City of Baldwin City Minutes from the July 17, 2018 Regular Council Meeting The Baldwin City Council met in Regular Session at 7:00 p.m. at the Baldwin City Public Library, 800 7th Street, with Mayor Casey Simoneau presiding. Present were Council Members: Tony Brown, Brian Cramer, A.J. Stevens and Susan Pitts. Also, attending: Glenn Rodden-City Administrator; Laura Hartman, City Clerk; Brad Smith, Finance Director; Gregg Schiffelbein, Police Department; Kenny Oshel, Public Works Director; Rob Culley, Utility Production Director. City Attorney, Blake Glover and David Simmons were absent. A. Call to Order: Mayor Casey Simoneau called the regular council meeting to order at 7:00 p.m. B. Approval of Agenda: Susan Pitts moved and A.J. Stevens seconded to approve the July 17, 2018 agenda. Motion carried with a vote of 4 yes and 0 no. C. Consent Agenda: Council considered minutes of the July 17, 2017 Regular Meeting and Special Events: Maple Leaf Festival and Outdoor Concert. Tony Brown moved and Brian Cramer seconded to move Outdoor Concert to New Business, #4. Motion carried with a vote of 4 yes and 0 no. A.J. Stevens moved and Susan Pitts seconded to approve the consent agenda as amended. Motion carried with a vote of 4 yes and 0 no. David Simmons arrived at 7:05 p.m. D. Public Comment: Lloyd Lam, 507 Oakleaf Court shared concerns about a neighbor with junk in the yard. Mr. Lam is trying to sell property next door to the property. E. Special Reports or Presentations: 1. Library Report - Cheryl Sylvester, Director Baldwin City Library presented the quarterly report from the library. 2. Baldwin City Economic Development Hank Booth from the BCED gave an update to the council on its activities and accomplishments. 3. Chamber of Commerce Report Jeannette Blackmar gave an update to Council on the activities and accomplishments of the Chamber of Commerce. 4. Baldwin Golf Association presentation. Jay Armbruster, President golf association board gave a presentation to the council about the various activities that take place throughout the year on the golf course. Jay will be back at the end of the year with an annual report. Brian Cramer moved and A.J. Stevens seconded to approve Resolution 2018-12 with the amendment under Section 1. to add green space which contains Baldwin City golf course. Motion carried with a vote of 5 yes and 0 no.
Mayor Simoneau requested to add Funding options for the Chamber of Commerce under agenda item G. 1., New Business. Brian Cramer moved and Tony Brown seconded to approve adding Funding options for the Chamber of Commerce under New Business Agenda Item G. 1. Motion carried with a vote of 5 yes and 0 no. F. Old Business: 1. RFP Solar. Staff member, Paul Mahlberg from the Kansas Municipal Energy Association (KMEA) will attend to discuss the city s solar project. KMEA is proposing to provide project management services for this project at no additional cost to the city. Representative, David Schup from Evergy was present to answer questions from council members. Council ensued discussion. David Simmons moved and A.J. Stevens seconded to enter into contract negotiation with Evergy as specified in the submitted proposal. Motion carried with a vote of 5 yes and 0 no. 2. Sunflower Grant - Recently, the City was awarded $10,000 grant to hire a consultant to work with the four jurisdictions along the Midland Railway trail easement to construct a multi-use trail from Baldwin City to Ottawa. Marilyn Hull Consulting submitted a proposal to provide professional services. A.J. Stevens thanked the Chamber of Commerce for bringing this grant forward and working with staff. Marilyn Hull was present to address questions from Council. David asked for a short explanation of what Marilyn will actually be doing. Marilyn will be working with all 4 municipalities and getting everyone on board with the project. Marilyn noted, identifying all 4 municipalities and building a steering committee from the 4 municipalities is on the agenda. Susan Pitts moved and Brian Cramer seconded to approve Marilyn Hull Consulting to provide professional services in the amount of $7500.00 for the trail easement project. Motion carried with a vote of 5 yes and 0 no. 3. Ordinance UPOC and STO. This was a second reading of this ordinance. David Simmons said he would not be voting to not approve because he does not have a clear understanding of the changes. Tony Brown moved and A.J. Stevens seconded to approve the ordinance for the UPOC. Motion carried with a roll call vote; Brown, aye; Pitts, aye; Stevens, aye; Simmons, nay; Cramer, aye. Tony Brown moved and A.J. 4. Resolution- Maple Leaf - City Clerk, Laura Hartman explained why a resolution was necessary for street closures and sidewalk use. A.J. Stevens moved and Susan Pitts seconded to approve Resolutions 2018-13 and 2018-09. Motion carried with a vote of 5 yes and 0 no. 5. RFP Architect Study. Glenn explained that earlier this year, the city purchased a building on Highway 56 formerly used as the Wooden Spoke Restaurant for the purposes of converting that building into a new police station. The city must comply with its own building codes when constructing or refurbishing existing buildings. Included in this council meeting packet was letter from Mr. Don Whipple, a retired structural engineer who lives in Baldwin City. In his letter, Mr. Whipple outlines the reasons for hiring a team of architects and engineers to manage the construction of this project. Glenn said we received two bids for architectural and engineering services for the new police building. Staff recommends that the council approve the proposal submitted by Jay Zimmerschied Architecture. A.J. Stevens moved and Susan Pitts seconded to accept the RFP submitted by Zimmerschied Architecture in the amount of $69,480.00. Motion carried with a vote of 5 yes and 0 no. F. New Business: 1. Funding options for Chamber of Commerce Mayor Simoneau asked for this item to be placed on the agenda to discuss ideas for funding. The Mayor suggested adding 1 mil to add funding to the Chamber of Commerce. Mayor Simoneau also said this would need to have Council action tonight in order to be on the November ballot. Brad added you are not required to have an election. Council ensued discussion. Mayor Simoneau asked for public comments. Brad Scraper, 814 Baker Street asked if it is typical for citizens to support the Chamber financially through a mil levy. Jake Wright, 1212 Fremont said he was confused what is being suggested. Jake said as treasurer, he would like to understand what is on the table. Council continued discussion regarding the budget and how the funds are distributed. Lynn Murray, President of Baker University stated we need to support our local Chamber and continue the conversation and not rush a vote. George McCreary, 916 Baker also understands the difficult task with a budget, however knows there are funds available and encourages council to have vision. Phillip Hannon, 1305 10 th Street, President of the Chamber of Commerce Board. People will not want to raise taxes, and believes this option is smoke and mirrors. Mayor Simoneau asked if there was any intent to back down on the City s portion in the earlier discussions. Council ensued discussion.
Jeannette Blackmar spoke to the 2014 agreement and encouraged the council to discuss with Paul Dorathy as he was the President at the time the agreement was made. Jake Wright said he has not seen the actual executed signed agreement. Reality is, is the $3100.00 something the Chamber can overcome? The bigger concern is the intention of the council is this a one-time cut? Ken Donohue, 817 Dearborn would like to offer a possible solution. If there was something on the ballot, could the word cut be eliminated, could the City designate 1 mil towards the Chamber. Brian Cramer spoke about the entrepreneurship program and how it has grown. That program in itself is worth $3100.00 and said he is in favor to continue to funding Chamber of Commerce. 2. 2019 Budget publication. Brad Smith explained the publication process. A.J. Stevens moved and Susan Pitts seconded to approve the publication of the 2019 Budget Hearing Summary. Motion carried with a vote of 5 yes and 0 no. 3. BCRC appointment- Tony Brown moved and Brian Cramer seconded to appoint Ginny Honomichl to a 4-year term on the Baldwin City Recreation Commission. Motion carried with a vote of 5 yes and 0 no. 4. Mowing bids - The City has received two bids for mowing services. The purpose of the bid request is to provide necessary staff and equipment to mow high grass on private property after proper notice and time to abate the violation is expired. City staff recommended the approval of the lowest bid, Ahern Lawnscaping, LLC. Susan Pitts moved and A.J. Stevens seconded to accept the mowing bid from Ahern Lawnscaping, LLC in the amounts specified in the bid. Motion carried with a vote of 5 yes and 0 no. 5. Outdoor Concert Tony Brown asked for a clarification of the application. Council had a short discussion. Tony Brown moved and A.J. Stevens seconded to approve special event- Outdoor Concert, pending complete paperwork. Motion carried with a vote of 5 yes and 0 no. 6. Resolution - Outdoor Concert City Clerk, Laura Hartman explained that special events that are using sidewalks or have street closures or alcohol such as this Outdoor Concert require Resolutions that address those specific ordinance waivers for the event. Susan Pitts moved and A.J. Stevens seconded to approve Resolutions 2018-10 and 2018-11. Motion carried with a vote of 5 yes and 0 no. G. Committee Reports:

RESOLUTION NO. XXXX-XX A RESOLUTION OF THE GOVERNING BODY OF THE CITY OF BALDWIN CITY KANSAS TO CREATE A ONE-WAY STREET AROUND BALDWIN JUNIOR HIGH AND BALDWIN HIGH SCHOOL DURING PICK UP TIMES DURING THE SCHOOL YEAR. WHEREAS, Section 14-201 of the Code of the City of Baldwin City authorizes the Governing Body, by resolution, to establish and fix the location of such traffic control devices as may be deemed necessary to guide and warn traffic under the provisions of this chapter, other traffic ordinances and the state laws.; and WHEREAS, the City of Baldwin City, Kansas shall mark and label on a map of the City of Baldwin City for the purpose of displaying all such traffic control devices and shall be filed with the city clerk to be open to inspection and available to the public at all reasonable hours of business.; and WHEREAS, due to traffic congestion around Baldwin Junior High and Baldwin High School between 3:00 pm and 4:00 pm, there is a need for a one-way street to help the flow of traffic; and WHEREAS, after reviewing Exhibit A, the Governing Body believes the proposed traffic control device is necessary and reasonable; NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Baldwin City, Kansas, that effective August 16, 2018, beginning at the intersection of Eisenhower Street and Quayle Street, a one-way Street shall be in effect on Eisenhower Street and continue north to N 375 Road with traffic flowing north.
