4.1. Introduction to Australia Skilled Migration Program The Australian General Skilled Migration Program (GSM) has been implemented through a partnership between the Australian government and the industry. The motive is to facilitate those professionals who have skills in a particular occupation required in Australia. The applications through the General Skilled Migration program can be independent or sponsored by a relative or nominated by an Australian State or territory government. The introduction of the SkillSelect Program since July 1 st, 2012 has led to major changes in the Australian Skilled Migration Program. SkillSelect SkillSelect changed the way prospective visa holders seek to migrate to Australia. Instead of applying for a visa, people submit an online Expression of Interest (EOI). The expression of interest (EOI) includes information on the applicant s personal details, English language skills, occupation and skills assessment, work or business and investment experience. An Expression of interest is not a visa application. In case, the applicant qualifies the EOI, he/she may be invited to submit an Australian Visa application. If such an invitation is received, then the applicant can submit a visa application along with the required documents within 60 days, or the invitation might be revoked. To prepare an application for the point based skilled migration to Australia, the following requirements need to be met: Invitation to apply: You can only apply for a visa if you have been invited to do so by the Department of Immigration and Citizenship following your qualifying the Expression of Interest. You can to lodge your application no later than 60 days after you receive your invitation, or the invitation will Automatically lapse, and there is no guarantee that you will be issued an invitation in the future. Age: You must be under the age of 45. English language: The minimum requirement is competent English (IELTS score of 6 in each section). This needs to be furnished before submitting an EOI. Nominated occupation: When you lodge your application, you nominate an occupation that corresponds to your qualifications. The nominated occupation must be listed on Australia s Skilled Occupation List. You must provide details of a Skills Assessment analogous to your nominated occupation in your EOI. 10

Your EOI is then ranked and points are awarded based on the claims you make about your skills, experience, and attributes. If you receive an invitation, your visa application will be assessed against the point system. In order to obtain an Australian visa, you need to achieve the pass marks, currently set at 65 points, but are subject to change according to the Australian labor market needs. Skill Assessment: Before you can submit your EOI, you must have your skills assessed corresponding to your occupation by an assessing authority. The criteria for skills assessment varies according to the occupation you have nominated. In most cases, the skills assessment will be based on the applicant s qualifications and work experience, though in some cases, English language proficiency and formal examinations are also required. 11

4.2 Skilled Independent Visa (Subclass 189) It is point based Visa which does not require any sponsorship by an employer, family member or nomination by a state or territory government. It helps skilled people to migrate in Australia. 4.3 Skilled Nominated Visa (Subclass 190) This is a point based Visa which helps the applicant to live, work and study in Australia for indefinite period of time. Applicant must be sponsored by state or any government agency. 4.4 Skilled Regional (Provisional) Visa (Subclass 489) This visa helps the skilled and qualified professionals to move to Australia on provisional basis. This Visa helps the applicant to stay in Australia upto four years. Applicant can easily work and live in the definitive territory of Australia. Immigrant can apply for PR after the completion of four year period. Immigrant can take Australian Citizenship during this period or renew PR or can take Resident Return Visas. 4.5.1 Temporary Skill Shortage visa (TSS) (Subclass 482) This visa is to cut the shortage of skilled laborers in Australia by addressing the skilled labor and on the same time the Australian people will get priority. TSS visa holders can work in Australia in their nominated occupation for their approved sponsor under one of three streams: The Short-Term Stream: In this, the employer sponsor the applicant for temporary basis for the occupation listed in the Short-term Skilled Occupation List (STSOL) for TSS Visa. The Medium-Term stream: In this, the employer sponsor the applicant for the occupation listed in the Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL) for a TSS visa for four years. The Labor Agreement stream: In this, the employer sponsors the applicant and he signs the labor agreement with the Department. ELIGIBILITY REQUIREMENTS: Approved sponsor should nominate the applicant and nomination must be approved. Should meet the English language requirements. Should meet the health and character requirements. Should meet all the requirements of the stream in which you have applied. 16

4.5.2 Employer Nomination Scheme (ENS) (Subclass 186) Under this subclass of Visa, the sponsored employee can get the Permanent Visa. The applicants should have age less than 50 years. DIFFERENT PATHWAYS TO APPLY FOR ENS VISA i. Labor agreement stream: In this scheme, the applicant has Labor agreement. ii. Direct entry stream: In this stream, assessment of the applicant skills is mandatory and applicant should have minimum 3 years experience in their occupation. IELTS score should be at least 6. iii. Temporary Agreement stream: Applicant should be the 457 Visa holder for 2 years. In this skill assessment is not required and IELTS score should be at least 5. ENS Visa application has two stages: i. NOMINATION: This stage reviews the business operations and position of employee. ii. VISA APPLICATION: In this stage the skill evaluation, English proficiency test and health & police checks are done. EXCEPTIONS IN SKILL ASSESSMENT The applicants do not have to show three years experience if he/she possess any of the following skills: Nominated in the occupation as a Senior Academic, Scientist, University Lecturer or Ministers of Religion Citizen of New Zealand New who have worked for their sponsoring employer for at least two years in the nominated occupation. The Salary on offer to the Visa applicant is above a certain threshold. The Visa applicant is applying on the basis of holding a 457 visa for at least two years (Temporary Residence Transition Stream) and is being nominated in the same occupation. 17

4.5.3 Regional Sponsored Migration Scheme Visa (Subclass 187) It is a Regional Sponsored Migration Scheme (RSMS) Visa that requires a Job offer in the Regional Australian area. It helps the skilled workers who want to work in Regional Australia. In order to get RSMS visa, a position must be offered to the employee in a Regional Area.
