Town Council Meeting 9/16/14 Item #1 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY MEETING SEPTEMBER 2, 2014 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Tuesday, September 2, 2014, at 7:00 P.M. MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Steven Leonardis, Vice Mayor Marcia Jensen, Council Member Joe Pirzynski, Council Member Diane McNutt, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Tristan Knowlton led the Pledge of Allegiance. The audience was invited to participate. CLOSED SESSION REPORT There was no closed session. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Joe Pirzynski stated he attended the Congestion Management Program and Planning Committee meeting for Valley Transportation Authority (VTA) and the VTA Board of Directors Meeting. - Mayor Steve Leonardis stated he attended the West Valley Sanitation District (WVSD) Board of Directors meeting. - Council discussed scheduling the consideration of a potential Town Code modification regarding the election of the Mayor and Vice Mayor. Manager Matters - Announced recruitment for Boards and Commissions begins September 5, and that interviews and appointments will be held on December 16, 2014. - Announced the Hillbrook Conditional Use Permit (CUP) modification and Environmental Impact Report (EIR) hearing that was scheduled for September 10 has been postponed for public noticing purposes to the regularly scheduled Planning Commission meeting on September 24. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council Minutes of August 19, 2014 2. Accept Fiscal Year 2013/14 Quarterly Investment Report (April through June 2014) 3. Request for use of the Civic Center lawn for the 12th annual Magical Glass Pumpkin Patch 4. Adopt a Resolution setting the date for consideration of reorganization of an uninhabited area designated as Hilow Road No. 5, approximately 0.26 acres located at 16442 Hilow Road. APN 532-04-076 File #AN14-003 RESOLUTION 2014-060 5. Accept the report on the permanent installation of traffic calming devices for the Chestnut Avenue neighborhood 6. Authorize the Town Manager to execute a renewal of a Joint Use Agreement with Santa Clara Valley Water District for use of District property along Los Gatos Creek Trail 7. Authorize the Town Manager to execute a first amendment to an agreement with the West Valley Sanitation District for storm drain maintenance services a. Extending the agreement for a period of two years and b. Increasing the total compensation by $6,400 per year to a total contract amount not to exceed $38,000 per year c. Authorize budget adjustment in the amount of $38,000 from available nonpoint source fund balance 8. PPW Job No. 13-23 - FY 2013/14 Curb, Gutter And Sidewalk Replacement Project 411-813-9921 a. Approve payment in the amount of $4,273 in excess of the agreement and contingency amount for additional project expenses b. Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion accepting the work of Bearden Construction Co., Inc. DBA: CB Concrete Construction, Inc. and authorize recording by the Clerk Administrator 9. PPW Job No. 13-28 Retaining Wall Repairs Project 815-9930 a. Authorize the Town Manager to execute a first amendment to the construction contract with Casey Construction, Inc. in an amount not to exceed $184,316 to allow for the installation of additional retaining wall b. Authorize staff to execute future change orders on the first amendment to the construction contract, as necessary, in an amount not to exceed $20,000 Greg Larson, Town Manager, advised Item #3 has been withdrawn by the applicant. MOTION: VOTE: Motion by Vice Mayor Marcia Jensen to approve items #1-2 and #4-9. Seconded by Council Member Joe Pirzynski. Motion passed unanimously. 2

Adopt a resolution authorizing submittal of the Draft Housing Element to the California Housing and Community Development Department for its 60-day review RESOLUTION 2014-061 Laurel Prevetti, Assistant Town Manager/Community Development Director, presented the staff report. Opened and Closed Public Comment at 7:22 p.m. MOTION: VOTE: Motion by Council Member Joe Pirzynski to adopt a resolution authorizing submittal of the draft Housing Element to the California Housing and Community Development Department for its 60-day review. Seconded by Council Member Barbara Spector. Motion passed unanimously. PUBLIC HEARINGS 11. North Forty Specific Plan, General Plan Amendment GP-14-001, Zoning Code Amendment Z-14-001, and Environmental Impact Report EIR-10-002. Project Location: the plan area comprises approximately 44 acres located at the northern extent of the Town of Los Gatos, bordered by State Route 17 and State Route 85 freeways to the West and North, Los Gatos Boulevard to the east, and Lark Avenue to the South. APN 424-07-009, 010, 024 through 027, 031 through 037, 052 through 054, 060, 063 through 065, 070, 081 through 086, 090, 094 through 096, 099, 100, 424-06-115, 116, and 129. Property Owners: Thomas & Miyoko Yuki, Herbert & Barbara Yuki, ETPH LP, William Mattes, Peter Brutsche, William Fales. Opened the Public Hearing at 7:37 p.m. Tony Alarcon - Commented on the traffic and school impacts. Scott Broomfield, President, Board of Trustees, Los Gatos Union School District - Commented on the impacts to the schools and traffic. Dr. Diana Abbatti, Superintendent, Los Gatos Union School District - Commented on the impacts to the schools based on revised student generation rates. - Members of the Town Council asked questions of Dr. Abbatti. Susan Burnett - Commented on the traffic impacts, specifically to emergency services. Kristine Kasten - Commented in favor of the project and affordable senior housing. Jeff Loughridge - Commented in favor of the project, and expressed concerns with traffic impacts, school impacts, building heights, and the quality of the Specific Plan document. Susan Kankel - Requested the Plan be returned to the Planning Commission with the necessary funding to do any traffic analyses required. Richard Erbst - Commented on the traffic and school impacts. Edward Morimoto - Commented in favor of the Plan. Jak Van Nada - Commented on the traffic impacts and requested the Plan and new traffic studies be remanded to the Planning Commission. Maria Ristow - Commented in favor of the project with changes to traffic, density, schools, and building heights. 4

Public Hearing Item #11 continued Anne Fisher, Silicon Valley Bicycle Coalition - Commented on the bike friendly elements of the plan. Larry Arzie - Commented against the Plan and its impact on Downtown. He requested it be returned to the Planning Commission for additional public input. - A member of the Town Council asked questions of Mr. Arzie. Kendra Burch - Commented on the traffic impacts to the Highland Oaks neighborhoods, requested Council consider installing a traffic barrier, and commented that building heights along Lark Avenue should be low. Joanne Rodgers - Commented on the traffic impacts. Tom Thimot, President of Los Gatos Education Foundation - Commented on the school and traffic impacts. John Shepardson - Commented on the General Plan height limits. Cecil Anison - Commented on the traffic impacts, encouraged more bicycle friendly elements, and requested the traffic study return to Planning Commission. Barbara Dodson - Commented on the traffic impacts, requested a new traffic study for a reduced density option, and suggested land dedication for a school. Carl Guardino - Commented in favor of the Plan and the availability of State transportation funds. Laura Murphy-Wilkens - Commented on the school and traffic impacts. Tim Johnston - Commented in favor of the Plan. Linda Mandolini, President, Eden Housing - Commented in favor of the Plan. 5

Public Hearing Item #11 continued Kelly Duvall - Commented on the school impacts. Zoe Mullendore, Silicon Valley Leadership Group - Commented in favor of the Plan. Lee Quintana - Commented in favor of the Plan, and expressed concern about last minute issues that might derail the Plan. Recess was called at 9:28 p.m. Meeting reconvened at 9:37 p.m. Teresa Siguenza - Commented on the traffic impacts to the Highland Oaks neighborhood and requested Council consider installing a traffic barrier. Stephen Pratt - Commented on the traffic impacts to the Highland Oaks neighborhood with particular concern for children s safety. Ardie Zahedani, Saint Anton Communities - Commented in favor of the Plan, particularly the flexibility for residential development in the Northern District. Maria Gerst - Commented on the school impacts. Matthew Hudes - Commented on the process of the approval of the Specific Plan and EIR. He also expressed concern about the economic analysis and suggested retail limits. - Members of the Town Council asked questions of Mr. Hudes. Anne Robinson - Commented on the maximum height limits, balance of the development, connectivity of the North 40, and traffic impacts. Jennifer Grewell - Commented on the size of commercial space for small businesses, traffic and school impacts, and requested the Plan be sent back to the Planning Commission for further review. 6

Public Hearing Item #11 continued Sandy Decker - Commented against the Plan due to its impacts on Downtown, loss of trees along Highway 17, lack of input from other North 40 property owners, and the rush to approval. Jim Russell - Commented on the school impacts. Carol Tinsley - Commented on the school impacts. Gina Robinos - Commented in favor of the Plan and the opportunity to improve her property in the North 40. James Paulson - Commented on the school and traffic impacts, especially for the Highland Oaks neighborhood. Jan Olsen - Commented on the traffic impacts, height restrictions, and the phasing of development in the districts. Don Capobres, Grosvenor Americas - Commented on the history of the Specific Plan and past School District bond funding. Wendi Baker, SummerHill Homes - Commented on the their outreach to the community, the deliberate planning for housing that does not generate school children, opportunities to improve bicycle and pedestrian connectivity, and height limits. - Members of the Town Council asked questions of Mr. Capobres and Ms. Baker regarding traffic, schools, economic analysis, retail limitations, senior housing, phasing, trees along Highway 17, and other issues. Closed the Public Hearing at 11:40 p.m. MOTION: VOTE: Motion by Council Member Barbara Spector to continue the matter to the September 16, 2014, Town Council meeting. Seconded by Council Member Joe Pirzynski. Motion passed unanimously. 7
