Tender for Supply of Desktop, Barcode Scanner & Thermal Printer in ANIIDCO, Port Blair 1. Introduction: Andaman and Nicobar Islands Integrated Development Corporation Ltd. (ANIIDCO) having an annual turnover of around ` 250 crore is a Govt. company and engaged in trading, tourism, industrial financing, etc. The Corporation invites tender for supply of Desktop, Barcode Scanner & Thermal Printer for IMFL Shops, ANIIDCO, Port Blair. 2. Tender document: The tender document containing the terms and conditions can be obtained from Dy. Manager (IT) on any working day from the office of the Corporation upto 21/01/2016 at free of cost. Alternatively, the terms and conditions can be downloaded from website www.and.nic.in. Tenderers downloading the tender document from the website are requested to notify the Corporation so that any amendment in the tender document can be informed to all the prospective Tenderers. 1. Cost of Tender: The Tenderer shall bear all costs associated with the preparation and submission of its Bid and the Corporation will in no case be responsible or liable for those costs, regardless of the conduct of outcome of the Tendering process. 4. Submission of bid: 4.1 Sealed bid superscribed "Tender for Supply of Desktop, Barcode Scanner & Thermal Printer in ANIIDCO, Port Blair along with Earnest Money Deposit (EMD) as specified at clause 8 is to be submitted in the office of the General Manager, M/s. ANIIDCO Ltd., Vikas Bhawan, Port Blair before 3.00 P.M. on 22/01/2016. 4.2 The Technical bids will be opened on the same day at 3.30 P.M. 4.3 The offer should be sent, so as to reach the Corporation not later than Page 1 of 16

the date and the time specified above. Un-sealed tenders and the tenders which are not properly addressed or identified will be summarily rejected. 4.4 The Corporation will not be responsible for any delay or missing of bid while in transit/post. 4.5 Bid received after due date and time including postal delays, unsigned bids, bids not given in two separate sealed cover i.e. separate cover consisting of technical bid and separate cover consisting of financial bid will be summarily rejected. 4.5 All bids should be in English language only. 4.6. The tender is based on two bids system i.e. Technical bid and Financial bid. 4.6.1. The technical bid must contain the following: 1) EMD as specified in clause 8. 2) Documentary proof of meeting eligibility criteria as specified in clause 7. 3) PAN Card copy. 4) Technical details of Desktop, Barcode Scanner & Thermal Printer as per Annexure I. 4.6.2. If required documents as prescribed above are not submitted along with Technical Bid then the offer will be summarily rejected. 4.6.3. The Corporation retains the right to seek additional information/clarification during the tendering process from any or all the bidders. 4.6.4. Financial Bid of only those bidders who qualify in the Technical bid to be evaluated by a Committee constituted by the Corporation, will only be opened. The Financial bid of those bidders who do not qualify the technical bid will be treated as Non-Responsive and shall not be opened. Successful bidder shall be decided based on lowest financial offer taking into account the estimated purchase quantity and net rate quoted in the financial bid. The estimated quantity at Annexure II is only for the purpose of tender evaluation and quantity of purchase shall depend on actual requirement. 5. Financial Bid 5.1 The Financial bid should be submitted in separate sealed cover duly superscripted with the words Financial Bid for Desktop, Barcode Scanner & Thermal Printer as per the format Annexure-II. 5.2. The rates quoted by the bidders should be inclusive of all applicable taxes and duties, insurance, packing and forwarding, freight up to site, octroi, installation and commissioning charges etc. 5.3. Rate quoted by the Tenderer shall be fixed during the Tenderer's performance of the Contract and will not subject to variation on any account. A bid submitted with an adjustable price Financial bid for such equipment and services will be treated as non-responsive and rejected. 5.4. Notwithstanding anything stated elsewhere in the Tender documents, irrespective of mode of the contracting with the successful Tenderer, the successful Tenderer will be liable for the payment of Indian Income Tax, surcharge on Income Tax, Service Tax, Works Contract Tax, and any other Corporate Tax, turnover tax etc. if attracted under the provisions of the law. The Corporation shall not bear any tax liability whatsoever irrespective of the mode of contracting. 5.5 For all equipment and services covered in this Tender Document, Financials shall be quoted in Indian Rupees only. 6. Sealing of the cover: 6.1 The Financial bid and Technical bids should be sealed in a separate cover duly superscripted with the words Financial Bid for Desktop, Barcode Scanner & Thermal Printer and Technical bid for Desktop, Barcode Scanner and thermal Printer respectively. 6.2. The Sealed Cover containing Technical bid and the sealed cover containing Financial bid should be placed in a common cover duly superscripted with the words Tender for Supply of Desktop, Barcode Scanner & Thermal Printer in ANIIDCO, Port Blair and sealed by the firms. 7. Tenderers Eligibility Criteria: Interested bidders should fulfill all of the following criteria to be considered eligible to participate in the tender: Page 3 of 16

The items should be equivalent or better model as per the minimum indicative technical specification given in the tender document and it should be covered with warrantee period as per minimum indicative technical specification given in the tender document. The bidder / authorized dealer / Partner/ agent must have after sales service facility in Port Blair for Desktop. Certificate of incorporation/ Letter of authorization / dealership/ agent/ partner certificate. Submission of duly filled ANNEXURE I. Documentary proof regarding after sales service facility in Port Blair. The documentary proof of meeting the eligibility criteria must be submitted. 8. Earnest Money Deposit (EMD): 8.1 Tender should be accompanied by an EMD of ` 10,000/- EMD should be given by way of Bank Guarantee/FDR of a Nationalized Bank or Scheduled Bank drawn in favour of the ANIIDCO Ltd., Port Blair. Tenders submitted without EMD will not be considered. 8.2 The EMD of unsuccessful tenderers will be released after the awarding of tender. The EMD of successful Tenderers will be released on furnishing of Performance Security as per clause 13. 8.3 The EMD will be forfeited to the Corporation Accounts, if the Tenderer withdraws his tender. EMD will also be forfeited if successful Tenderer fails to deposit Performance Guarantee within 15 days. 9. Scope of Work: a. The work consists of the following for Desktop, Barcode Scanner & Thermal Printer : i. Supply of Desktop, Barcode Scanner & Thermal Printer, its installation, testing and commissioning at IMFL Shops, Mohanpura, Delanipur, Junglighat, Pathargudda and Haddo, Port Blair. Page 4 of 16

ii. Installation of Operating System, HDD partition, IP configuration, antivirus, testing and commissioning. iii. Handover OS CD, antivirus CD licensed version in removable media, manual, license key, warranty card etc. iv. During warranty period the items should be repaired free of cost within 02 days from date of raising complaint. The complaint can be registered either over phone, email, SMS, writing etc. v. The offer equipments must be compatible with 32 and 64 bit applications. vi. Desktops, Barcode Scanner and Thermal Printer shall be free from all workmanship defects, sharp edges, nicks scratches, burrs, etc. All fasteners shall be fixed properly. The equipment shall be complete with all parts and all parts should be functional. The minimum indicative technical specification / features of the Desktops, Barcode Scanner and Thermal Printer is provided at Annexure I. It is not the intent of the corporation that equipment fulfilling only these technical will be bought. The bidders are free to give higher specifications for the same. However, the bidders should specify all details/ technical specifications etc. in Annexure I and it will be the responsibility of the Tenderer. The successful Tenderer is responsible to undertake all work involved in design, supply, installation, testing, commissioning and maintenance equipment as per the technical specification given by the bidders. The successful Tenderer shall be responsible for all activities relating to installation and commissioning of the equipment at the site and making the equipment fully operational. The successful Tenderer will also be required to make arrangement of the tools required for the work, conducting training for technical and non-technical staff of the Corporation. The equipment supplied should be strictly in accordance with the minimum specifications/features approved by the Corporation. If any equipment in the opinion of the inspecting authority is not as per the approved specification, the same will be rejected without any liability to the Corporation and performance security so furnished shall be forfeited. The contract form to be executed by the successful tenderer is enclosed at Annexure - III. i. Quantity and schedule of delivery : The Desktops, Barcode Scanner and Thermal Printer has to be supplied at IMFL shops, ANIIDCO, Port Blair. The estimated quantity to be supplied with timeframe is as under: Page 5 of 16

Validity of Bid The bid should be valid for a period of 03 months from the date of submission of bid. In exceptional circumstance, the Corporation may solicit tenderers consent for extension of validity period. 11. Assignment of Contract: Successful tenderer cannot assign or sub-contract the work awarded to them without permission of ANIIDCO. 12. Payment Terms: (i) 100% payment shall be released on successful supply, installation, and commissioning of Desktop, Barcode Scanner and Thermal Printer and on submission of performance security equivalent to 10% of the contract value in the form of FD, call deposit, bank guarantee. (ii) For release of payment for supply, the successful bidder shall be required to submit satisfactory report of installation, commissioning of Desktop, Barcode Scanner and Thermal Printer from unit incharge. 13. Performance Security: Within 15 days after the award of the Contract, the successful Tenderer shall furnish performance security to the Corporation amounting to 10 % of the contract value. The proceeds of the performance security shall be recoverable to the Corporation as compensation for any loss resulting from the Tenderer s failure to complete its obligations under the Contract. The Performance Security shall be in the following form: (i) A bank guarantee, issued by a Nationalized Indian Bank/other scheduled banks. Such bank guarantees shall be valid till the expiry of the Page 6 of 16

warranty period. The format for bank guarantee is enclosed at Annexure - IV (ii) Fixed Deposit or Call Deposit from scheduled banks pledged to the Corporation. The amount received under such instructions shall not bear any interest. (iii) The performance security will be discharged by the Corporation and returned to the Successful Tenderer not later than 60 days following the date of completion of the Tenderer s performance obligations, including warranty obligations, under the Contract. 14. Liquidity Damages: (a) Supply and installation of equipment. Subject to Clause 18, if the successful Tenderer fails to deliver any or all the equipment or perform the services within the time period(s) specified in the Contract, the Corporation shall, without prejudice to its other remedies under the contract, deduct from the contract Financials, as liquidated damages, a sum equivalent to: 2% of the value of the incomplete supply for every one week of delay (week comprising of 7 days including holidays). The total amount so deducted shall not exceed 10% of the Contract value. Once the maximum is reached, the Corporation may consider termination of the contract pursuant to clause 15. 15. Termination for Default: The Corporation may without prejudice to any other remedy for breach of contract by written notice of default sent to the Tenderer terminate the contract in whole or in part. If the Tenderer fails to deliver any or all the equipment within the time period(s) specified in the Contract or any extension thereof granted by the Corporation pursuant to clause 16 or if the Tenderer fails to perform any other obligations under the contract. In the event the Corporation terminates the contract in whole or in part pursuant to clause 16. The Corporation may procure upon such terms and in such manner as it deems appropriate equipment similar to those undelivered and the Tenderer shall be liable to the Corporation for any excess costs for such similar equipment. However, the Tenderer shall continue performance of the contract to the extent not terminated. 16. Delays in the Tenderer s performance: Delivery of equipment and performance of service shall be made by the Tenderer in accordance with the time schedule given in the Tender. Page 7 of 16

An unexcused delay by the Tenderer in the performance of its contract obligations shall render the Tenderer liable to any or all of the following sanctions and the Corporation shall not be responsible for any financial loss to the tenderer on such action: (i) Forfeiture of its bid/performance security (ii) Imposition of liquidated damages; and/or (iii) Termination of the Contract for default If at any time during performance of the contract, the Tenderer should encounter conditions impeding timely completion of the services under the contract and performance of services, the Tenderer shall promptly notify the Corporation in writing of the fact of the delay, its likely duration and its causes. As soon as practicable, after receipt of the Tenderer s notice, the Corporation shall evaluate the situation and may at its discretion extend the Tenderer s time for performance, in which case the extension shall be ratified by the parties by amendment of the Contract. 17. Warranty: The successful tenderer shall repair and replace the defective equipment or parts for three years from the date of successful installation and commissioning of Desktop and for one year of Thermal Printer and Barcode Scanner. The unit shall promptly notify the Tenderer in writing of any claims arising under this warranty. Upon receipt of such notice, the Tenderer shall, within all reasonable time, repair or replace the defective equipment or parts thereof without prejudice to any other rights which the Corporation may have against the Tenderer under the contract. If the Tenderer, having been notified, fails to rectify the defects within a reasonable period, in any case not more than one week, the Corporation may proceed to take such remedial action as may be necessary at the Tenderer s risk and expense and without prejudice to any other rights which the Corporation may have against the Tenderer under the contract and the Corporation shall levy liquidated damages as per Clause 14. 18. Force Majeure: In all cases where the delay or failure in performance of supply order/ contract is directly or indirectly caused by or due to acts of God, war, mobilization, demobilization, requisition by/ or interference from Page 8 of 16

government or local Authorities, force major lockout, labour disturbance, trade disputes, unavailability or shortage of materials, fires, riots, strikes, and/or civil commotion or any events or circumstances whatsoever beyond the control of the, tenderer then in such case, the Tenderer shall be entitled to an extension of time for performance of this contract for a period corresponding to the period of delay. 19. Arbitration: All disputes relating to this tender shall be referred to an arbitrator to be appointed by the Managing Director of the Corporation. Decision of the Sole Aribtrator shall be binding on both the parties as per the Arbitration and Conciliation Act, 1996. 20. Jurisdiction of Court: All disputes arising out of this contract shall be subject to jurisdiction of Courts at Port Blair only. 21. Corporation s right to accept any bid and to reject any or all bids: The Managing Director, ANIIDCO, Port Blair reserves the right to accept or reject any or all the tenders without assigning any reason thereof. 22. In case, the Supplier fails to perform or fulfill the Contract/ Purchase Order as per the terms and conditions agreed upon, the ANIIDCO is entitled to demand an amount equal to 10% of the Contract value from the Supplier and the demand made by the ANIIDCO by itself will be conclusive evidence and proof that the Supplier has failed to perform or fulfill his obligations and neither the Supplier nor the Bank will be entitled to raise any dispute regarding the reasons for the failure of performance or Page 14 of 16

fulfillment, on any ground. We, (name of the Bank), do hereby undertake to pay an amount equal to 10% of the order value, being the amount due and payable under this guarantee without any demur, merely on a demand from the ANIIDCO which has to be served on us before the expiry date of Bank Guarantee i.e., stating that the amount claimed is due by way of non-performance of the contractual obligations as aforesaid by the Supplier or by reason of the Supplier's failure to perform the said contractual commitments/purchase Order, any such demand made on the Bank shall be conclusive as regards the amount due and payable by the Bank under this guarantee. However, our liability under this guarantee shall be restricted to an amount not exceeding Rs. (Rupees only) being the amount equal to 10% of the total order value. We, (name of the Bank), further, agree that the performance guarantee herein contained shall remain in full force and effect for a period of calendar months from the date of Bank guarantee (the period should be till end of warranty period) and till the ANIIDCO certifies that the terms and conditions of the said contract/ purchase order have been fully and properly carried out by the said Supplier and accordingly discharge the guarantee, unless a demand or claim under this guarantee is made on us in writing by the ANIIDCO on or before, we shall be discharged from all liabilities under this performance guarantee thereafter. We, (name of the Bank), further agree with the ANIIDCO that the ANIIDCO shall have the fullest liberty without our consent and without affecting in any manner our obligations hereunder to vary any of the terms and conditions of the said Bidding Document and the Contract/Purchase order or to extend the time of performance by the said Supplier from time to time or postpone for any time or from time to time and any of the power exercisable by the ANIIDCO against the Supplier and to forebear or enforce any of the terms and conditions relating to the said Bidding Document and the Contract/Purchase Order and we shall not be relieved from our liability by reason of any such variation, or extension being granted to the said Supplier, or for any forbearance, act or omission on the part of the ANIIDCO to the said Supplier by any such matter or thing whatsoever which under the law relating to sureties would but for this provision have effect of so relieving us. This guarantee shall be in addition to and without prejudice to any other securities or remedies which the ANIIDCO may have or hereafter possess in respect of the goods supplied or intended to be supplied and the ANIIDCO shall be under no obligation to marshal in favour of the Bank any such securities or funds or asset that the ANIIDCO may be entitled to receiving or have a claim upon and the ANIIDCO at its absolute discretion may vary, exchange, renew, modify or refuse to complete to enforce or assign any security or instrument. The Bank agrees that the amount hereby guaranteed shall be due and payable to the ANIIDCO on serving us with a notice before expiry of bank guarantee, requiring the payment of the amount and such notice shall be deemed to have been served on the Bank either by actual delivery thereof to the Bank or by despatch thereof to the Bank by Registered Post Page 15 of 16

at the address of the Bank. In order to give full effect to the provisions of this guarantee the Bank hereby waives all rights inconsistent with the above provisions and which the Bank might otherwise as a guarantor be entitled to claim and enforce.
