O: 2018-053 AN ORDINANCE IN ACCORDANCE WITH THE DEL RIO CITY CHARTER AND STATE LAW ORDERING AND ESTABLISHING A DATE FOR HOLDING AND CONDUCTING A SPECIAL RUN-OFF ELECTION IN AND THROUGHOUT THE CITY OF DEL RIO FOR THE PURPOSE OF ELECTING PERSONS TO HOLD THE OFFICE OF COUNCILPERSON-AT-LARGE PLACE C AND COUNCILPERSON- DISTRICT II; PROVIDING FOR OTHER NECESSARY ELECTION MATTERS WHEREAS, a General Election was duly called and conducted on May 05, 2018 for the purpose of electing persons to hold the offices of Mayor, Councilperson-at-Large Place C, Councilperson District I, and Councilperson District II; and WHEREAS, no person received a majority of votes cast in the races for Councilperson-at-Large Place C and Councilperson District II as is required by the City Charter and therefore a Special Election is necessary and required by the Charter; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DEL RIO, TEXAS THAT: Section 1. Order It is hereby ordered that a special run-off election shall be held in and throughout the corporate limits of the City of Del Rio, Texas on June 23, 2018, for the purpose of electing the following officers of Councilperson-at-Large Place C and Councilperson District II and the races are to appear on the ballot in that order. Section 2. Election Officers The maximum number of election clerks is hereby established as seven (7), and the maximum number of election clerks for the Early Voting Ballot Board is hereby established as six (6). Each Judge and clerk shall be compensated at the rate of $10.00 per hour. A judge who delivers the returns of the election and performs such other services as provided in Section 32.092 of the Texas Election Code shall also receive the sum of $50.00 Section 3. Early Voting a. Voting Period - Polling Places. The early voting period shall be commenced at 8:00 a.m. on June 11, 2018 and shall end at 7:00 p.m. on June 19, 2018. Early voting by personal appearance at the early polling place shall be conducted on weekdays of the early voting period and during the hours that the City Secretary s main business office is regularly open for business, that being 8:00 a.m. to 5:00 p.m. except for the final two (2) days of the early voting period. On the final two (2) days of early voting by personal appearance, the City Secretary s regular business hours are hereby designated as 7:00 a.m. To 7:00 p.m. to comply with the Election Code. The location of the main early

polling place shall be the Council Chamber, Municipal Building located at 109 West Broadway, Del Rio, Texas. Section 4. Notice of City Election and Order of Election The Mayor of the City of Del Rio, Texas is hereby authorized and directed to cause notice of the special run-off election ordered herein to be given in accordance with the requirements of Article III, Section 40 of the Del Rio City Charter and the Texas Election Code. The Notice of General Election shall be published in accordance with the provisions of the Texas Election Code. Further, the Mayor of the City of Del Rio is hereby authorized and directed to sign the Order of Election for Municipalities as prescribed by the Texas Election Code. Section 5. Direct Recording Electronic Voting Machines A direct recording electronic voting machine shall be used for voting at each of the foregoing election precincts as mandated by the Texas Election Code and the Help America Vote Act which requires that at least one voting system be equipped for individual with disabilities at each polling place so that individuals can vote independently and privately. Section 6. Election Supplies and Laws The Election Administrator as contracted by Resolution No: R:2018-005 is designated as the Early Voting Clerk is also hereby authorized and instructed to provide and furnish all necessary election supplies to conduct the aforesaid city election. The election herein shall be conducted in accordance with the Texas Election Code. Early Voting Clerk, Generosa Ramon, P.O. Box 1267, Del Rio, Texas 78841. Section 7.
