(Afrikaans text signed by the State Presiknt.) (Assented to 19th June, 1973.) BE IT ENACTED by the State President, the Senate and the House of Assembly of the Republic of South Africa, as foliows:- 1. In this Act, unless the context otherwise indicates- (i) "certify", in relation to a measuring instrument, means to stamp, seal or mark, after verification or testing, with a certifying stamp, seal or mark, or to certify in writing in accordance with the 'provisions of this Act, and the word "recertify" has a corresponding meaning; (xx) I (ii) "contract measuring instrument" means a measuring instrument which any person who is a registered mechanic in respect of that instrument may, by virtue of a certificate issued under section 36 (I), (2) or (3), repair without complying with the provisions of section 34 (I); (ix) (iii) "correct", in relation to any measuring instrument, means correct with due allowance for the limits of error or sensitivity prescribed by regulation; (viii) (iv) "council" means the Metrology Council established under section 6; (xvii) (v) "director" means the Director of Trade Metrology appointed or deemed to be appointed under section 2; (i)! (vi) "examiner" means any examiner appointed under section 4; (xiii) (vii) "goods in prepacked form" means any commodity made up or packaged in any manner as a single unit or entity prior to the time of sale thereof (irrespective of whether such unit or entity consists of one or more than one item ofsuch commodity and irrespective of whether such unit or entity is wholly or partly enclosed or is unenclosed and irrespective of the method used to obtain such unit or entity) for the purpose of selling such commodity as such unit or entity, and the word "prepacked", when used in connection with the word "goods", has a corresponding meaning; [iii) (viii) "inspector" means any inspector appointed under section 3; (vii)! (ix) "measuring instrument" means any appliance, equipment, instrument, apparatus or other thing or any combination thereof by means of which a measurement of physical quantity, expressed in any measuring unit or a mathematical function of measuring units, may be made, and includes any appliance, eqnipment, instrument, apparatus or other thing or any combination thereof by means of which a grading or counting in connection with the measurement of any physical quantity may be effected; (xi)

DAAR WORD BEPAAL deur die Staatspresident, die Senaat en die Volksraad van die Republiek van Suid-Afrika, soos volg:- 1. In hierdie Wet, tensy uit die samehang anders blyk, Woordbepaling. beteken- (i) "direkteur" die Direkteur van Handelsmetrologie wat kragtens artikel 2 aangestel is of geag word aangestel te wees; (v) (ii) "geregistreerde werktuigkundige" iemand wat ingevolge artikel 35 (I) as 'n werktuigkundige geregistreer is, en, met betrekking tot 'n meetinstrument, iemand wat aldus ten opsigte van daardie meetinstrument of die klas of fabrikaat waartoe daardie meetinstrument behoort of alle meetinstrumente geregistreer is; (xv) (iii) "goedere in voorafverpakte vorm" ware wat, voordat dit verkoop word, op enige wyse as 'n enkel eenheid of geheel opgemaak of verpak word (ongeag of so 'n eenheid of geheel uit een of uit meer as een item van daardie ware bestaan en ongeag of so 'n eenheid of geheel heeltemal of gedeeltelik omhul is of nie omhul is nie en ongeag die metode waarvan gebruik gemaak is om so 'n eenheid of geheel te verkry) met die doel om daardie ware as so 'n eenheid of geheel te verkoop, en het die woorde "voorafverpak" en "voorafverpakte", waar dit in verband met die woord "goedere" gebruik word, 'n ooreenstemmende betekenis; (vii) (iv) "grootheid", met betrekking tot meting, 'n begrip wat gemeet kan word en waarvan die grootte in 'n meeteenheid uitgedruk kan word; (xii) (v) "handel" ook- (a) die sluiting of aangaan van 'n kontrak, ooreenkorns, verkoop, koop of transaksie, of 'n betaling in verband daarmee; of (b) (e) betalings vir dienste gelewer; of die invordering van tolgelde, heffings, belastings of ander gelde, in verband waarmee 'n meetinstrument gebruik is; (xxii) (vi) "hierdie Wet" ook 'n regulasie of 'n proklamasie; (xxi) (vii).jnspekteur" 'n inspekteur wat kragtens artikel 3 aangestel is; (viii) (viii) "juis", met betrekking tot 'n meetinstrument, juis met inagneming van die onnoukeurigheids- of gevoelisheidsperke wat by regulasie voorgeskryf is; (iii) (ix) "kontrakmeetinstrurnent" 'n meetinstrument wat iemand, wat 'n geregistreerde werktuigkundige ten opsigte van daardie meetinstrument is, uit hoofde van

(x) "measuring unit" means any unit published or prescribed in terms of section 3 of the Measuring Units and National Measuring Standards Act, 1973, but does not include any such unit which, by regulation made under this Act, is excluded for the. purposes of this Act; (x) (xi) "Minister" means the Minister of Economic Affairs; (xii). (xii) "physical quantity", in relation to measuring, means any concept capable of being measured and of which the magnitude can be expressed in terms of a measuring unit; (iv) (xiii) "prescribed purpose", in relationto the use, possession, manufacture or import of any measuring instrument or in relation to the expression of the quantity of goods, means any purpose prescribed by regulation; (xxv) (xiv) "proclamation" means any proclamation made under this Act; (xvi) (xv) "registered mechanic" means any person who is in terms of section 35 (I) registered as a mechanic and, in relation to any measuring instrument, any person who is so registered in respect of that measuring instrument or the class or make to which that measuring instrument belongs or ofall measuring instruments; (ii) (xvi) "regulation" means any regulation made under this Act; (xviii) (xvii) "Republic" includes the territory of South West Africa; (xix) (xviii) "sell" includes to offer, advertise, keep, expose, transmit, convey, deliver or prepare for! sale, or to exchange or to dispose of for any consideration whatever, or to transmit, conveyor deliver In pursuance of a sale, exchange or disposal as aforesaid, and the words "seller", "selling", "sale" and "sold" have a corresponding meaning; (xxiii) i (xix) "stamp" includes cast, engrave, etch, print or otherwise mark, in such a manner as to be as far as possible indelible; (xxii) (xx) "statutory body" means any board, council or body of persons established under any Act of Parliament or any ordinance of any provincial council or of the Legislative Assembly of the territory ofsouth West Africa; (xxi) (xxi) "this Act" includes any regulation or proclamation; (vi) (xxii) "trade" includes- (a) the making, effecting or concluding of any contract, bargain, sale, purchase or transaction, or any payment in connection therewith; or (b) any payment for services rendered; or (c) the collection of tolls, rates, taxes or other fees, in connection with which any measuring instrument is used; (v) (xxiii) "unauthorized measuring unit" means a measuring unit other than a measuring unit as defined in this Act; (xiv) (xxiv) "uncertified", in relation to a measuring.instrument, means not certified or not recertified if such measuring instrument should under this Act have been certified or recertified; (xv) : (xxv) "vehicle" does not include railway rolling ~tock. (xxiv)

'n sertifikaat uitgereik kragtens artikel 36 (I), (2) of (3) mag herstel sonder om aan die bepalings van artikel 34 (I) te voldoen; (ii) (x) "meeteenheid" 'n eenheid soos bekend gemaak of voorgeskryf ingevolge artikel 3 van die Wet op Meeteenhede en Nasionale Meetstandaarde, 1973, maar uie ook so 'n eenheid wat, by regulasie kragtens hierdie Wet uitgevaardig, by die toepassing van hierdie Wet uitgesluit word nie; (x) (xi) "meetinstrument" enige toestei, toerusting, instrument, apparaat of ander voorwerp of 'n kombinasie daarvan deur middel waarvan 'n meting van grootheid, uitgedruk in 'n meeteenheid of 'n matematiese funksie van meeteenhede, verrig kan word, en ook enige toestel, toerusting, instrument, apparaat of ander voorwerp of 'n kombinasie daarvan deur middel waarvan 'n gradering of telling in verband met die meting van 'n grootheid bewerkstellig kan word; (ix) (xii) "Minister" die Minister van Ekonomiese Sake; (xi) (xiii) "ondersoeker" 'n ondersoeker wat kragtens artikel 4 aangestel is; (vi) (xiv) "ongemagrigde meeteenheid" 'n ander meeteenheid as 'n meeteenheid soos omskryf in hierdie Wet; (xxiii) (xv) "ongesertifiseerd", met betrekking tot 'n meetinstrument, nie gesertifiseer of hersertifiseer nie indien daardie meetinstrument kragtens hierdie Wet gesertifiseer of hersertifiseer moes gewees het; (xxiv) (xvi) "proklamasie" 'n proklamasie wat kragtens hierdie Wet uitgevaardig is; (xiv) (xvii) "raad" die Metrologieraad wat kragtens artikel 6 ingestel is; (iv) (xviii) "regulasie" 'n regulasie wat kragtens hierdie Wet uitgevaardig is; (xvi) (xix) "Republiek" ook die gebied Suidwes-Afrika; (xvii) (xx) "sertifiseer", met betrekking tot 'n meetinstrument, om, na verifikasie of toets, met 'n sertifiseringstempel, -seel of -merk te stempel, seel of merk of om skriftelik ooreenkomstig die bepalings van hierdie Wet te sertifiseer, en het die woord.jiersertifiseer" 'n OOfeenstemmende betekenis; (i) (xxi) "statutere liggaam" 'n raad of liggaam van persone wat kragtens 'n Wet van die Parlement of 'n ordonnansie van 'n provinsiale raad of van die Wetgewende Vergadering van die gebied Suidwes-Afrika ingestel is; (xx) (xxii) "stempel" ook giet, graveer, ets, druk of andersins merk, op so 'n wyse dat dit sover moontlik onuitwisbaar is; (xix) (xxiii) "verkoop", as werkwoord, ook vir verkoop aanbied, adverteer, hou, uitstal, versend, vervoer, lewer of voorberei of verruil of teen enige vergoeding hoegenaamd van die hand sit of ingevolge 'n verkoping of verruiling of so 'n vandiehandsetting versend, vervoer ofaflewer,en het die woorde "verkoper" en "verkoap", as selfstandige naamwoorde, 'n ooreenstemmende betekenis; (xviii) (xxiv) "voertuig" nie ook rollende spoorwegmateriaal nie; (xxv) (xxv) "voorgeskrewe doel", met betrekking tot die gebruik, besit, vervaardiging of invoer van 'n meetinstrument ofmet betrekking tot die uitdrukking van die hoeveelheid van goedere, 'n doel wat by regulasie voorgeskryf is. Appointment of examiners. Administration of Act. Metrology CounciL ADMINISTRATtON OF ACT 2. (I) Subject to the provisions of the laws governing the public service, the Minister shall appoint a Director of Trade Metrology., (2) Subject to the provisions of the laws governing the public service, the Minister may appoint a Deputy Director of Trade Metrology who may, subject to the control and directions of the director or in the absence of the director or ifthe director is for any other reason unable to perform his duties or ifthe post of director is temporarily vacant, do anything which may lawfully be done by the director. (3) Any person who immediately before the date of commencement of this Act held the post of superintendent ofweights and measures referred to in section 2 of the Weights and Measures Act, 1958 (Act No. 13 of 1958), shall on such date be deemed to have been appointed as director in terms of subsection (I). 3. (I) Subject to the provisions of the laws governing the public service, the Minister may from time to time appoint inspectors to verify or test all measuring instruments or any particular kind of measuring instrument in accordance with the provisions of this Act, and to perform such other functions as may be assigned to inspectors by this Act. (2) No person shall in terms of subsection (I) be appointed as an inspector unless he has shown in undergoing an examination a knowledgeof the appropriate provisions of this Act and- (a) has, in accordance with a curriculum laid down from time to time by the director in consultation with the council, passed an examination in- (i) subjects so laid down; and, (ii) practical work in verifyingand testing all measuring instruments or the kind of measuring instrument (b) in question; or : has satisfied the Minister that he holdsi a certificate qualifying him to act as an inspector,, and no person shall act as an inspector in respel, of any particular kind of measuring instrument unless he h,ol s a certificate issued to him on the instructions of the Minister to the effect that he is qualified to act as an inspector in r spect of all measuring instruments or that kind of measuring instrument. (3) Subject to the provisions of section 22, no inspector shall derive any profit from or be employed in the making, repair, adjusting or selling of any measuring instrument. 4. SUbject to the provisions of the laws governing the public service, the Minister may appoint examiners to, exercise the functions of examiners under this Act. 5. Subject to the control of the Minister, this Act shall be administered by the director and by inspectors and examiners who shall perform their duties under the control ofthe director. 6. (I) The Minister shall appoint a Metrology Council to examine or cause to be examined applicants for the post of inspector, and to assist and advise the director in the performance of his functions under sections 3, 18, 23 and 24 and in connection with such other matters as the Minister may refer to the council from time to time. (2) The council shall consist of- (a) (b) the director who shall be the chairman; not more than five persons appointed on account of their scientific or technical knowledge or commercial or industrial experience; and,

(3) Iemand wat onmiddellik voor die datum van inwerkingtreding van hierdie Wet die pos van superintendent van mate en gewigte soos bedoel in artikel 2 van die Wet op Mate en Gewigte, 1958 (Wet No. 13 van 1958), beklee het, word op bedoe1de datum geag ingevolge subartikel (I) as direkteur aangestel te gewees het. 3. (I) Die Minister kan van tyd tot tyd, met inagneming van Aanstelli~ en die wetsbepalings op die Staatsdiens, inspekteurs aanstel om ~pekttlikasles vau alle meetinstrumente of 'n bepaalde soort meetinstrument oor- IDS eurs. eenkomstig die bepalings van hierdie Wet te verifieer of te toets en om die ander werksaamhede te verrig wat deur hierdie Wet aan inspekteurs opgedra word. (2) Niemand word kragtens subartikel (I) as 'n inspekteur aangestel nie tensy hy by die aflegging van 'n eksamen kennis van die toepaslike bepalings van hierdie Wet getoon het en (a) ooreenkomstig'n leerplan wat die direkteur, in oorieg met die raad, van tyd tot tyd bepaal, geslaag het in 'n eksamen in- (i) vakke aldus bepaal; en (ii) praktiese werk verbonde aan die verifikasie en toets van alle meetinstrumente of die betrokke soort meetinstrument; of (b) die Minister oortuig het dat hy 'n sertifikaat besit waarvolgens hy bevoeg is om as inspektenr op te tree, en niemand tree ten opsigte van 'n bepaalde soort meetinstrument as inspekteur op nie tensy hy 'n sertiflkaat besit wat in opdrag van die Minister aan hom uitgereik is en wat aandui dat hy bevoeg is om as inspekteur op te tree ten opsigte van alle meetinstrumente of daardie soort meetinstrument. (3) Behoudens die bepalings van artikel 22, mag geen inspekteur winste verkry uit of werksaam wees by die vervaardiging, herstel, regstel of verkoop van 'n meetinstrument nie, 4. Die Minister kan, met inagneming van die wetsbepalings Aanstelling van op die Staatsdiens, ondersoekers aanstel om die werksaamhede ondersoekers, van ondersoekers kragtens hierdie Wet te verrig. 5. Onderworpe aan die beheer van die Minister, wordfuit- UitvoeriDg van voering aan hierdie Wet gegee deur die direkteur en deur Wet. inspekteurs en ondersoekers wat hul pligte onder beheer van die direkteur verrig. 6. (I) Die Minister stel 'n Metrologieraad aan om van Metrologieraad. applikante vir die betrekking van inspekteur eksarnens af te neem of te laat afneem, en om die direkteur by die verrigting van sy werksaamhede kragtens artikels 3, 18, 23 en 24 en in verband met die ander aangeleenthede wat die Minister van tyd tot tyd na die raad verwys, by te staan en te adviseer. (2) Die raad bestaan uit- (a) (b) die direkteur wat die voorsitter is; hoogstens vyf persone aangestel op grond van hul wetenskaplike of tegniese kennis of handels- of nywerheidsondervinding; en

(3) The members of the council who are not in the full-time employment of the State, shall receive such remuneration and allowances as the Minister, in consultation with the Minister of Finance, may determine from time to time. Carrying out of functionsmay be assigned to statutory bodies. 7. The Minister may, after consultation with the council, assign in writing to any statutory body the carrying out, subject to such conditions and requirements as may be iprescribed by regulation, of any function specified in this Act.! Departmental standards. Regional standards. CHAPTER II STANDARDS 8. (I) The director shall keep in his custody such measuring standards (in this Act referred to as departmental standards) as may be necessary for the purpose of verifying the regional standards. (2) The value of a departmental standard shall as accurately as possible represent the value signified by its denomination. (3) A departmental standard shall, in regard to accuracy, be verified and certified in accordance with the provisions of subsection (2) by the Council for Scientific and Industrial Research referred to in section 2 of the Scientific Research Council Act, 1962 (Act No. 32 ofl962), and shall be reverified and so certified by the said Council at intervals!not exceeding five years. I (4) The said Council for Scientific and Industrial Research shall render such further assistance in connection with the carrying out of the provisions of this Chapter as the Minister may from time to time request of it. 9. (I) The director shall cause to be kept at every regional office of metrology under his jurisdiction in the custody of the inspector in charge of such office, such measuring standards (in this Act referred to as regional standards) as he may deem necessary for the purposes of this Act. (2) The value ofany regional standard shall, with due allowance for such limits of error as may be prescribed by regnlation, agree with the value signified by the denomination of such regional standard at the time of verification thereof, and the director shall cause such regional standard to be $0 verified and certified before being taken into use and thereafter at intervals not exceeding two years: Provided that regional standards of volume made of glass and regional standards relating to length, shall be reverified and certified at such intervals as the director may deem fit., (3) For the purposes of this Act "regional office of metrology" means any such office established for the purposes of the administration of this Act in any area which the director determines to be a region. Inspection standards. 10. (I) The director shall provide for use by any inspector such measuring standards (in this Act referred to as inspection standards) as may in the opinion of the director be required by such inspector for the purposes of carrying out his duties and functions under this Act. (2) The value ofan inspection standard shall, with due allowance for the limits of error prescribed by regulation, agree with the value signified by the denomination of such inspection standard at the time of verification thereof and shall be verified with regional standards and certifiedaccordingly 1Jy the inspector in whose custody the regional standards with which it is so verified are kept in terms of section 9 (I).

(3) 'n Departementele standaard word, wat noukeurigheid betref, deur die Wetenskaplike en Nywerheidnavorsingsraad vermeld in artikel 2 van die Wet op die Wetenskaplike Navorsingsraad, 1962 (Wet No. 32 van 1962), in ooreenstemming met die bepalings van subartikel (2) geverifieer en gesertifiseer en word by tussenpose van hoogstens vyf jaar deur bedoelde Raad herverifieer en aldus gesertifiseer. (4) Bedoelde Wetenskaplike en Nywerheidnavorsingsraad verleen die verdere bystand in verband met die uitvoering van die bepalings van hierdie Hoofstuk wat die Minister van tyd tot tyd van hom verlang. 9. (I) Die direkteur laat die meetstandaarde (in hierdie Wet Streekstandaarde. streekstandaarde genoem) wat hy vir die doeleindes van hierdie Wet nodig ag, by elke streekkantoor van metrologie wat onder sy regsbevoegdheid val in die bewaring hou van die inspekteur wat in beheer van daardie kantoor is. (2) Die waarde van 'n streekstandaard moet, met inagneming van die onnoukeurigheidsperke wat by regulasie voorgeskryf is, ooreenkom met die waarde aangedui deur die maatwaarde van daardie streekstandaard op die tydstip van verifikasie daarvan, en die direkteur moet bedoelde streekstandaard aldus laat verifieer en sertifiseer voordat dit in gebruik geneem word en daarna by tussenpose van hoogstens twee jaar: Met dien verstande dat volumestreekstandaarde wat van glas vervaardig is en streekstandaarde betreffende lengte by die tussenpose wat die direkteur goedvind, herverifieer en gesertifiseer word. (3) By die toepassing van hierdie Wet beteken "streekkantoor van metrologie" so 'n kantoor wat vir die uitvoering van hierdie Wet in 'n gebied ingestel is wat die direkteur as 'n streek bepaa!. 10. (I) Die direkteur verskaf vir gebruik deur 'n inspekteur Ins~ksi~ die meetstandaarde (in hierdie Wet inspeksiestandaarde ge- stan aar e. noem) wat so 'n inspekteur na die oordeel van die direkteur nodig het ten einde sy pligte en verksaamhede ingevolge hierdie Wet te kan uitvoer. (2) Die waarde van 'n inspeksiestandaard moet, met inagneming van die onnoukeurigheidsperke wat by regulasie voorgeskryf is, ooreeukom met die waarde aangedui deur die maatwaarde van daardie inspeksiestandaard op die tydstip van verifikasie daarvan en word met streekstandaarde geverifieer en dienooreenkomstig gesertifiseer deur die inspekteur in wie se bewaring die streekstandaarde waarmee dit aldus geverifieer word, ingevolge artikel 9 (1) gehou word.

10 No, J~6~ GOVERNMENT GAZETTE; ~TH JULY, 1m Act No, 77, 1973, TRADE METROLOGY ACT, 1911 I (3) Any inspection standard for the testing of masspieces used for any prescribed purpose shall, before being taken into use and thereafter at intervals not exceeding six months, and any other inspection standard shall, before being taken into use and thereafter at intervals not exceeding one year, be verified or reverified with regional standards ~nd certified accordingly by the inspector in whose custody the regional standards with which any such inspection standard 'is so verified or reverified are kept in terms of section 9 (I): Provided that inspection standards of volume made of glass shall be reverified and certified within such intervals as the director may deem fit. Measuringinstruments used by director, inspectors or examiners shad be inspectedand tested. 11. (I) Every measuring instrument, other than any regional or inspection standard, used by the director or any inspector or examiner for the purposes of carrying out his duties and functions under this Act, shall be inspected and ~ested before being taken into use and thereafter at such interva s as may be prescribed by regulation, and a record of every su.h inspection and testing shall be made and kept by the director or the inspector referred to in section 9 (I). (2) Any measuring instrument referred to in subsection (I) shall not be used for the carrying out of any duty or function under this Act unless it complies at any inspection and test referred to in subsection (I) with such requirements as may, in respect of any such measuring instrument, be prescribed by regulation. CHAPTER III INSPECTION, EXAMINATION AND CONFISCATION Inspections and examinations. 12. The director shall arrange inspections and examinations in order to prevent the use of any measuring instrument which falls within the purview of and which does not comply with the applicable requirements of this Act, and in order t<! prevent the sale of goods which, in respect of quantity or the manner in which they are offered for sale, do not comply with t~e applicable requirements of this Act.. Powers of inspection and examination. 13. (I) Any inspector or examiner or any employee of a statutory body furnished in writing with inspection or examination authority by the director, or any policeman, may conduct investigations to ascertain whether the provisions of this Act are being or have been complied with, and may for that purpose open packages containing goods prepacked for sale. (2) Any inspector, examiner or employee refer~ to in subsection (I), or any policeman, may at all reasonab e times (a) enter any place or stop and enter any veh cle---- (i) in respect of which he has reason to' believe that there is on or in it- (aa) any measuring instrument used or intended to be used for any prescribed purpose; or (bb) goods for sale; or (ii) in respect of which he has reason to believe that it is connected with- (aa) any measuring instrument used otintendedto be used for any prescribed purpose: or (bb) the sale of goods;! (b) inspect or examine any measuring instrument, goods, articles or other thing which may in terms of this Act be inspected or examined, or order that for the purposes of inspection or examination such measuring instrument, goods, articles or other thing be placed at his disposal;

'n inspekteur of 'n onder- i:'.~:,.~~~/eur, soeker by die urtvoerrng van sy pligte en werksaamhede inge- ondersoekers volge hierdie Wet gebruik word, moet, voordat dit in gebruik gebruik word, geneem word en daarna binne die tussenpose wat by regulasie moet geinspekteer voorgeskryf word, gemspekteer en getoets word, en elke so- en getoets word. danige inspeksie of toets word deur die direkteur of die inspekteur bedoel in artikel 9 (I) aangeteken en gehou. (2) 'n Meetinstrument bedoel in subartikel (I) word nie by die nitvoering van 'n plig of werksaamheid ingevolge hierdie Wet gebruik nie tensy dit by 'n inspeksie en toets bedoel in subartikel (I) voldoen aan die vereistes wat by regulasie ten opsigte van so 'n meetinstrument voorgeskryf word. HOOFSTUK III INSPEKSIE, ONDERSOEK EN KONFISKERING 12. (I) 'n Inspekteur of ondersoeker of 'n werknemer van 'n Inspeksie- en statutere liggaam aan wie die direkteur skriftelik inspeksie- of ~~ersoekbevoelld. ondersoekbevoegdhede verleen het of 'n polisiebeampte kan e. ondersoek instel om vas te stel of die bepalings van hierdie Wet nagekom word of is, en kan vir daardie doel pakkette oopmaak wat goedere bevat wat vir verkoop voorafverpak is. (2) 'n Inspekteur, ondersoeker of werknemer bedoel in subartikel (1), of 'n polisiebeampte, kan te aile redelike tye- (a) 'n plek betree of 'n voertuig tot stilstand bring en binnegaan- (i) ten opsigte waarvan hy rede het om te glo dat daarop of daarin- (aa) 'n meetinstrument is wat vir 'n voorgeskrewe doe! gebruik word of bestem is om daarvoor gebruik te word; of (bb) goedere vir verkoop is; of (ii). ten opsigte waarvan hy rede het om te glo dat dit in verband staan met- (aa) 'n meetinstrument wat vir 'n voorgeskrewe doe! gebruik word of bestem is om daarvoor gebruik te word; of (bb) die verkoop van goedere; (b) enige meetinstrument, goedere, artikels of ander voorwerp wat ingevolge hierdie Wet geinspekteer of ondersoek kan word, inspekteer of ondersoek of gelas dat bedoelde meetinstrument, goedere, artikels of ander voorwerp vir die doeleindes van inspeksie of ondersoek tot sy beskikking gestelword;

(c) inspect, verify or test or cause to be verified or tested any measuring instrument used for an(y prescribed purpose or which is subject to any provision of this Act and which is in the possession of any person or is found on any premises; i (d) seize and retain any measuring instrument, goods, articles or other thing which may be confiscated or seized in terms of this Act; (e) order any person carrying goods for sale, to stop; and (f) examine and measure or count the quantity of any goods for sale by means of any measuring instrument referred to in section II or by means of any certified measuring instrument found at the place where such goods are found or on any vehicle on which such goods are carried for sale. (3) Any person in charge ofmeasuring instruments or goods which are being inspected or examined by any inspector, examiner or employee referred to in subsection (I), or any policeman, or any agent or employee of such person, shall at the request ofany such inspector, examiner, employee or policeman render such assistance as may be necessary for the purpose ofverifying or testing such measuring instruments or ofmeasuring or counting the quantity of such goods. (4) Any person using any measuring instrument in trade shall, on demand of any person desiring to ascertain whether such instrument is certified, produce such instrument and any document relating to the certification thereof to such person for his examination. (5) Any person who- (a) fails on demand to produce to, or put at the disposal of, any inspector, examiner or employee referred to in subsection (I), or any policeman, anything in his possession or on his premises which may relate to any inspection or examination; or (b) fails on demand to produce for inspection or examination under subsection (I) or (4) any me:'juring instrument, or any document relating to the, certification thereof, in his possession or on his premises; or (c) fails to comply with any order given under subsection (2) (e) or any request made under subsection (3); or (d) fails on demand to produce to any inspec}or, examiner or employee referred to in subsection ( ), or to any policeman, any invoice, delivery note 0 other document relating to any measuring instrument or goods which may be inspected or examined by such inspector, examiner, employee or policeman; or, (e) hinders or obstructs any inspector, examiner or employee referred to in subsection (I), or any policeman, in the exercise of his powers under this section; or (f) falsely holds himself out to be an inspector, examiner or employee referred to in subsection (I), shall be guilty of an offence. 14. (I) Any inspector or examiner referred to in section 13(I), or any policeman, who examined any goods or who inspected or examined or caused to be verified or tested any measuring instrument and who found that such goods or measuring instrument did not comply with the requirements of this Act, may order the person in whose possession or on whose premises such goods or measuring instrument were found, or the agent or employee of such person, to withdraw the whole, or any part, of such goods forthwith from sale or to withdraw any such measuring instrument forthwith from further use or to take such other steps as may be deemed necessary by such inspector, examiner or policeman for the protection of prospective purchasers or of any other persons concerned.

(e) (d) (e) 'n meetinstrument wat vir'n voorgeskrewe doel gebruik word ofwaarop'n bepalingvan hierdie Wet betrekking het en wat in die besit van iemand is of gevind is op 'n perseel, inspekteer, verifieer of toets of laat verifieer of toets; enige meetinstrument, goedere, artikels of ander voorwerp wat ingevolge hierdie Wet gekonfiskeer kan word, in beslag neem en hou; iemand wat goedere vir verkoop vervoer, gelas om tot stilstand te kom; (f) die hoeveelheid van goedere vir verkoop ondersoek en meet of tel deur middel van 'n meetinstrument bedoel in artikel II of deur middel van 'n gesertifiseerde meetinstrument wat gevind is op die plek waar daardie goedere aangetref is of op 'n voertuig waarmee daardie goedere vir verkoop vervoer word. (3) Iemand in beheer van meetinstrumente of goedere wat deur 'n inspekteur, ondersoeker of werknemer bedoel in subartikel (I), of'n polisiebeampte, geinspekteer ofondersoek word, of :n agent of werknemer van so iemand, moet op versoek van daardie inspekteur, ondersoeker, werknemer of polisiebeampte die hulp verleen wat nodig is om bedoelde meetinstrumente te verifieer of te toets of om die hoeveelheid van bedoelde goedere te meet of te tel. (4) Iemand wat 'n meetinstrument in die handel gebruik, moet, op aanvraag van '0 persoon wat begerig is om vas te stel of bedoelde meetinstrument gesertifiseer is, daardie meetinstrument en 'n dokument wat op die sertifisering daarvan betrekking het aan daardie persoon vir ondersoek deur hom toon. (5) Iemand wat- (a) versuim om op aanvraag enigiets in sy besit of op sy perseel wat betrekking kan he op 'n inspeksie of ondersoek, aan 'n inspekteur, ondersoeker of werknemer bedoel in subartikel (I) of aan 'n polisiebeampte te toon of tot sy beskikking te stel; of (b) versuim om op aanvraag 'n meetinstrument of 'n dokument wat op die sertifisering daarvan betrekking het wat in sy besit of op sy perseel is, vir inspeksie of ondersoek kragtens subartikel (I) of (4) te toon; of (c) (d) (e) versuim om te voldoen aan 'n bevel kragtens subartikel (2) (e) gegee of 'n versoek kragtens subartikel (3) gerig; of versuim om op aanvraag 'n faktuur, afleweringsbrie of 'n ander dokument in verband met 'n meetinstrument ofgoedere wat deur'n inspekteur, ondersoeker of werknemer bedoel in subartikei (I) of deur 'n polisiebeampte geinspekteer of ondersoek kan word, aan so '0 inspekteur, ondersoeker, werknemer of polisiebeam pte te toon; of 'n inspekteur, ondersoeker of werknemer bedoel in subartikel (I) of 'n polisiebeampte by die uitoefening van sy bevoegdhede kragtens hierdie artikel hinder of dwarsboom; of if) valslik voorgee dat hy 'n inspekteur, ondersoeker of werknemer bedoei in subartikel (I) is, is aan 'n misdryf skuldig. 14. Presumptions regarding use and possession of certain measuring instruments and determination of quantities of goods. Contents of certafd affidavits deemed to be primafacie proof. (2) Any person who fails to comply with anyi order given under subsection (I) shall be guilty of an offence. 15. (I) The court convicting any person of an offence under this Act, may confiscate any measuring instrument, goods, articles or other thing in respect of which such offence has been committed. (2) Any measuring instrument, goods, article or other thing confiscated under subsection (I) shall be disposed of in such manner as the Minister may direct. 16. (I) If in any prosecution for an offence under this Act, itis necessary, in orderto establish the charge againstthe accused, to prove--! (a) that the accused did at any time or place use for any prescribed purpose or have in his possession for such purpose any measuring instrument, andl it is proved that at such place and time he performed any activity regarding such purpose and that such measuring instrument was then in his possession, it shall be presumed that the accused at that time used for such purpose or had in his possession for such purpose, such measuring instrument, until the contrary is proved; or (b) that the accused did at any time or place sell or have in his possession for sale any goods or articles, and it is proved that at that time and place he carried on trade and that such goods or other articles wete then in his possession, it shall be presumed that at that time and place he sold or had in his possession for sale such goods or articles, until the contrary is proved; or (c) that a notice under section 19 (I) or that the provisions of section 19 (2) should, in respect of a,y measuring instrument, have been complied with, it lshall be presumed that at all relevant times the accused possessed such measuring instrument for a prescribed purpose in the area to which the notice in question or the provisions of section 19 (2) applies, until the contrary is proved. (2) If in any prosecution for an offence under this Act it is proved that any inspector, examiner or employee referred to in section 13 (I), or any policeman, in the exercise of his duties under section 13 (2) (1) used any measuring instrument referred to in section II or any certified measuring instrument in order to determine the quantity of any goods, it shall be presumed that the quantity so determined is the actual quantity Ofsuch goods, until the contrary is proved. 17. If in any prosecution for an offence undej this Act the question arises whether any measuring instrument not certified under this Act is not a measuring instrument exempted from certification or recertification in terms of section 1$ (2) (a) or 23 or from periodical recertification by reason of such measuring instrument's being a contract measuring instrument referred to in section 19 (1) (a) or by reason of such measuring instrument's being a measuring instrument in respect of which the provisions of section 19 (2) (a) or (b) had been complied with, a document purporting to be an affidavit made by a person who in that affidavit alleges-- (a) that he is the inspector in charge of the regional office of metrology for the area in which the measuring instrument in question was found; (b) that if the measuring instrument in question were a measuring instrument exempted from certification or recertification in terms of section 18 (2~ (a) or 23 or from periodical recertification by re son of such measuring instrument's being a contr ct measuring instrument referred to in section 19 (I) (a) or by reason of such measuring instrument's being! a measuring instrument in respect ofwhich the provisionsofsection r,

16 No. J969 GOVERNMENT GAZETIE, 6TH JULY, 197J Ad No. 77, 191~, TRADE METROLOGY ACf, 1971 19 (2) (a) or (b) had been complied with] it would in the ordinary course of events have come to his. the deponent's. knowledge and a record thereof, available to him, would have been kept; and (e) that there is no such record thereof, shall, upon its mere production at such prosecution, be prima facie proof that the measuring instrument in question is not a measuring instrument exempted from certification or recertification in terms of section 18 (2) (a) or 23 or from periodical recertification by reason of such measuring instrument's being a contract measuring instrument referred to in section 19 (I) (a) or by reason of such measuring instrument's being a measuring instrument in respect ofwhich the provisions ofsection 19 (2) (a) or (b) had been complied with. CHAPTER IV MPROVAL, VERIFICATION AND CERTIFICATION OF MEASURING INSTRUMENTS Approval of measuring instruments. 18. (I) (a) If any person desires to sell or make available any new model of a measuring instrument ofa class or kind which or of which the material, design or construction is in terms of any regulation required to be approved by the director, he may, with a view to the issue to him of a certificate in terms of subsection (2), submit a specimen of that model to the director who shall examine it with reference to the material from which, the principle according to which and the manner in which it has been made and such other circumstances as he may deem fit, and the director may, before issuing any such certificate, require such alterations to be made to such model as he may deem fit. (b) Ifa certificate has been issued in terms of subsection (2) in respect of a particular model of a measuring instrument, and any person desires to sell or make available for any prescribed purpose in respect ofwhich it is prescribed by regulation that an approved measuring instrument shall be used, a modified mpdel of that measuring instrument, he may submit a specimen ofthe modified model or of the modified part tlhereof to the director with a view to endorsing or making an addition to that certificate to the effect that it also relates to the modified model. (e) Ifwith a view to the issue ofa certificate inlterms of subsection (2) any specimen of any new model of a measuring instrument exempted by regulation or in terms of section 23 (2) from the provisions of section 23 (I), is submitted to the director, he may in his discretion agree or refuse to deal therewith in terms ofthis section. (2) (a) If the director finds a specimen of a model submitted to him in terms of subsection (I) (a) to be suitable for use for any prescribed purpose, he shall approve such model for such use and issue a certificate to that effect: Provided that the director may, subject to the provisions of any regulation made in terms of section 42 (I) (k), by means of any such certificate limit the prescribed purposes for which any measuring instrument made according to any such specimen may be used, or impose conditions upon the use of any such measuring instrument, or impose in respect of any such measuring instrument any limitation or condition regarding approval or subsequent certification or recertification or exemption from certification or recertification in terms of this Act. (b) In any case contemplated by subsection (I) (b), the director may in his discretion make or refuse to make
