The Arizona Association of REALTORS Voter Guide is a resource produced by the REALTORS of Arizona Political Action Committee (RAPAC) to give AAR members a better understanding of the candidates who are running for political office in the 2014 Arizona elections.

This guide was assembled by AAR member volunteers who scrutinized voting records and evaluated candidate questionnaires on issues important to REALTORS. Funding for this guide was provided by volunteer donations from REALTORS around the state. We hope that you find this information useful as you make your choices on Election Day. LEGISLATIVE BILLS & AAR S POSITION Fire Access Roads; Limitation; Sprinklers Prohibits municipalities and counties from requiring a fire apparatus access road or approved route that would result in the mandatory installation of fire sprinklers. Campaign Finance; In-kind Contributions; Disclosures (Homeowners Association; Omnibus) Establishes protections for homeowners and tenants against continued onerous abuses by homeowners associations (HOAs) that interfere in contractual relationships, require sensitive personal information disclosures and unjustly assess costly fees on homeowners. Homeowners Associations Amendments; Omnibus Outlines lawful actions a property management company can take on behalf of a association (HOA) and establishes rental rights of tenants, unit/property owners in condominium and planned community HOAs. Property Tax Penalty Waiver Enables county treasurers, in consultation with boards of supervisors, to waive a penalty imposed on a property owner who fails to respond to a request for information regarding the property s classification for tax purposes. Mortgages; Trust Deeds; Deficiency Actions Allows deficiency judgments against spec builders and developers who obtain construction loans for sales to homes to third parties. Applies to mortgages and deeds of trusts originated after December 31, 2014. Real Estate Licenses; Cancellation Permits the Arizona Department of Real Estate to cancel a person s license, at the individuals request, regardless of whether the license status is active or not. Homeowners Associations; Transfer Fees; Exemption Exempts owners and associations from providing the resale disclosure information required by statute if the transfer is a conveyance by recorded deed; if the deed bears an exception which covers transfers for only nominal actual consideration between family members or for no consideration or nominal consideration between companies or entities with common ties. 4 2014 VOTER GUIDE - P RIMARY ELECTION

Assessing Non-Incumbent Candidates Questionnaire Responses Non-incumbent candidates must fill out our candidate questionnaire in order to be considered for an interview and endorsement. Due to space limitations, we have chosen five questions to include in this Voter Guide for your consideration of the candidates. Other questions included on the questionnaire were related to water, land management, line extensions, utility fees and HOA issues. He currently serves as the chairman for the Natural Resources and Rural Affairs Committee. He was instrumental in stopping legislation harmful to the industry. He is a strong advocate for rural Arizona. Karen Fann 1. She serves as the chairwoman for the Transportation Committee. She previously held a real estate license; and as a legislator, she has sponsored real estate legislation and is a friend of the industry. Linda Gray Is a past state legislator who strongly supported REALTOR issues. She plans to focus on the economy, education and public safety issues. Candidate Questionnaire Answers 1. No, not when it increases the property tax rates for homeowners. 2. Increase jobs for a direct correlation to a reduction in government assistance. 3. No, there are already plenty of regulations. 4. D I S T R I C T 2 Andrea Dalessandro Incumbent senator in District 2. She is a retired CPA and well versed in tax issues. She is a friend of the real estate industry. Damion Clinco 2. She is focused on creating opportunities and prosperity by supporting and encouraging education and economic development efforts. absent D I S T R I C T 3 Olivia Cajero Bedford Incumbent senator in District 3. She has focused on increasing educational standards throughout the state. She has a favorable voting record with our association. Saldate Macario 3. D I S T R I C T 4 Lynne Pancrazi Incumbent senator in District 4. She previously held a real estate license and was a past recipient of AAR s Legislator of the Year award. Lisa Otondo 4. Her focus has been on economic development, job creation and education. She is a REALTOR member. D I S T R I C T 5 Kelli Ward Incumbent senator for District 5. She serves on the Government and Environment Committee and is a friend to the industry. Sonny Borrelli 5. He is a retired Marine and owns a small business. He has focused on increasing housing opportunities for Veterans. ARIZONA ASSOCIATION OF REALTORS 7

D I S T R I C T 6 Chester Crandell Incumbent senator for District 6. He is a strong supporter of private property rights and is an advocate for rural Arizona. Brenda Barton 5. She once held a real estate license. She serves as the chairwoman for the Agriculture and Water Committee and has sponsored legislation for the association. Bob Thorpe Incumbent fiscal conservative, a published constitutional author and lecturer. He has focused on jobs and fiscal responsibility. D I S T R I C T 7 Carlyle Begay Incumbent senator in District 7. He was appointed to office in late 2013. D I S T R I C T 8 Barbara McGuire Incumbent senator in District 8. She believes that government should be efficient, accountable and responsive to the people of Arizona. Frank Pratt 8. He is the chairman of the Energy, Environment and Natural Resources Committee. He believes that growth occurs when government is less intrusive and that the legislature needs to be fiscally responsible. absent absent absent T.J. Shope 8. He is a manager at Shope IGA, a family-owned supermarket. He has focused on job creation, fiscal order and regulatory reform. One Way RAPAC Helps Homeowners Save Money RAPAC helped to defeat special legislation that would have provided a dramatic tax reduction to one for-profit regionally accredited institution of higher education. The tax reduction would have shifted the institutions real and personal property tax to Class 6 (assessed at 5%) from Class 1 (assessed at 19.5%). Homeowners are in Class 3 (assessed at 10%). The result would have shifted the tax burden onto the backs of homeowners in the form of increased property taxes. AAR successfully fought to defeat this legislation. D I S T R I C T 9 Steve Farley Incumbent senator in District 9. He is an artist and owns a small business. Since taking office, he has had a pro-realtor record. 9. He has proven to be someone that will listen to the industry s concerns. Ethan Orr Victoria Steele 9. In her time at the legislature, she has had a pro-realtor voting record. D I S T R I C T 1 0 David Bradley Incumbent senator from District 10. He has been an advocate for children and families during his legislative career. He is a reasonable, thoughtful and articulate legislator who reaches across the aisle to work in the best interest of Arizona. Bruce Wheeler 10. He has a history of public service at both the local and state level of government. He is a past recipient of AAR s Legislator of the Year award. 10 2014 VOTER GUIDE - P RIMARY ELECTION

D I S T R I C T 1 0 C O N T I N U E D Stefanie Mach Incumbent representative from District 10. She has focused on increasing job opportunities and establishing fiscal responsibility. She has a favorable voting record with the association. D I S T R I C T 1 1 Steve Smith Incumbent representative for District 11 and is running for the State Senate. He is an advocate for education, economic stability and border security. absent Vince Leach He owns a small business. He plans to focus on job creation, reduction in taxes and smaller government. Candidate Questionnaire Answers 1. No, I do not support a straight line shift to the Counties. 2. Growing the economy and growing the tax base to reduce or eliminate budget challenges. 3. I am not aware of any circumstances that would warrant an increase in regulations for the (real estate) industry. 4. Any change in the tax structure needs to be thoroughly researched, as it may produce unforeseen consequences. 5. Lower taxes, reduce burdensome regulation and show that Arizona has the ability to provide low cost power and water. Mark Finchem Is a REALTOR, a fiscal and social conservative. He plans to focus on the protection of private property rights. Candidate Questionnaire Answers 1. No, homeowners must not be reduced to renters via taxation. 2. Corporate Income Tax must change, follow the Texas model, and pay off debt now. 3. No, the industry operates fairly and efficiently with existing regulations. 4. No. We are taxed enough already. 5. D I S T R I C T 1 2 Andy Biggs Incumbent, president of the Senate. He is a past recipient of AAR s Legislator of the Year award. He has proven to be a protector of private property rights and individual liberties. Eddie Farnsworth 12. He is the chairman of the House Judiciary Committee. He is a longtime supporter of our industry and has been helpful in protecting private property rights. * Voted against * did not want to see any changes to the states anti-deficiency statutes. Warren Petersen Incumbent REALTOR and owner/ broker of a real estate firm. His focus has been to limit government, lower taxes, reduce regulation and protect individual rights. D I S T R I C T 1 3 Don Shooter Incumbent senator for district 13. He is the chairman of the Senate Appropriations Committee. He has extensive knowledge of our industry and does not support a professional service tax nor believe we need further regulation. Darin Mitchell 13. He is a REALTOR and has been in the real estate profession for over 22 years. In his tenure, he has cosponsored numerous bills for the association. Steve Montenegro Incumbent representative for District 13. He is the chairman of the Reform and Human Services Committee. He has had a pro-realtor record since taking office. absent

D I S T R I C T 1 4 Gail Griffin Incumbent senator for District 14. She is a REALTOR and has been in the real estate profession for over 35 years. In her tenure, she has sponsored numerous bills for the association. She is a strong advocate for rural Arizona. David Steven Incumbent representative for District 14. He is the chairman of the Technology and Infrastructure Committee in the House. He is an advocate for personal property rights and individual liberties. David Gowan 14. He serves as the House Majority Leader. He has been a protector of private property rights and a friend of the industry. D I S T R I C T 1 5 Nancy Barto Incumbent senator for District 15. She has proven to be someone that will listen to the industry s concerns. Heather Carter Incumbent representative for District 15. She was once a REALTOR. In his first year, he was supportive of REALTOR issues. not in office not in office not in office Doug Coleman 16. As a former mayor he has extensive knowledge of all issues affecting government. D I S T R I C T 1 7 Steve Yarbrough Incumbent senator in District 17. He runs Arizona Christian School Tuition Organization. He is proficient on tax issues. J.D. Mesnard 17. He is the speaker pro tempore for the House of Representatives. He has had a pro-realtor record since taking office. Jeff Weninger Is a current city council member and small business owner. He plans to focus on education, public safety and infrastructure. Candidate Questionnaire Answers 1. No, but if we can lower other taxes without the shift to homeowners, then I would support. 2. Will scrutinize the budget closely. 3. I feel we need less regulation in all aspects of life. 4. No, I don t believe services should be taxed. 5. Whatever the state can do to make your jobs easier and more efficient. D I S T R I C T 1 8 Jeff Dial 18 and is running for the State Senate. He is a REALTOR and has been a long-time supporter of our industry and has sponsored numerous pieces of legislation for the association. Bob Robson 18. He serves as the chairman for the House Rules Committee. D I S T R I C T 1 8 C O N T I N U E D John King Is a business owner and school board member. His focus will be on increasing safety, education, jobs and the economy.
