THAT Council adopt "Bylaw No. 2521, City of Kimberley Official Community Plan Bylaw No. 2333, Amendment No. 12, 2015"; AND 2. BACKGROUND Applications have been submitted by the property owner proposing to amend the Official Community Plan (OCP) and the Zoning Bylaw to allow for future residential development of three lots on Deer Park Avenue, adjacent to Mark Creek, presently designated for commercial development. The applicant's description of the proposed development is attached. Council approved 1st reading on June 8 and held the public hearing on June 22 during which there were no submissions or presentations to Council. Council subsequently approved 2nd and 3rd readings at the June 22 meeting. ANALYSIS The proposed bylaw 2521 will amend the OCP Planned Use Map by re-designating the subject land from "Commercial" to "Low Density Residential." The proposed bylaw 2522 will rezone the subject land from "Central Commercial Zone: C-1" to "Single and Two Family Residential Zone: R-2." One of the lots contains an existing residential building. The owners plan to build a new house on the other two lots that are presently vacant. The Ministry of Transportation and Infrastructure has confirmed no concerns with the proposed zoning amendment. Application fees have been paid. Applicant will also be invoiced for cost of the public hearing advertising. The potential for future commercial development of this property is likely limited given its small size, restricted access and reduced visibility. The amendments will allow for development of the property that is compatible with the permitted uses of adjacent parcels. The proposed development is minor in scale and should not negatively impact local traffic volumes or patterns. Administration supports the proposal and recommends that Council adopt the bylaws.

City of Kimberley Official Community Plan Bylaw No. 2233, 2005 is hereby amended in the manner set forth in this Bylaw. 2. Schedule A: Planned Land Use, attached to and forming part of Bylaw No. 2233, is amended by re-designating Lots 6, 7 and 8, District Lot 1358 Kootenay District, Plan 1462, civically located at 350, 360 and 370 Deer Park Avenue, from Commercial to Low Density Residential as shown in heavy outline on Schedule A attached hereto and forming part of this Bylaw. 3. Page 13 of 16 CITY OF KIMBERLEY FROM: Dave Clarke REPORT TO SPECIAL COUNCIL Item: RPT - 0365 File: 8100-20 DATE: June 26, 2015 SUBJECT: Medieval Festival - Archery Event MEETING: Special Council RECOMMENDATION Due to the last minute organization of the archery event I have some concerns. I don't feel the "Viking Village Map" outlines the location of the "archery site" very well leaving the safety and wellbeing of the pubic undetermined. My main concern is where an arrow would go if misfired. This is not a risk I would like to take. BACKGROUND Reason for Report: The organizers of the Medieval Festival taking place on July 11-12, 2015 are requesting to put on an archery event at Coronation Park. Bylaw No. 1564, which includes long bows, compound bows or crossbows, states: No person shall discharge a firearm within the boundaries of the City of Kimberley without the consent of the police unless at a designated shooting or archery range as recognized and approved by Council. Please see the attached letter to Council from the organizers of this event. Page 3 of 4 Page 15 of 16 KIMBERLEY MEDIEVAL FESTIVAL June 25, 2015 City Council City of Kimberley 340 Spokane Street Kimberley, BC V1A 2E8 To City Council Further to the subject of archery in the city of Kimberley, we have followed the outlined regulations to obtain police consent, as outlined in bylaw 1564, which states: No person shall discharge a firearm within the boundaries of the City of Kimberley without the consent of the police. As requested by the police, we have done our due diligence to ensure that this will be a safe event that will in no way endanger the public safety. The safety measures which we will be put in place are as follows: The archery demonstration will take place once per day for the two days of the festival at approximately 2:30 on Saturday, July 11th and 2:00 on Sunday, July 12th. It will consist of the Vikings and archery club having an archery competition to knock an apple of a helmet. All participants are fully trained and have proper insurance. The arrows being used will be blunted arrows (not sharp), both to ensure that no sprinkler lines are damaged, and also to further ensure the safety of the public. They will be using long bows, a 35 lb draw weight, and the arrows have four large flutings on the back as opposed to three small shaped ones, to help slow them down. They are also all fitted with specific re-enactment blunt tips for safety. The area where the archery demonstration will be held will be roped off from the public, and the public will have at least a six foot barrier at all times. General safety guidelines the Vikings use also include: clearly shout commands "Knock, Draw, Loose". Check all blunts and arrows for defects before every show, and never loose an arrow in any direction other than the open lane given. As in, they know exactly which direction they can shoot, as there will be no members of the public standing behind the target zone. Hay bales will be stationed behind the target.
