The following members were present: Mr. Purvis Abshire, Mr. Terry Bessard, Mr. Ernal E. J. Broussard, Mr. Minos Broussard, Mr. Kenneth DeHart, Mr. Carroll Duhon, Mr. Hubert Faulk, Mr. Luther Buster Hardee, III Mr. Louis Joe Hardy, Mr. Pervis Pee Wee Meaux, Mr. Mark Poche, Mr. T. J. Prejean, Jr., Mr. Edval J. Simon, Jr. Mr. Ritter P. Trahan. Absent: None Upon motion of Mr. T. J. Prejean, Jr., duly seconded by Mr. Mark Poche, and unanimously carried, the reading of the minutes of the May 7, 2001 meeting were dispensed with and were accepted. President Ritter Trahan called for any other bids in the audience to be submitted relative to the bid call shown on the agenda. Upon motion of Mr. Minos Broussard, duly seconded by Mr. Purvis Abshire, and unanimously carried, the Jury closed the receipt of all bids for tonight s meeting. Upon motion of Mr. Louis Joe Hardy, duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Jury authorized the opening of the only bid received for tonight s meeting. 2001 Long Wheel Base Diesel Truck For Vermilion Parish Cooperative Extension Service Bay City Ford - $31,871.70

Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury authorized the award of the contract to furnish the vehicle referenced above to Bay City Ford. President Ritter Trahan read the following announcement: (1) Received an invitation from IHS of Kaplan announcing their upcoming Ribbon Cutting Ceremony and Dedication of their Renaissance Wing (Secured Alzheimer s area) on Wednesday, May 23, 2001 at 2:00 p.m. (2) The Statewide Local Coastal Program Quarterly Meeting will be held on Thursday, May 24, 2001 in Baton Rouge at the Ione Burden Conference Center. (3) The next meeting of the Acadiana Resource Conservation and Development Council will be held on Tuesday, May 22, 2001 at 6:00 p.m. in Carencro. Upon motion of Mr. Hubert Faulk, duly seconded by Mr. Louis Joe Hardy, and unanimously carried, the Public Road Committee Recommendations were amended to include the adoption of an ordinance to establish a 40 mph speed limit on Dubose Road for its entire length as follows: O R D I N A N C E 2001-O-9 WHEREAS, it has been brought to the Police Jury s attention that a considerable amount of speeding is existing and causing very hazardous conditions on Dubose Road; and SECTION I: NOW THEREFORE, BE IT HEREBY ORDAINED, that the Vermilion Parish Police Jury does hereby impose a 40 mph speed limit on said road for its entire length; and SECTION II: BE IT HEREBY FURTHER ORDAINED, that a maximum penalty of $100.00 and/or a 10 day jail sentence may be imposed at the discretion of the court. SECTION III: BE IT HEREBY FURTHER ORDAINED, that Honorable Sheriff Raywood Lemaire be and is hereby requested and/or directed to enforce the speed limit by the use of radar and/or regular patrolling. * * * * * * * * *

Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, Item No. 5 of the Public Road Committee Recommendations was amended to reflect that the purchase of a new portable building for the Area 2 Satellite barn in the Mouton Cove area be approved to be purchased from Living Quarter Technology at a cost of $10,000.00. Upon motion of Mr. Edval J. Simon, Jr., duly seconded by Mr. T. J. Prejean, Jr. and unanimously carried, the Public Road Committee Recommendations were further amended to enter into the following intergovernmental agreements with the Prairie Gregg Drainage District:

Prejean, Jr., and unanimously carried, Item No. 6 of the Public Road Committee Recommendations was amended to add the following state highway driveway permit installations: E) Dewey Domingues La. Hwy 330 F) Abby Broussard La. Hwy 688 Upon motion of Mr. Luther "Buster" Hardee, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Public Road Committee Recommendations were approved as amended, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC ROAD COMMITTEE MAY 16, 2001 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC ROAD COMMITTEE MEETING HELD ON MAY 16, 2001, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that in response to Ms. Patty Henely request, that she be advised that the proposed road right of way she wants to be dedicated to the Police Jury can and would be accepted into the parish road maintenance system if all required specifications are met. 2. It is recommended that authorization be given to replace the transaxle in the Case 580 Tractor with a rebuilt unit at a cost of $5,800.00 in lieu of repairing the existing unit at a cost of $4,317.00. The rebuilt unit has a six (6) month warranty. 3. It is recommended that Mr. Kevin Meaux, janitor/mechanic aide/parts runner, at the Mechanic Shop be terminated. It is further recommended that Mr. Winfred Collins be transferred from the Area 1 Road Crew to the Mechanic Shop to replace Mr. Meaux. It is further recommended that Mr. Barry Young be hired as a truck driver/mower operator to replace Mr. Collins and assigned to the Area 1 Road Crew. 4. It is recommended that authorization be given to obtain quotes and purchase a rear mower to be located in work Area 2. The cost of the mower is to be paid from Road District No. 7, Road District Sub 1 of 2, and Road District No. 4A funds and prorated as was done for previous equipment purchased.

5. It is recommended that a new 16 x 24 portable building for the Area 2 Satellite barn in the Mouton Cove area be approved to be purchased from All-States Portable Buildings at a cost of $10,989.00. Costs includes finishing the interior ceilings, walls, flooring electrical, insulation, 5 x 5 bathroom area with fixtures, etc. and delivered and leveled on the site. 6. It is recommended that the following state highway driveway permit installations be approved to be installed: A) Dewey Domingues La. Hwy 330 B) Dewey Domingues La. Hwy 338 C) Herman J. Suire La. Hwy 339 D) Stacy Duhon La. Hwy 343 7. It is recommended that the invoices shown on the attached sheets be approved to be paid. 8. It is recommended that a pauper funeral allocation be authorized to be paid for Alisha Angelle Benoit (3 month old child), made payable to Brailey s Marble and Granite Works in Abbeville. Prejean, Jr., duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Public Works Committee Recommendations were approved as presented, and the appropriate officials of the Jury were authorized to carry out the recommendations; PUBLIC WORKS COMMITTEE MAY 16, 2001 ABBEVILLE, LOUISIANA AS A RESULT OF A PUBLIC WORKS COMMITTEE MEETING HELD ON MAY 16, 2001, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that the damage claim of Mr. Randy Trahan be approved to be repaired at Primeaux s Body Shop at a cost $252.00 being the lowest of two (2) quotes received. 2. It is recommended that the legal counsel be requested to file for a restraining order against former employee Wayne Richard in view of incident which occurred 5/15/01. 3. It is recommended that Invoice No. 483 from Rodney Istre and Sons Construction, in the amount of $14,000 be approved to be paid. Invoice represents balance of contract due for the Meaux-Nunez Fire Station addition. Payment to be made from balance of Rural Development Grant available ($8.00) and from Meaux-Nunez Fire Department funds. Payment to be made after inspection and acceptance as complete by The Sellers Group and by the Fire Department Board. 4. It is recommended that the Little Chapel Fire Department be reimbursed the amount of $2,713.87 from their annual Sales Tax 76 allocation. Amount represents the purchase of three (3) fire suits received in February, 2001 from Ferrara Fire Apparatus, Inc. 5. It is recommended that the invoices shown on the attached sheets be approved to be paid.

6. It is recommended that the Police Jury approve the award of the contract to construct the Phase III, Subtitle D Improvements at the Solid Waste Plant to SERROT INTERNATIONAL, INC. at a cost of $103,816.09, being the lowest qualified bid received on May 7, 2001. 7. It is recommended that Invoice No. 006067 from Sellers and Associates, Inc. in the amount of $411.25 be approved to be paid. Invoice for engineering services provided to prepare specifications, go through bid process and award contract for the 2001-2003 Aerial Spray Service Contract for the Mosquito Control Program. 8. It is recommended that the Police Jury endorse the applications submitted by the various volunteer fire departments for grant funding under the new federal funding authority. It is further recommended that the Congressional delegation be requested to support the program. 9. It is recommended that Sellers and Associates be authorized to complete the specifications and advertise for bids to furnish a new fire truck for the Pecan Island Fire Department. COURTHOUSE BUILDING COMMITTEE MAY 16, 2001 ABBEVILLE, LOUISIANA AS A RESULT OF COURTHOUSE BUILDING COMMITTEE MEETING HELD ON MAY 16, 2001, THE FOLLOWING ITEMS ARE RESPECTFULLY SUBMITTED FOR THE JURY S CONSIDERATION: 1. It is recommended that the following invoices from THE SELLERS GROUP be approved to be paid: A) Statement No. 2052 - $16,638.75 Design Development Phase New Abbeville Library Project B) Statement No. 2051 - $2,130.34 Construction Phase Kaplan Branch Library Project C) Statement No. 2056 - $2,407.50 Schematic Design Phase Maurice Branch Library Project Cost to be paid from Library Bond funds. 2. It is recommended that the previous budget authorization request from the Vermilion Parish Assessor s office be amended to reflect the purchase of a lap-top computer and printer in lieu of the filing system. Chairman In accordance with the Courthouse (Building) Committee Recommendations, the following intergovernmental agreement was entered into: TITLE: A resolution authorizing the Vermilion Parish Police Jury and the Hospital Service District No. 3 (Gardiner Community Health Center) to enter into an intergovernmental agreement all in accordance with the provisions of La. R.S. 33:1321 et seq. GENERAL STATEMENT OF CONTRACTUAL AUTHORITY WHEREAS, the provisions of La. R.S. 33:1321 et seq, dealing with intergovernmental functions, authorize the police jury of a parish, and any city, town or village, and any special district or political subdivision of the state to agree between and among themselves to engage jointly in the exercise of any power, and in the construction, acquisition or improvement of any public project or improvement, or the promotion and maintenance of any undertaking when either one of the participants in the agreement is authorized under provision of general or specific law to perform such activity or exercise such power as may be necessary for completion of the undertaking (La. R.S. 33:1324); and AGREEMENT WHEREAS, the building formerly utilized as the Gueydan Health Unit is currently vacant; and WHEREAS, Hospital Service District No. 3 is requesting the use of the facility; NOW, THEREFORE, the Vermilion Parish Police Jury does resolve to allow the Hospital Service District No. 3 to utilize the building; NOW, THEREFORE, the Hospital Service District No. 3 does;

RESOLVE THAT, they will be responsible for the cost of utilities, building insurance, any renovation costs and will provide maintenance of the facility. RESOLVED FURTHER, by both parties that a certified copy of this resolution shall immediately be filed and recorded in the records of the Clerk of Court for the Parish of Vermilion, Louisiana; and upon adoption of this resolution by both parties and recordation of same, it shall constitute the agreement between the Police Jury and the Hospital Service District No. 3 and a copy of this resolution shall be published in the official journal of the above said parties concerned. * * * * * * * * * * Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Police Jury allowed those in the audience to present their business at this time. Mr. Brian Angelle, on behalf of Texaco Pipeline, requested a letter of no objection from of the Vermilion Parish Police Jury to allow Texaco Pipelines LLC, successor in title to Texaco, Inc., to utilize two (2) pipelines (a 30 gas pipeline and a 10 liquids pipeline), for the transportation of oil, gas, petroleum products or any other liquids, gases or substances which can be transported through a pipeline(s). Texaco Pipelines LLC was granted permission to lay, construct, maintain and operate these pipelines under canals within the district of the Prairie Gregg Drainage District through a resolution approved by the Prairie Gregg Drainage District on January 31, 1964, in which the wording (gas pipeline and liquids pipelines) unintentionally may cause to restrict Texaco, Inc., of the type of products they can use these pipelines. Upon motion of Mr. Edval J. Simon, Jr., duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury approved the issuance of a Letter of No Objection to Texaco Pipelines LLC to use pipelines for the transportation of oil, gas, petroleum products or any other liquids, gases or substances which can legally be transported through those pipeline(s) covered under said January 31, 1964 resolution. Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Hubert Faulk, and unanimously carried, the Police Jury authorized the President to sign the following proclamation designating the week of May 20, - 26, 2001 as Emergency Medical Services Week.

Upon motion of Mr. Edval J. Simon, Jr., duly seconded by Mr. Kenneth DeHart, and unanimously carried, the Police Jury adopted the following resolution approving the holding of an election in the Prairie Gregg Drainage District on Saturday, July 21, 2001, to authorize the levy of a special tax therein:

Prejean, Jr., duly seconded by Mr. Pervis "Pee Wee" Meaux, and unanimously carried, the Police Jury appointed the following persons to serve on the Vermilion Parish Industrial Development Board: 1) Richard Dubois 2) Sammy Noel Upon motion of Mr. Kenneth DeHart, duly seconded by Mr. Edval J. Simon, Jr., and unanimously carried, the Police Jury adopted the following ordinances altering the boundaries of Waterworks District No. 1 and Southeast Waterworks District No. 2:

Upon motion of Mr. Ernal "E. J." Broussard, duly seconded by Mr. Terry Bessard, and unanimously carried, the Police Jury approved a pauper funeral allocation for Eldia Gilbert made payable to Rapheal s Funeral Home. The Secretary advised the Jury that the Ambulance Ordinance Review Committee meeting has been rescheduled for Tuesday, May 29, 2001 at 5:30 p.m. Upon motion of Mr. Carroll Duhon, duly seconded by Mr. Ernal "E. J." Broussard, and unanimously carried, the Police Jury directed that someone from the Courthouse meet with Mr. C. J. Bertrand to begin the transition of issuing Building Permits. Upon motion of Mr. Purvis Abshire, duly seconded by Mr. Carroll Duhon, and unanimously carried, the Police Jury directed the Secretary to send a letter to Slemco regarding requesting that they relocate two (2) electrical poles located in a drainage ditch along Klaby Meaux Road which are causing an obstruction.
