirements set by the university, the colony may be considered an active chapter. Colony Membership: Colonies of NPHC organizations may send a delegate and alternate delegate to the MSU NPHC Council but they will not have a vote or hold an office in the election process. Dues: Dues for each member chapter and colony chapter affiliated with the MSU NPHC shall be established in the bylaws. These dues cannot be changed more than once every academic year. Dues are to be paid by member chapters and colony members. Advising: A member of the Division of Student Life of Morehead State University shall be an advisor to this organization, appointed by the Office of Student Activities. The advisor is an exofficio, non-voting member of both NPHC and the Executive Committee. Article III MEETINGS Section 6: Quorum: To conduct business a simple majority of the NPHC representatives and Executive Officers must be present at the meeting. Voting percentages: Motions dealing with amendments to this Constitution and the removal of officers or members will require a three fourths majority vote of the total voting membership. All other motions will require a simple majority vote of the quorum to pass. Frequency of meetings: The NPHC shall meet at least once a month during the academic year. The time and place shall be as stated by the Council at the first meeting of each semester. The President or a majority of the chapter delegates may call a special meeting. Chapter delegates file their request for a special meeting with the Advisor per written request. Notice of special meetings will go out to the delegates and Executive Council no less than 48 hours in advance, sent by the Advisor. Parliamentary authority: The Constitution of this organization shall be the supreme authority in parliamentary procedure at all meetings. The Bylaws of this organization shall be the next highest authority. Robert s Rules of Order shall be the procedure used to conduct meetings except where it conflicts with the Constitution or with the Bylaws. Missing meetings: All member chapters shall be required to have the appropriate number of delegates in attendance at each meeting or event. Any member chapter failing to have the appropriate number of delegates shall be fined, unless an excused absence is approved by the advisor 6 hours in advance. Such amount shall be set at $25 per violation. Delegate responsibilities: The delegates from each member organization shall be responsible for notifying his or her chapter of all matters discussed in regular and special meeting of the Morehead State University National Pan-Hellenic Council. Failure to attend or provide an excuse will result in penalties as outlined in Title V, Section 3 of the MSU NPHC Bylaws. There may only be 2 chapter delegates at any meeting. Article IV COUNCIL OFFICERS AND THEIR DUTIES 2

Officers: Elected officer positions will be designated in the bylaws. Executive Committee Composition: The Executive Committee of the MSU NPHC shall be composed of all officers. The advisor or advisors are also part of the Executive Committee as an ex officio, non-voting member. Term of Office: The Executive Committee officers shall serve for a term of one year, the term of office to begin with MSU NPHC Council in April. Vacancy: When a delegate or officer vacancy occurs mid-term, it shall be the responsibility of the President to issue a call for nominations for the vacant position within two weeks. One the vacancy has been filled the President will inform the council immediately. Article V -- IMPEACHMENT Definition: Impeachment is defined as the removal of an individual from his or her Executive Committee position for mis, mal or nonfeasance of office. Additionally, Executive Committee Members may be impeached for unethical/inappropriate behavior. Executive Officers having more than three (3) absences, excused or unexcused, from Council meetings may be impeached. Impeachments are not a Judicial Board affair. Procedures for impeachment: a. A representative or Executive Officer must move that a specific Executive Officer be removed. That member must state the charge or charges and reasons why he/she feels the Executive member should be removed at the time he/she makes the motion. b. The highest ranking Executive Officer not charged shall take over the proceedings. c. The Executive Officer charged may offer answers or explanations to the charges brought against him/her. d. If the accused Executive Officer is not present at the time of the charges, then a written notification of the charges shall be delivered to the accused. The impeachment proceeding shall be tabled until the next scheduled meeting of the Council. If the accused fails to attend this next meeting, the proceedings will continue. e. The charged Executive Officer will then leave the meeting as a vote is taken of the Council. f. Should three-fourths (3/4) of the Council vote in the affirmative to impeach the Officer, then he/she shall be removed from office and be ineligible to hold a seat on the Council. Should less than three-fourths (3/4) vote be in the affirmative, then the charge shall be dropped. g. It is the responsibility of the chapter that holds the officer position to appoint a replacement from their chapter. Article VI JUDICIAL BOARD Name, Purpose and Function: The name of the Judicial Board shall be the National Pan- Hellenic Council Judicial Board. The Judicial Board shall be a student disciplinary organization whose primary function is jurisdiction over the NPHC s member chapters, their members, and pledges/associates. The Judicial Board shall have the power to investigate, and recommend penal action of chapters to the Greek Affairs Coordinator when a formal charge has been placed before the Board by the Greek Affairs Coordinator or the President of the NPHC of a violation of rules 3

and regulations of Morehead State University or rules and regulations of the NPHC, or of conduct unbecoming a fraternity or sorority. Composition: The Board shall be composed of the Vice Presidents of the member chapters or a designee of the chapter appointed by the chapter president. The chairperson of the Board shall be the Vice President of the NPHC. He/she shall: a. Preside over the hearing. b. Call all meetings and hearings of the board. c. Enforce strict observance of the rules and regulations of MSU and the NPHC. d. Vote only in case of a tie. The Secretary of the Board shall be the Secretary of the Council. His/her only duty will be to take the minutes of the proceedings of all meetings and hearings of the Judicial Board. He/she can neither participate in the discussion nor vote on the verdict. A representative from the Division of Student Life shall serve as Advisor to the Judicial Board. Proceedings: All accusations must be turned in to the Coordinator of Greek Affairs and the President of the Council in typewritten form. The Council President shall present formal notice of the accusation to the Vice-President within 36 hours. The Vice-President shall contact the Vice-President of each member chapter and set a time, date, and place for the hearing within five (5) school days, but not less than three (3) school days after he receives formal notice from the Council president. The defendant shall be given no less than 72 hours notice of the time, date, and place of the Judicial Board hearing. At the time set by the chairman of the Judicial Board, the complainant and the defendant shall appear and present preliminary arguments. At this time, if the majority of the Board feels there is enough evidence to try the case, the trial shall begin. The members of the Board whose chapter is the defendant or is the complainant shall not participate as a member of the Judicial Board. The defendant is responsible for his/her own defense. The defendant may cross examine witnesses; call witnesses on their behalf, and has right to counsel. The defending chapter may have counsel representing them and has the right to have its chapter advisor present. Any investigation deemed necessary by the Judicial Board shall be conducted by the President of the Council. The Board shall have the right to make additional temporary provisions for execution of its business for each case. Quorum & Voting Percentages: A majority of the voting members of the Board shall constitute a quorum. On the question of responsible a majority of the quorum shall determine the verdict. A majority vote of the quorum shall determine the degree of punishment. Appeal: Chapters shall have the right to appeal a decision of the National Pan-Hellenic Council Judicial Board to the vice president of student life or the dean of students. They shall overturn the decision, amend the decision or uphold the decision as he or she determines. Article VII AFFILIATION WITH THE NPHC NATIONAL OFFICE This organization shall follow all National Pan-Hellenic Council constitution and by-laws that do not conflict with Morehead State University policies. 4

Article VIII SPECIAL FUNDING Funding Process: The council requires an organization use monies for the trip and may ask for receipts. The maximum amount that may be given will be one-ninth of one-half of the previous step show intake. The chapter requesting funds must be in good standing with the University, the council and have provided a service to both. The request must be submitted by the council meeting that is at least six weeks before the conference, summit or convention in question. Article IX AMENDMENTS Proposal: Any member chapter may submit a proposed amendment to this Constitution in written form through its representative to the Council at any regular meeting. Presentation: The proposed amendment shall be read to the Council when presented. A threefourths majority vote of the members of the Council shall be necessary to approve the proposed amendment for presentation to its member chapters. Chapter Notification: Once approved by the National Pan-Hellenic Council, a proposed amendment or constitutional change must be given to each member chapter in writing. Each member fraternity must be given at least one week from the time such proposal is approved and submitted in writing before it can be voted on at a Council meeting. (i.e.: A proposal cannot be submitted and voted on at the same meeting.) This allows each chapter to take it back to a chapter meeting. Failure for a member chapter not to have a chapter meeting during this week will not be considered as an excuse to table for an additional week, unless such reason was for a recognized school holiday or the death of one of its members. Final Approval: All amendments shall be subject to the approval of the Constitution and Bylaws committee and the Coordinator of Greek Life.
