1 Introduction The Class Action Registry gives citizens access to all class actions instituted in Québec after January 1, 2009. It contains several types of proceedings, as well as notices of publication and claims fms. Class actions are entered in the Registry by lawyers (regular members of the Québec Bar) and employees at the Ministère de la Justice. This handbook is intended f use by lawyers; it has been designed to facilitate the entry and updating of documents and proceedings in the Registry. 2 Access to the Registry Access to the Registry is through the Courts of Québec website (Figure 1), at the address http://www.tribunaux.qc.ca/mjq_en/index.html. After navigating to the Registry, the home page is displayed (Figure 2). If you are unable to launch the application, refer to Appendix 2 - Wkstation configuration. 2.1 Consult the Registry The consultation page (Figure 3) is designed f use by the general public. It contains entries f all the class actions in the Registry, along with related documents and proceedings. All the class actions entered in the Registry are listed on the consultation page, in the der in which the motions f authization were filed. The criteria that can be used to locate a class action are the file number, the courthouse where the motion f authization was filed, the description of the group bringing the class action, the period during which the motion f authization was filed, the name of the case and the subject matter of the class action. By clicking the icon in the Details and documents column, it is possible to display additional infmation on the class action, including contact infmation f counsel, the stage reached by the class action, and the documents and proceedings available f the class action (Figure 4). It is also possible to download any document by clicking on its hyperlink. The documents are in PDF fmat. Figure 5 2.1.1 Search f a class action To find out if a class action has been instituted in connection with a specific problem, citizens and lawyers can use one of the search criteria displayed at the top of the page Consult the Class Action Registry. The target infmation can be entered in the search box above the list of results. If no case matches the search criteria, a message is displayed on screen. A search can be based on precise criteria, such as a file number, on a general key wd that will bring up all the class actions in which the wd is included. Two me search criteria can be combined. 2.2 Access f lawyers The section Access f lawyers is a secure section f which authentication from the Québec Bar is required. It can be used by lawyers to access the menu of reserved functions. This section is not accessible by the general public. P750U.E1 : Handbook f lawyers 9
3 Authentication of lawyers To be authenticated, lawyers must click on the hyperlink Access f lawyers on the home page; from there, they are redirected to the Québec Bar website f authentication (Figure 6). A window opens, asking them to enter their Québec Bar membership number and digital identification code. The membership number and digital identification code are printed on the Québec Bar membership card (Figure 7). Figure 6 Figure 7 Lawyers must enter the infmation in the two relevant fields and click on the button Validate and continue; their identity is then verified. If the membership number and digital identification code are valid, lawyers can then access the secure section of the Registry (Figure 10). displayed to infm them that the infmation entered is not valid (Figure 8), that they are not entitled to access the application (Figure 9). If this occurs, you should contact the Québec Bar to verify your code. Figure 8 Figure 9 It is imptant to note that connections to the Class Action Registry website are secure at all times, and that the digital identification number is not fwarded to the Ministère de la Justice. The authentication process takes place entirely within the secure Québec Bar website, and users are redirected to the Registry following authentication. The session closes when you exit the Web browser after 60 minutes of non-activity on the Registry site. P750U.E1 : Handbook f lawyers 11
4 Functions reserved f lawyers 4.1 Main menu Once authenticated, you are directed to the main menu f the section reserved f lawyers (Figure 10). You can then enter a class action in the Registry update an entry you have made previously. Me specifically, you can: - consult the public page; - enter a class action; - update, print and/ cancel the entry f a class action; - return to the home page. Figure 10 4.2 Consult the Registry By clicking Consult the Registry, you can access the public consultation page, and use it to search f a class action (see 2.1 Consult the Registry.) 4.3 Enter a class action To enter a class action, you must access the subsection Enter a class action from the main menu in the section reserved f lawyers. You must then complete the fm displayed (Figure 11). All the fields with an asterisk (*) are required fields and must be completed befe the entry is saved. specifying the nature of the field. The Help button, in the upper right-hand cner, can be used to display the help file giving me infmation on the current page. Figure 11 P750U.E1 : Handbook f lawyers 13
4.3.1 General infmation The first part of the fm (Figure 12) is used to enter general infmation: the file number, the courthouse where the motion f authization was filed, the name of the case, the description of the group bringing the class action, the date of filing of the motion f authization at the clerk s office, and the subject matter of the class action. Figure 12 Users should note the following: o File number: The file number must be in the fmat 000-00-000000-000. The file number must be a valid number assigned by the clerk of the courthouse where the motion f authization was filed. o Verify button: allows to know if the file number has already been entered in the Class Action Registry. It is not possible to enter a duplicate file number. However, it is possible to make the update of an existing file. o Courthouse: the courthouse is automatically displayed after the file number is entered. o Name of class action: it is preferable to use the data entry screen that pops up after the icon is clicked, in der to enter the complete infmation. o Description of the group brining the class action: it is preferable to use the data entry screen that pops up after the icon is clicked, in der to enter a complete description of the group. o Subject matter of the class action: you may select me than one box if they all apply to the class action. The system validates the infmation entered. 4.3.2 Add a PDF document Documents and proceedings can be added in the part of the fm called Documents and proceedings by clicking the button Add (Figure 13). Figure 13 A dialogue box will be displayed to select the type of file (Figure 14). All the fields in this window are required: o Date of document: this is the date entered on the document; f example, in the case of a judgment, this is the date on which it was rendered, indicated at the end of the judgment. o Description of document: a pull-down menu lists the types of documents and proceedings that may be entered; the crect type must be selected. o File: if Browse is clicked, Windows will display a window f the selection of the file to be attached. At least one document must be included when entering a new class action. Only documents in PDF fmat are accepted. The file size may not exceed 8MB. After you click Save, a progress bar confirms that the file is being uploaded (Figure 15). If the document size exceeds the maximum permitted, you will receive a message stating that the upload has failed. In other cases, once the upload is complete, you will be redirected to the fm used to enter a class action, which will now display the name of the added document. Note: See the Appendix f a list of documents that must be entered in the Registry. 4.3.3 Add contact infmation f counsel f the applicant Contact infmation f counsel f the applicant can be added by clicking the button Add in the part of the fm Counsel f the applicant (Figure 16); a new window will open (Figure 17). If you click Close, the window will close without the infmation being saved, and you will be redirected to the fm used to enter a class action. 4.3.4 Add contact infmation f counsel f the defendant Contact infmation f counsel f the defendant can be added by clicking the button Add in the part of the fm Counsel f the defendant (Figure 18); a new window will open (Figure 19). 4.3.5 Save entry Once the fm used to enter a class action has been completed, click the button Save. The system verifies various elements of the entry. If the entry is incomplete (f example, if a required field has not been filled), if the infmation has been entered in the wrong fmat, the system displays an err message and asks the user to crect the entry. If the entry is saved successfully, a confirmation page is displayed (Figure 20). Figure 20 4.3.6 Validation of Registry content When a new class action is entered in the system, the Registry codinat verifies the data entered. This can take several days, and during this time the class action is not available on the public consultation page If the validation confirms that the infmation entered matches the motion filed in the clerk s office, the Registry codinat makes the class action available on the public consultation page. F missing invalid data, the Registry codinat contacts the lawyer who entered the class action, by E-mail, to indicate that the entry must be crected and revalidated. The user must crect the erroneous data using by updating the entry (see 4.4 Update an entry). 4.3.7 Publication of the entry f a class action Only entries f class actions validated by the Registry codinat are displayed on the public consultation page. An entry that has not appeared is still being validated by the Registry codinat. 4.3.8 Transfer of the entry to the Canadian Bar Association All class actions instituted in Québec must be entered in the Class Action Registry. It is no longer necessary to enter the class action on the Canadian Bar Association website f publication in the national database. As soon as an entry has been validated by the Codinat f Québec s Class Action Registry, the Codinat sends the Canadian Bar Association an E-mail containing infmation on the entry and the related documents. All class actions entered in Québec s Class Action Registry are automatically added to the national database. 4.4 Update an entry 4.4.1 Locate an entry (f updating) To update an existing entry f a class action, whether to crect infmation add new documents proceedings, use the subsection Update an entry, accessible via the main menu in the section reserved f lawyers (Figure 21). Figure 22 The search is based on the file number. Therefe, the user only has to enter the number of the file he wishes to update and click on Search to display the content of the entry. When the infmation concerning the class action is displayed, the Search button will then change to indicate New Search, allowing to enter the number of another file the user wishes to find (Figure 23). Figure 23 When updating an entry, you can modify all the fields containing infmation, and change the documents and proceedings appended to the entry. The Registry codinat validates the update befe it is made available. The rules and processes that apply to the entry of a class action also apply to the update. It is imptant to note that the Registry codinat is aware of the igin of each update (i.e. the name and profile of the user). In addition, all entries and updates made in the register are logged by the system, and a daily log may be produced by the system administrat Registry codinat. P750U.E1 : Handbook f lawyers 22

An entry may be cancelled only if it has not yet been made available on the public consultation page. An entry that has already been made available in the Registry cannot be cancelled (Figure 28). Figure 28 An entry may only be cancelled by the lawyer who made it. It is not possible to cancel an entry made by another lawyer; if this is attempted, the following message will be displayed (Figure 29). 4.5 Return to the home page Figure 29 The last option on the menu in the section reserved f lawyers is Return to the home page (Figure 30). Use this option to return to the home page without closing the current session, in der to perfm other operations without going through the authentication process again. If you want to enter crect an entry after closing a session, you will have to go through the authentication process again. 5 Technical aspects 5.1 Fmat of proceedings Documents and proceedings added to an entry must be in PDF fmat. To open PDF documents contained in the Registry, Acrobat Reader software must be installed on your wkstation. To convert a document (f example, to convert a Wd file into PDF fmat), you must use commercially available conversion software, such as PDF Creat, available free of charge. The size of PDF files uploaded to the Registry must not exceed 8MB. P750U.E1 : Handbook f lawyers 27
5.2 Technical requirements To ensure smooth system operation, your must use Internet Expler 6.0 later software. The system is not optimized f use with Mozilla Firefox and other browsers, which may cause some functions to operate increctly. If you try to access a secure page (reserved f lawyers) using Mozilla Firefox, you will be refused access to the Registry. 6 Access to the Registry The Class Action Registry is accessible at all times f public consultation. However, the authentication module is not accessible between midnight and 4 a.m., and so lawyers cannot access the reserved section to make update an entry at this time. 7 Security of data entered in the Registry 7.1 Validation of Registry content Every entry made in the Registry by a lawyer is validated by the Registry codinat befe being made available f consultation on the public consultation page. 7.2 Transaction logging All entries in changes to the Registry can be traced, along with the name and profile of the user concerned. 7.3 Legal value of documents filed The Registry does not constitute the civil court ledger f class actions befe the courts. 8 On-line help and user suppt 8.1 On-line help file In all the pages, tooltips explain the meaning of each field. In addition, an on-line help file is available f most pages (Figure 31). The proceedings entered by counsel f the applicant are the following: - Motion f authization; - Motion to institute proceedings - Notice of the change of the counsel f the applicant. Counsel f the defendant does not add proceedings to the Registry. This task will be perfmed by court employees when proceedings are filed at the clerk s office (see the Appendix f me details). 10 Appendix 2 (Wkstation configuration) Appendix 2 contains various screen panamas that can be used to configure the wkstation of outside users (lawyers, citizens) to access the application, and in particular the section reserved f lawyers. Problem accessing the Registry (section reserved f lawyers) If, after clicking the link to go to the page reserved f lawyers, you receive the message in Figure 32, you should click twice on the button Yes to go to the authentication process of the Québec Bar. Problem displaying secondary windows Access to certain pop-up windows may be blocked by your browser (f example, the viewer may not be displayed when you wish to print an entry).
