Information or instructions: Motion affidavit & order for a new trial 1. A motion for new trial requests the court to reconsider its judgment for the reasons stated in the motion. 2. The motion should be filed within ten days after the judgment is rendered, and should be supported by an affidavit. 3. See Rules 320-329B of Texas Civil Procedure applicable to new trials. 4. The following form assumes that the court granted a judgment and a party seeking to overturn the court's decision is the Movant in the motion. The motion cites specific portions of the judgment that are contrary to law. 5. See Texas Rule of Civil Procedure 324, prerequisites of appeal. The rule has been amended and contains changes applicable to the motion for new trial process. 6. A point in a motion for new trial is no longer required as a prerequisite to a complaint on appeal in either a jury or non jury case, except as provided for in Subdivision B, Rule 324, which states: 7. A point in a motion for new trial is a prerequisite to the following complaints on appeal: (1) a complaint upon which the evidence must be heard such as jury misconduct or newly discovered evidence, (2) complaint of factual insufficiency of the evidence to support a jury finding, (3) a complaint that the jury finding is against the overwhelming weight of the evidence, (4) a complaint of inadequacy or excessiveness of the damages found by the jury, or (5) incurable jury argument if not otherwise ruled on by the trial court. 8. A motion for new trial must be filed within 30 days of the date the judgment is signed. 9. Also see Rule 329b(c). Amending a motion for new trial will not extend the 30-day-time period. The motion is considered overruled by operation of law in the event the original or amended motion for new trial, a motion to modify, correct or reform a judgment is not determined by written order and signed within 75 days after the judgment was signed. 10. Amendments to the motion for new trial are not allowed after 30 days from the date of judgment. Accordingly, the procedures of tacking on to the time period for appeals is prohibited.
