WHEREAS, the Board of County Commissioners of Reno County, Kansas (the "County"), acting as governing body of Blue Spruce Combined Sewer District (the District ) has heretofore authorized certain sewer improvements (the "Improvements") to be constructed pursuant to K.S.A. 19-27a01 et seq. and Charter Resolution No. XXVII (the Act ); and WHEREAS, the Board of County Commissioners desires to levy assessments on certain property benefited by the construction of the Improvements, and is required by the Act to call and hold a public hearing to consider such special assessments, and to publish a proposed assessment resolution once in a newspaper of general circulation within the County at least 10 days prior to the date of the public hearing thereon, which resolution shall state the cost of the Improvements, the proposed method of assessment, the date, time and place of the public hearing to consider the proposed special assessments and that written or oral objections will be considered at the hearing; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF RENO COUNTY, KANSAS: Section 1. Required Information and Notice. The Board of County Commissioners will meet for the purpose of holding a public hearing, as provided by K.S.A. 19-27a01 et seq. and Charter Resolution No. XXVII, at 206 West First Street, Hutchinson, Kansas 67501 in the County, on August 1, 2017 at 9:00 a.m., or as soon thereafter as may be heard. Said public hearing is for the purpose of hearing any and all oral or written objections to proposed assessments in connection with the following described improvements, authorized by Resolution No. 2015-26, as amended by Resolution No. 2017-22: That there be constructed improvements to modify the existing locations of irrigation from the wastewater lagoon facilities, replace influent lift station and upgrade erosion protections, to serve the District, all in accordance with plans and specifications therefor that have been submitted to and approved by the Kansas secretary of health and environment. Block A, Lots 1-12; Block B, Lots 1-16; Block C, Lots 1-17; Block D, Lots 1-15; Block E, Lots 1-15; and Block F, Lots 1-8, all in Blue Spruce I Subdivision, Reno County, Kansas. Block G, upon which are sewer lagoons, is excluded from this listing of properties to be assessed. Block 1, Lots 5-14, all in Blue Spruce II Subdivision, Reno County, Kansas. Block 1, Lots 1-8; Block 2, Lots 1-8; Block 3, Lots 1-8; Block 4, Lots 1-8; Block 5, Lots 1-11; Block 6, Lots 1-6; and Block 7, Lots 1-8, all in Blue Spruce III Subdivision, Reno County, Kansas. The total costs of the Improvements are $568,850.88. Improvement costs shall be assessed equally parcel, among 138 parcels identified in the District. 100% of the cost of the Improvements shall be assessed against the property in the District, described above. Section 2. Levy of Assessments. After holding the hearing described in Section 1 of this Resolution, and for the purpose of paying the costs of the Improvements described in Section 1, there are hereby levied and assessed the amounts (with such clerical or administrative amendments thereto as may be approved by the County Counselor) against the property described on Exhibit A attached hereto. Section 3. Payment of Assessments. The amounts so levied and assessed in Section 2 of this Resolution shall be due and payable from and after the date of publication of this Resolution. Such amounts may be paid in whole or in part within thirty (30) days from the date of adoption of this Resolution. Section 4. Notification. The Clerk shall notify the owners of the properties described in Exhibit A attached hereto insofar as known to said Clerk, of the amounts of their respective assessments; and, said notice shall further state that unless such assessments are paid within thirty (30) days from the date of adoption of this Resolution, bonds will be issued therefor, and the amount of such assessment will be collected in installments with interest. Section 5. Certification. Any amount of special assessments not paid within the time prescribed in Section 2 hereof shall be certified by the Clerk in the same manner and at the same time as other taxes are certified and will be collected in 20 annual installments, together with interest on such amounts at a rate not exceeding the maximum rate therefor as prescribed by the Act. Interest on the assessed amount remaining unpaid between the effective date of this Resolution and the date the first installment is payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued to finance the Improvements, shall be added to the first installment. The interest for one year on all unpaid installments shall be added to each subsequent installment until paid. Section 6. Effective Date. This Resolution shall take effect and be in force from and after its adoption and publication once in the official County newspaper.
