CITY OF LAREDO BOARD OF ADJUSTMENT Bm. Averill informed all board members of a meeting that was scheduled with the Mayor to discuss the variance request denials. Mr. Averill added the City Manager, Building Department and Legal Department were present to create a flowchart that would determine the action to be taken after a BOA variance denial. Mr. Averill announced that a follow up report of the variance request denials will be presented at the beginning of each meeting. V. CHAIRMAN AND DIRECTOR S REPORT AND COMMUNICATIONS: No updates reported. VII. PUBLIC HEARING AND CONSIDERATION OF THE FOLLOWING VARIANCE REQUEST: A. Request submitted by Michael Connor to authorize an exception to the literal interpretation of the Laredo Land Development Code, Section 24-77, entitled Dimensional Standards, by granting a variance to the setback requirements on the Lot 106, Block 7, Hillside Terrace Unit II, located at 309 Gumwood Ln. BOA-19-2018 Bm. J. Martinez motioned to open the public hearing. Second: Bm. R. Perales In Favor: 5 Opposed: 0 Abstained: 0 Motion passed unanimously. Michael Connor spoke in favor of the variance request. Mr. Connor explained to the board that the variance request is to add a room between the porch and the master bedroom. Mr. Connor added that the house was originally built with the rear encroachment but no further encroachment is planned. Planning staff confirmed the house is currently encroaching and the plans submitted show a building extension to the side, thus no additional rear encroachment is being presented for approval. Bm. Martinez asked the applicant if he has initiated the construction being proposed. Mr. Connor assured the board that no construction has been started. Bm. A. Perales motioned to approve the following variance request: Lot 106, Block 7, Hillside Terrace Unit II Front Yard Setback = from the required 20 ft. building setback to 13 ft. 7 in. building setback. REPORT ON THE FOLLOWING BOA ORDERS BOA-16-2018 Property Address: Lot 244, Block 15, Lowry Farm Subdivision, located at 149 Ashton Loop Applicant: Sergio Lozano Planning Staff, Ana Villarreal, informed the Board Members that the property owner of 149 Ashton Loop has been cited three times, last citation issued after the BOA variance request denial on April 11, 2018. Staff provided a summary on 2017 variance request denials. Out of the 9 denied variance requests, 4 properties have come to compliance, and 5 have not complied. From those properties still out of compliance, 2 have obtained a demolition permit. Also, Staff added Code Enforcement will continue to follow up on those variance request denials and updates will be continually presented to the board. B. VIII. ADJOURNMENT Bm. F. Garza to authorize an exception to the literal interpretation of the Laredo Land Development Code, Section 24-77, entitled Dimensional Standards, by granting a variance to the setback requirements on Lot 30, Block 9, Sierra Vista Unit V, located at 4724 Los Cerezos Dr. BOA-20-2018 BACKGROUND: Council District: I - The Honorable Rudy Gonzalez, Jr. Site: The site has a single family residence. Zoning: R-1A (Single Family Reduced Area District). Applicant Position and Variance Request Summary: The applicant requests the following variance from the dimensional standards as required by the Laredo Land Development Code, Section 24-77, entitled Dimensional Standards, (See attached Exhibit A ): Lot 30, Block 9, Sierra Vista Unit V Front Yard Setback = from the required 20 ft. building setback to 0 ft. building setback. Building Department denied building permits due to the following violation: Failure to comply with setback requirements as per the Laredo Land Development Code, Article V, Chapter 24, Section 24.77.1 STAFF COMMENTS:
Laredo Land Development Code, Section 24.1.3.2(2) (b), entitled Responsibilities of Zoning Board of Adjustments, allow the Board to vary the building setback in peculiar and unusual circumstances which would prevent the reasonable use of the land. (see attached Exhibit B) Laredo Land Development Code, Section 24.1.3.3(e), entitled Standards for Granting Variances, Appeals and Permits, stipulates the Board may grant a variance in applicable cases, that the strict enforcement of this ordinance shall deny the property owner the use of his property for any reasonable land use (see attached Exhibit B) Staff does not support the proposed variance. There are no peculiar and unusual circumstances which would prevent the reasonable use of the land. Thus, denial of the proposed variance shall not result in the prevention of the reasonable use of the land. STAFF RECOMMENDATION: Staff does not support the variance request.
