The legislation addresses the critical financial needs of the government and the community, as we continue restoration efforts in the wake of Super Typhoon Pongsona. This bill is the first legislation transmitted by I Mina 'Bente Siete Na Liheslaturan Guahan to the Camacho-Moylan Administration. I thank the members of the Legislature for taking swift action in passing this measure. I am confident that with its enactment we will begin a new chapter of cooperation and communication between the Executive and Legislative branches and restore the faith of the community in its government and its elected leaders. Sanford Ray Tenorio AN ACT TO AMEND P.L. 26-155 and P.L. 26-156, RELATIVE TO INCREASING THE EMERGENCY AUTHORIZATION FOR SUPER TYPHOON PONGSONA RESTORATION EFFORTS, AND TO INCLUDE FUNDING FOR THE MAYORS COUNCIL OF GUAM. BE IT ENACTED BY THE PEOPLE OF GUAM: 1 Section 1. Super Typhoon Pongsona Emergency Authorization. 2 Section 2 of Public Law No. 26-155 is hereby amended to read as follows: 1

1 "Section 2. I Maga'lahen Gunhanlis authorized to utilize any 2 part or portion, not to exceed Nine Million Dollars ($9,000,000.00), of 3 the General Fund of the Government of Guam, for expenses for civil 4 defense, public safety, education or health emergencies resulting 5 from Super Typhoon Pongsona. The appropriation contained herein 6 shall be used for typhoon-related non-regular expenditures incurred 7 after December 06, 2002." 8 Section 2. Special Fund Transfer. Section 3 of Public Law 26-155 is 9 hereby amended to read as follows: 10 "Section 3. 1 Maga ilahen Gudhan is hereby authorized to 11 transfer any cash available in any special fund, except the Tourist 12 Attraction Fund, of the Executive Branch to the General Fund to fund 13 the appropriation authorized in Section 2 of this Act". 14 Section 3. Reversion. Section 5 of Public Law No. 26-155 is hereby 15 amended to read as follows: 16 "Section 5. Any appropriation authorized under this Act which 17 has not been encumbered or expended within ninety (90) days of 18 enactment of this Act shall revert back to the General Fund." 19 Section 4. Reporting Requirement. Section 6 of Public Law No. 26-20 155 is hereby amended to read as follows: 21 "Section 6. I Maga ilahen Guithan shall prepare a detailed report 22 on all transfers, expenditures and reimbursements by all and any 23 agency or department, and the Mayor's Council, directly related to 24 Super Typhoon Pongsona or the funds appropriated herein. All 25 reports required herein shall be submitted to the Speaker of I Mina 2

1 Bente Siete Na Lihe5laturan Guihan and the Public Auditor within five 2 (5) days of transfer, expenditure or reimbursement. A closeout 3 report of the expenditures of the funds appropriated herein shall be 4 filed within ninety (90) days of the enactment of this Act." 5 Section 5. Reimbursement. Section 8 of Public Law No. 26-155 is hereby 6 amended to read: 7 "Section 8. Reimbursement of any funds expended under this 8 Act from federal sources, including the Federal Emergency 9 Management Authority (FEMA), and other sources, including 10 insurance policies, shall be reimbursed to the source from which the 11 funds originated, to the extent that Federal laws permit. 12 The Director of the Department of Administration shall maintain 13 detailed accounting records pertaining to the expenditures under this 14 Act. 15 Within thirty (30) days from the receipt of the initial reimbursement 16 from FEMA, and thirty (30) days after each subsequent 17 reimbursement from FEMA, the Director of Administration shall 18 submit a detailed report of such expenditures and reimbursements 19 authorized under this Act to the Speaker of 1 Liheslaturan Guilhan." 20 Section 6. Contractual Terms. Section 10 of Public Law No. 26-155 21 is hereby amended to read as follows: 22 "Section 10. Contracts entered into pursuant to this Act shall 23 not exceed a term of sixty (60) days." 24 Section 7. Allocation to the Mayors Council of Guam. The sum of 25 Three Hundred Thousand Dollars ($300,000.00) from the authorization 3

1 contained in Section 2 of Public Law 26-185 shall be allocated to the 2 Mayors Council of Guam for Super Typhoon Pongsona related non-regular 3 expenses incurred after December 06, 2002. 4 The funds provided herein shall be distributed in the following 5 manner for typhoon-related expenses: 6 a.) Temporary office space for the Executive office of the Mayors 7 Council, Rental Amount not to exceed: $32,000.00 8 (February-September, 2003) 9 b.) 19 Villages Minimum Allotment per village: $10,000.00 10 c.) Mayors' Council of Guam $78,000.00 11 (The appropriation shall be further divided by the Mayors 12 Council of Guam in accordance with the restoration needs of the island 13 community.) 14 The Mayors Council of Guam shall provide I Liheslaturan Gudhan and 15 the Public Auditor a written report of the expenditure of such funds no 16 later than thirty (30) days upon the enactment of this Act, and every fifteen 17 (15) days thereafter until such time as the aforementioned funds have been 18 fully expended. 19 The Mayors Council of Guam shall immediately record and 20 coordinate its typhoon-related expenditures with the Federal Emergency 21 Management Agency, or other pertinent federal or local agency, for 22 possible reimbursement of said funds. Any reimbursement of the 23 appropriated funds herein shall immediately be deposited into the General 24 Fund. A written report of any reimbursement of such funds shall be 4

1 prepared and transmitted to I Liheslaturan Gudhan no later than fifteen (15) 2 days upon such reimbursement. 3 Section 8. Deadline For Expedited Procurement By GWA. Section 4 12 of Public Law 26-155 is hereby amended to read as follows: 5 "Section 12. Expedited Procurement Authorized. For 6 sixty (60) days from the enactment of this measure, and 7 notwithstanding the Guam Procurement Law, the Guam 8 Waterworks Authority is hereby authorized to purchase 9 necessary materials and items as funded for in Section 11(b) of 10 this Act; provided that the Guam Waterworks Authority must 11 solicit at least three (3) informal price quotations, and must 12 award the procurement to the firm with the best offer, as 13 determined by evaluating cost and delivery time and provide 14 the underlying documents to I Liheslaturan Gudhan and the 15 Public Auditor within thirty (30) days". 16 Section 9, Deadline For Expedited Procurement By GPA. Section 5 17 of Public 26-156 is hereby amended to read as follows: 18 "Section 5. Expedited Procurement Authorized. For 19 sixty (60) days from the enactment of this measure and 20 notwithstanding the Guam Procurement Law, the Guam Power 21 Authority is hereby authorized to purchase materials and items 22 necessary in response to the destruction caused by Super 23 Typhoon Pongsona to Guam's power system; provided, that 24 the Guam Power Authority must solicit at least three (3) 25 informal price quotations, and must award the procurement to 5

1 the firm with the best offer, as dkermined by evaluating cost 2 and delivery time, and provide the underlying documents to I 3 Liheslaturan Gueihan and the Public Auditor within thirty (30) 4 days". 5 Section 10. Expedited Procurement Authorized for GTA. For thirty 6 (30) days from the enactment of this measure and notwithstanding the 7 Guam Procurement Law, the Guam Telephone Authority is hereby 8 authorized to purchase materials and items necessary in response to the 9 destruction caused by Super Typhoon Pongsona to Guam's telephone 10 system; provided that the Guam Telephone Authority must solicit at least 11 three (3) informal price quotations, and must award the procurement to the 12 firm with the best offer, as determined by evaluating cost and delivery 13 time and provide the underlying documents to I Liheslaturan Guc7han and 14 the Public Auditor within thirty (30) days. 15 Section 11. Severability. If any provision of this Law or its 16 application to any person or circumstances is found to be invalid or 17 contrary to law, such invalidity shall not affect other provisions or 18 applications of this Law which can be given effect without the invalid 19 provisions or application, and to this end the provisions of this Law are 20 severable. 6

I. OVERVIEW The Committee on Appropriation and Budgeting, General Governmental Operations, Reorganization and Reform held an emergency public hearing at 10:00 a.m. on January 14, 2003 in the Public Hearing Room, I Liheslaturan Guahan. Public notice was provided to the media on Monday, January 13, 2003. Senators present at the public hearing were: Vice-Speaker Frank Bias Aguon, Jr., Chairman Senator Toni Sanford, Vice Chairman Senator Lou Leon Guerrero, Member Senator Tina-Muna Barnes, Member Senator John Quinata, Member Senator Mark Forbes, Member Senator Lawrence Kasperbauer, Member Speaker Ben Pangelinan Senator Randall Cunliffe Senator Carmen Fernandez Senator Robert Klitzkie Senator Jesse Lujan Senator Roy Respicio Senator Ray Tenorio II. SUMMARY OF TESTIMONY Individuals appearing before the Committee to present oral and written testimony on the bill are as follows: Paul Leon Guerrero, Acting Director, Bureau of Budget & Management Resource Mayor Robert Lizama, President, Mayor's Council of Guam John F. Bias, Executive Director, Mayor's Council of Guam Mayor Tony Quinata, Umatac Mr. Paul Leon Guerrero testified in favor of the bill with three revisions: (1) Delete the reversion dates in P.L. 26-155, or extend the deadline to 90-120 days; (2) Extend the deadline for contracts in Section 10 of P.L. 26-155 to 90 days; (3) $600,000 appropriation for the current DOA computer system, BACIS. Vice Chairperson Toni Sanford requested that the language on the $9 million appropriation be more definitive to indicate that the appropriation is an increase of $6 million to the initial $3 million appropriation in P.L. 26-155, for a total of $9 million.

Senator Rory Respicio recommended that the provisions in Bill 13 continue to be included in Bill 8. Senator Kasperbauer recommended that Section 4 be amended to include "education" along with civil defense, public safety and health emergencies. Senator Jesse Lujan recommended that a provision be included in the bill to require a detailed expenditure report on the Section 4 appropriation within 180 days to the Public Auditor. Mr. Robert Lizama, President of the Mayor's Council, expressed his support of Bill 8 and requested the following additions: (1) an appropriation for office rental for the Mayor's Council due to the condemnation of their current office, for which they had not been paying rent; and (2) an appropriation in the amount of $350,000 to $400,000 for overtime pay for mayoral employees relative to Typhoon Pongsona recovery. M. FINDINGS AND RECOMMENDATION The Committee on Appropriation and Budgeting, General Governmental Operations, Reorganization and Reform finds that Bill No. 8, as amended, is a necessary measure for the expeditious recovery from Typhoon Pongsona. BE IT ENACTED BY THE PEOPLE OF GUAM: Section 1. Super Typhoon Pongsona Emergency Authorization. Section 2 of Public Law No. 26-155 is hereby amended to read as follows: "Notwithstanding any other provision of law or this Act, I Maga' Lahen Guahan is hereby authorized to utilize any part or portion, not to exceed Three L!!!!!!! Nine Million Dollars ($9,000,000.00), of the General Fund of the Government of Guam, for expenses for civil defense, public safety, education or health emergencies resulting from Super Typhoon Pongsona. The appropriation contained herein shall be used for typhoon-related non-regular 9 expenditures incurred after December 06, 2002."

Reversion. 2 Any appropriation authorized under this Act which has not been 3 encumbered or expended within sixty (60) ninety (90) days of enactment of this 4 Act shall revert back to the General Fund. 5 Section 3. Reporting Requirement. 6 I Maga'lahen Guahan shall prepare a detailed report on all transfers, 7 expenditures and reimbursements by all and any agency or department, and the 8 Mayor's Council, directly related to Super Typhoon Pongsona or the funds 9 appropriated herein. All reports required herein shall be submitted to the Speaker 10 of I Mina Bente Siete Na Liheslaturan Guahan within five (5) days of transfer, 11 expenditure or reimbursement. A closeout report of the expenditures of the funds 12 appropriated herein shall be filed within si-x-ty-4-60) ninety (90) days of the 13 enactment of this Act. 14 Section 4. Reimbursement. is Reimbursement of any funds expended under this Act from federal sources, 16 including the Federal Emergency Management Authority (FEMA), and other 17 sources, including insurance policies, shall be reimbursed to the source from 18 which the funds originated, to the extent that Federal laws permit. 19 The Director of the Department of Military Affairs shall maintain detailed 20 accounting records pertaining to the expenditures under this Act. 21 Section 5. Contractual Terms. 22 Contracts entered into pursuant to this Act shall not exceed a term of thift=y 23 (D) sixty (60) days. 24 Section 6. Appropriation to the Department of Administration for BACIS 25 Contractual Services. 2

1 The sum of Six Hundred Thousand Dollars ($600,000.00) is hereby 2 appropriated from the General Fund to the Department of Administration for the 3 maintenance service agreement of the BACIS System. 4 Section 7. Appropriation to the Mayors Council of Guam for Restoration 5 and Recovery from Super Typhoon Pongsona. 6 The sum of Three Hundred Thousand Dollars ($300,000.00) is hereby 7 appropriated from the General Fund to the Mayors Council of Guam for Super 8 Typhoon Pongsona related expenses. The appropriation contained herein shall be 9 utilized for typhoon-related non-regular expenditures incurred after December 06, 10 2002. 11 The funds provided herein shall be distributed in the following manner for 12 typhoon-related expenses: 13 a.) Temporary Office Space: $32,000.00 14 (February-September, 2003) 15 b.) 19 Villages Minimum Allotment: $10,000.00 16 c.) Mayors' Council Main Office $10,000.00 17 d.) Village Population Allotment: $68,000.00 18 (Breakdown shall be divided equitably based on the year 2000 19 Guam population census.) 20 The Mayors Council of Guam shall provide I Liheslaturan a written report 21 of the expenditure of such funds no later than thirty (30) days upon the enactment 22 of this Act, and every fifteen (15) days thereafter until such time the 23 aforementioned funds have been fully expended. 24 The Mayors Council of Guam shall immediately record and coordinate its 25 typhoon-related expenditures with the Federal Emergency Management Agency, 26 or other pertinent federal or local agency, for possible reimbursement of said 3

1 funds. Any reimbursement of the appropriated funds herein shall immediately be 2 deposited into the General Fund. A written report of any reimbursement of such 3 funds shall be prepared and transmitted to I Liheslaturan Guahan no later than 4 fifteen (15) days upon such reimbursement. 5 Section 8. Severability. 6 If any provision of this Law or its application to any person or 7 circumstances is found to be invalid or contrary to law, such invalidity shall not 8 affect other provisions or applications of this Law which can be given effect 9 without the invalid provisions or application, and to this end the provisions of this 10 Law are severable. 4

Bill 008 (COB) The Bill proposes to increase the authorization to utilize $9,000,000 from existing General Fund appropriations for Typhoon Pongsona recovery efforts. It should be noted that the current preliminary damage estimate for local match alone is approximately $37.3 million (at the current 75/25 federal to local ratio). Other provisions of the bill regarding Governor's transfer flexibility, part-time employees, and transfer of employees would provide tools to facilitate managing government operations with the limited and steadily declining resources available. The last provision of the Bill re-appropriates from prior appropriations to the Legislature and has no impact on current Fiscal Year 2003 appropriations.
