MAY BE HELD, ANNUAL REPORTING, PAYMENTS TO INDIYIDUALS; AND BINGO EQUIPMENT. l BE IT ENACTED JJY THE PEOPLE OF GUAM: 2 Section 1. 64.?0(c)(l)(A) of Article 2, Chapter 64, Title 9, Guam Code 3 Annotated, is amended to read: 4 "(A) The application form shall include: 1
1 (i) the name and address of the applicant; 2 (ii) the evidences on which the applicant relies in order to 3 qualify under Subsection (b ); 4 (iii) the names of three (3) officers or members of the 5 organization who shall be responsible fo! the operation of the gambling 6 activities; 7 (iv) the address of the premises on which the operation of the 8 gambling activities will be held; and 9 ( v) the uses to which the net proceeds will be applied." 10 Section 2. A new 64.70(g) is added to Article 2 of Chapter 64, Title 9, 11 Guam Annotated, to read: 12 "(g) Notwithstanding any other law, rule or regulation, a non-profit 13. tax exempt organization issued a permit pursuant to SubsectiOn (c) may 14 conduct bingo operations on any premises where it is authorized to do so by 15 the Department of Revenue and Taxation, regardless of whether the premises 16 is owned. or leased by it or another non-profit tax exempt organization.. 17 However, the use of such premises sht;zll not be conditioned on the payment ts of a share of bingo proceeds." 19 Section 3. A new 64.70(h) is added to 'Article.2 of Chapter 64, Title 9, 20 Guam Annotated, to read: 21 "(h) Notwithstanding any other law, rule or regulation, a bingo 22 licensee, as that term is used in Title 3 GAR Chapter 7, is required to own all 23- equipment used to conduct the bingo games or lease such equipment from an 24 organization licensed with the Department of Revenue and Tax~tion (DRT). 25 However, the use of such premises shall not be conditioned on the payment 26 of a shar~ of bingo proceeds." 2
1 Section 4. A new 64.70(i) is added to Article 2 of Chapter 64, Title 9, 2 Guam Annotated, to read: 3 "(i) Notwithstanding any other law, rule or regulation, a bingo 4 licensee, as that term is used in Title 3 GAR Chapter 7, shall file an annual 5 ite~zed report with the Gaming Control Commission each year disclosing 6 the gross receipts and all expenses and expenditures associated with the 7 operation of the bingo games. Such report shall be filed on or before April 8 15th of every year. The report must be prepared on the form prescribed and 9 provided by the Gaming Control Commission.". 10 Section 5. A new 64.700) is added to Article 2 of Chapter 64, Title 9, 11 Guam Annotated, to read: 12 "G) Notwithstanding any other law, rule or regulation, no person or 13 organization may receive any money or other consideration for salary,. 14 expense money, or any other fees for the operation of or assistance with regard 15 to any bingo game, except that a member or auxiliary member of the licensed 16. non-profit tax exempt organization who assists in the conducting of such 17 games on such day shall be compensated based on the prevailing wages 18 according to the member's position." 19 Section 6. The Department of Revenue and Taxation shall, within thirty 20. (30) days of enactment of this Act, promulgate rules and regulations or amend 21 existing rules and r~gulations to enforce the provisions of this Act.. 3
