1. ITEMS UNDER TENDER PROCESS FOR PURCHASE TERMS & CONDITIONS FOR SUBMITTING TENDER Approximately 300 numbers of Setter cum Hatchers (Poultry Mini Hatching Unit) as per the technical specifications provided in Annexure- A to this document, are to be purchased by the Department of Animal Husbandry. The actual number of units to be purchased is likely to vary as per the requirement of the department. 2. ELIGIBILITY FOR PARTICIPATION IN TENDER PROCESS a) The Manufacturers with valid manufacturing license/certificate of Registration, issued by competent authority for item listed in Annexure- A OR the Dealer/Distributors authorised by manufacturing company in course of their regular business having valid certificate, are eligible to submit the tenders. b) It must be noted that the tenderer should not have been black-listed by any Government Agency/Institutions of local self Government/Public Sector in India under any contractual relation with them or pending legal/penal action for complaints of quality. The undersigned reserves the right for insisting upon submission of Good Performance Certificate issued by any such agency. c) The registration certificate of manufacturing company must indicate that production of the item shown in Annexure- A is commenced. Only provisional Registration of the item without commencement of production is not sufficient. d) The bidder company should clearly state whether the firm is registered with NSIC/SSI Unit. e) In case the tenderer is submitting tender as Dealer/Distributor of any manufacturing company, he must have valid certificate of appointment as Dealer/ Distributor issued by the manufacturing company. g) Non-compliance with the above conditions will render the tender ineligible for further processing and the Commercial bid in such case will not be opened. 3. HOW TO GET A TENDER FORM Tender Form along with Terms & Conditions can be downloaded from e-tendering Portal http://adf.maharashtra.etenders.in of the Dept.of Animal Husbandry w.e.f. 06/07/2011 at 17.01 hrs to 27/07/2011 at 17.45 hrs by payment of Rs. 5,000/- (Rs. Five thousand only) as the cost of tender form in the form of Demand Draft drawn on any Nationalised Bank. The demand draft shall be drawn in favour of "Accounts Officer to the Commissioner, Animal Husbandry, Maharashtra State, Pune-1 and shall be payable at Pune. The Demand Draft of Rs. 5000/- (Rs. Five Thousands only) must be submitted physically to the office of Commissioner, Animal Husbandry, Maharashtra State, Pune-1 before 04/08/2011 upto 13.00 hours. Scanned copy of Demand Draft should be uploaded for online tender submission. The tender document can be downloaded from above mentioned website after entering the details of said demand draft. This amount is non refundable. 4. SUBMISSION OF SAMPLES Sample of setter cum hatcher unit to be supplied, must be submitted giving the required information in the prescribed proforma at Annexure-F of the tender form. Sample without Name of manufacturer or brand name in embossed/engraved form, will not be accepted. Bidders should obtain a receipt of submission of sample on the same sample submission proforma. The scanned copy of this receipt cum proforma (Annexure-F), must be submitted online in the Technical Envelope T1. All columns in the format must be filled in.

Sample should be submitted from 07/07/2011 to 26/07/2011 during 10.00 am to 5.00 pm on any working day at the Office of the Assistant Commissioner Central Hatchery, Old Mumbai-Pune road, Near Mariaai Gate Police Chauki, Khadaki, Pune -3 for inspection. The testing charges of Rs. 4,412/-(Rupees Four Thousand Four Hundred Twelve Only) per tender sample must be submitted in the form of demand draft in the name of The Director, College of the Engineering, Pune, IRG A/C and will be borne by the tenderer. The sample submitted without prescribed testing fee, will not be accepted. The scanned copy of this demand draft for testing charges, must be submitted online in the Technical Envelope T1 and the demand draft should be physically submitted to the office of the Assistant Commissioner, Central Hatchery along with the sample. The tender sample of the successful bidder will remain permanently in the custody of the purchasing officer, as Approved Sample. The tender samples of rejected tenderers will be returned back, after the completion of tender procedure. In the course of sample testing, the tender samples may get damaged. No claim for any such damage would be entertain by the purchasing /indenting officer. Samples should be affixed with a label showing:- a. Name and address of the firm. b. Tender Notice No. c. Sample serial number. 5. EARNEST MONEY DEPOSIT (EMD) 1. An Earnest Money Deposit of Rs.10,00,000/- (Rupees Ten lac only) should be paid in the form of Demand Draft drawn on any nationalized bank. Cheque or cash will not be accepted. The Demand Draft for EMD shall be physically submitted to the Commissioner, Animal Husbandry, Maharashtra State, Pune-1 before 04/08/2011 upto 13.00 hours. Scanned copy of Demand Draft should be uploaded for online tender submission. 2. The following categories of suppliers are exempted from payment of earnest money depositi. The firms located in Maharashtra & Registered with Director General of Supplies & Disposals, New Delhi. ii. Small Scale Industrial Units registered with Director of Industries, Maharashtra, iii. only for item manufactured by them. The SSI units registered with National Small Industries Corporation and Small Industries Service Institute of Govt. of India for their manufacturing items. iv. Government and Semi-Government Institutions of Maharashtra and undertakings of any State Government /Government of India. v. Suppliers registered with the Central Stores Purchasing Officer of the Directorate of Industries, Maharashtra, who have satisfactorily supplied the material for last five years. 3. In case of claim for exemption, the bidder must submit necessary documents / exemption certificate from appropriate authorities. 4. The EMD is liable to be forfeited, in case the rates quoted by the tenderer are approved but the party refuses to enter into the agreement for supply. 6. PREBID CONFERENCE A pre-bid conference will be held on 15/07/2001 at 16.00 hrs in the Conference Hall, Office of the Commissioner, Animal Husbandry, Central Building, Pune -1, to discuss in detail the concept, specifications, desired work output of setter cum hatcher and the modalities of its supply. Discussions would also be held on issues/queries raised by the attending parties.

MANNER OF SUBMISSION OF ONLINE TENDER FORMS Tenderers should prepare & submit tenders online on above mentioned department s e-tendering portal http://adf.maharashtra.etenders.in in two bid system. Accordingly, rates quoted for the items in ANNEXURE A, should be prepared & submitted online in prescribed form given in commercial envelope C1, duly encrypted with tenderer s digital signature certificate. All other required documents as mentioned below need to be uploaded in technical envelope T1 given in online e-tender. While completing e-tender Bid Preparation, tenderers have to generate HASH VALUE of the Technical and Commercial envelopes. It may be noted that while online opening of the etender, Technical Envelope T1 will be opened in the first stage. Commercial Envelopes C1 of only such tenderers will be opened online, who have fulfilled all requisites terms and conditions and whose samples have been approved by the designated authority. The tender not fulfilling any of the requisite terms and conditions, will be rejected and no further claim will be entertained. a. Technical Envelope T1 (Technical Bid):- The technical information in the form of following documents is mandatory. i. Manufacturing license for the manufacturer/certificate of appointment as Authorised Dealer/Distributor, issued by manufacturing company for the dealer/distributor. ii. Sales Tax Registration Certificate of the manufacturing/dealer/distributor Unit, with registration number/tin, valid on the date of filing the tender. In case the application for allotment of registration/tin is being pending with the concerned department, the attested xerox copy of the application accepted by the department has to be

attached. A valid certificate for exemption of Sales Tax must be enclosed wherever applicable. iii. Last years annual report and audited financial statement of bidding firm. iv. Demand Draft for purchase of tender form. v. Demand Draft for Earnest Money Deposit- (1) Demand Draft of Rs.10,00,000/-(Rupees Ten lac only) drawn on any Nationalized Bank in the Name of "Accounts Officer to the Commissioner Animal Husbandry, Maharashtra State, Pune-1" OR (2) Certificate of exemption for Earnest Money Deposit from the concerned authorities. vi. Tender sample submission proforma cum departmental receipt (Annexure F). vii. Demand Draft for tender sample testing charges. viii. Information brochure of the tender item. ix. Details of machinery/infrastructure available for production/supply of items. x. Details regarding experience of supply of such type of items in the past, if any. xi. Warranty details. xii. xiii. xiv. Declaration duly signed by the tenderer (Annexure-D). Check list duly signed (Annrxure-E). Letter of Assurance for supply of indented item as per specifications, within a period of 60 days / stipulated period All the above documents should be uploaded in Technical Envelope T1. These documents must be duly certified/attested by a Gazetted Officer or a Notary and the originals should be kept ready for submission on demand. Failure to enclose the certified/attested copies will make the tender form liable for rejection. b. Commercial Envelope C1 (Commercial Bid):- The rates should be quoted only in the online price tender. The rates not quoted in prescribed online tender form or quoted on separate paper will not be considered and the tender form will be rejected. The rates should be quoted as described in the tender document. The Commissioner, Animal Husbandry, Maharashtra State, Pune reserves the right to call for break up of rates quoted, if necessary. c. Technical Envelope T1 and Commercial Envelope C1 should be submitted online as per the stipulated procedure. The HASH VALUE of both envelopes must be generated online. No tenders will be accepted after stipulated date & time. Also no request for extension of time will be entertained. d. Tenders sent by Registered Post or by Speed Post / Courier will not be accepted. e. The firm making any undue effort to bring pressure from outside/departmental authority will be liable for outright rejection. 9.CHECK LIST The documents in the check list must be compulsorily uploaded online with e-tender form. Any omission in this regard, will make the tender liable for its rejection. Before preparation of the online tender, the tenderer is advised to check each item and score at the appropriate place as Yes or No in the checklist and mention the page number accordingly. 10. HOW TO QUOTE RATES a. Rates should be quoted for F.O.R. (Destination) as mentioned in Annexure B in the prescribed online tender form. The rates should be quoted inclusive of all Taxes applicable. Tax structure as per VAT / CST as applicable, must be followed. The department will not provide octori

exemption certificate. b. F.O.R Destination rates should be on the basis of supplies to be made at various IPD Blocks in Maharashtra State at taluka/district level as per Annexure B. c. Rates must be submitted only in Online Prescribed Tender form. d. Tenderers should mention make/model of the item/spare parts. The tenderer should also specify whether the spare parts are of genuine/imported/equivalent make/indigenous/isi/iso standard. They are required to give guarantee for exact fitness, satisfactory performance and premature ware of the parts, offered other than the genuine parts. e. Validity of Rates The rates quoted would be valid for a period of six months from the date of opening of commercial bid. Repeat order for the tendered items can be given by the purchaser within this period. the tenderer is bound to supply the items with the accepted rates. f. In case the decision of acceptance of rates remains pending beyond the period of validity of rates and the tenderer proposes the change in the rates quoted, subsequently the case will be inspected on merit. 11. PRICE VARIATION/ESCALATION a) Increase in rate on any account such as increase in input cost etc. will not be admissible in any case. b) The tenderer will not quote or offer less price than the approved price in relation with this tender and agreement to any agency/institute concerned with Government of Maharashtra or Government of India or supply the same item to any of its distributor/dealers/whole- sellers at a lower rate, (after applying all relevant discount structures) during the contract period including extension if granted, failing which the tenderer will have to accept the lesser price for all the orders concerned during the contract period. 12. ACCEPTANCE OF TENDERS a. The Commissioner, Animal Husbandry, M.S. Pune-1 reserves the right of accepting whole or any part of the tender or to refuse all tenders without assigning any reason. b. The Commissioner, Animal Husbandry, also reserves the right to call for break-up of the quoted rates if required. c. The Commissioner, Animal Husbandry does not pledge himself to accept the lowest tender and reserves the right of accepting the whole or any part of the tender or portion of the rate offered against any item and the tenderer shall supply the same at the rates quoted. 13. SIGNING OF AGREEMENT a. Successful tenderer/authorised representative as detailed under condition 13-c, shall enter into the Contract Agreement with the Competent authority i.e. The Commissioner, Animal Husbandry, M.S., Pune-1, preferably within 10 days of acceptance of tender or when called for by the commissioner in this regard. b. The successful tenderer will be required to execute an agreement on judicial stamp paper. c. Only the person authorised by due resolution in this contest is allowed to sign the agreement on behalf of the successful tenderer. Any other person will not be eligible to sign the agreement on behalf of the successful tenderer. d. The Earnest Money Deposit will be forfeited in case the tenderer fails to sign the agreement after acceptance of his tender. The tenderer is liable to be blacklisted in such case.

14. SECURITY DEPOSIT:- a. The successful tenderer will have to give a Security Deposit of 3% of total value of the order in the form of Bank Guarantee for 36 months or Term/Fixed Deposit Receipt pledged to the Commissioner A.H. and drawn on any nationalized bank valid for at least 36 months. b. The Government and Semi-Government Institutions of Maharashtra and undertakings of any State Government /Government of India will be exempted from paying the security deposit. c. The security deposit will be returned after 6 months of successful completion of warranty period of three years and proper functioning of the supplied material. The security deposit should therefore be valid for 36 months. Indemnity bond after the above period will be required to be given by the party agreeing and assuring that in case of any complaint of losses the same will be paid by the contractor to the Commissioner, Animal Husbandry, Maharashtra State, Pune. d. Security Deposit will stand forfeited, in case of any breach of terms and/or conditions of the tender and/or contract. 15. INDENTING PARTIES The Commissioner, Animal Husbandry, Maharashtra State, Pune-1 shall be the indenting officer for the item under the contract. 16. DEMAND AND SUPPLY SCHEDULE a. Successful tenderer will have to supply the goods as per order placed within 60 (sixty) days or the period given by the indenting officer after receipt of supply order. For failure within the above stipulated period, the tenderer is liable for a penalty of 0.5 % (Half percent) of the total price of the goods, per week or part thereof for late delivery of such goods till the date of its final supply/receipt. b. A repeat order within the validity period of the tender may be given, if required. c. The number of items to be purchased may change as per the discretion of the indenting department. d. The Contractor will have to necessarily supply the item of the same quality and make, as have been specified in his bid. 17. BILL RAISING, PAYMENT AND PROCEDURE THEREOF a. The supply of setter cum hatcher should be made F.O.R. destination at various IPD Blocks as detailed in Annexure B. The supplier should transport and install the setter cum hatchers at his own cost at the place of beneficiary farmers in the area of concerned IPD block. b. The supplier should provide detailed guidance and training to the beneficiaries/ groups about the functioning, operation and other technical information of the setter cum hatcher unit. c. The payment shall be released by the Indenting officer only after the receipt of certificate regarding a minimum of 70% hatchability of fertile eggs. The fertile eggs for this purpose, would be supplied by the concerned IPD Block. The hatchability would be ascertained by the following committee- 1)District Deputy Commissioner of A.H. Chairman 2) District Animal Husbandry Officer Member 3)Livestock Development Officer (Extention) Member 4) Livestock Development Officer of IPD Block Member Secretary

d. Payment shall be made by the indenting officer on production of bills raised by the contracting company. All payment shall be made in the name of contracting company only. e. As the payments are made from Government Treasury, the undersigned shall not be responsible for any delay in receipt of grants from Government or procedural delay due to treasury operations, which is beyond control of undersigned or the indenting officer. 18. TAX DEDUCTIONS FROM BILLS Income tax at appropriate rate will be deducted at source for the supply made. 19. QUALITY CONTROL a. The undersigned desires to inspect the material, manufacturing facility and stores, they should be offered for inspection to him or to his agent at the cost of supplier. b. All the setter cum hatcher units supplied shall be tested by the College of Engineering, Pune or any other institute approved by the undersigned and the cost of such inspection will be borne by the successful tenderer. 20. PENALTY CLAUSE In case, contracting party fails to deliver consignment thereof within the contract period of delivery or in case the goods are found not in accordance with the prescribed specifications and/or as per approved samples, the Commissioner, Animal Husbandry, Maharashtra State, Pune shall exercise his discretionary powers to take one or more of the following actions. Any loss, penalty imposed on supplier shall be deducted from the bills payable to him to the extent of bill amount and any other amount due to contractor under the same or any other contract with the undersigned or any of the indenting agency. a. To recover from the contractor as liquidated damages, a penalty of 0.5 % (Half percent) of the goods price, which the contractor/supplier has failed to deliver as aforesaid for each week or part of a week during which the delivery of such goods may be in arrears, and/or b. To purchase such goods from any other sources and at such price as the purchasing officer in his sole discretion feels fit and to recover the differences of cost if any from the tenderer. The additional amount of expenditure incurred over and above approved rates will be liable for recovery from the approved tenderer. The defaulting contractor will be penalised to the extent of differences in the rate of 100% of the value of the order. If the defaulting contractor fails to pay penalty, he will be permanently delisted from the list of approved contractors of departments of Maharashtra Government/Central Government and security deposits of the contractor will be forfeited. c. To forfeit the entire amount of security deposit of the contractor. d. To cancel the contract or part thereof with the supplier. e. To blacklist the supplier permanently from the list of departmental suppliers. 21. WARRANTY CLAUSE AND ITS OPERATION The Tenderer/Contractor/Supplier/Successful Bidder should declare that the goods/stores/ articles sold to the buyer under this contract, shall be of best quality and workmanship and shall be strictly in accordance with the specifications and particulars contained/mentioned in ANNEXURE-A. The supplier should give a onsite replacement warranty of three years for the setter cum hatcher unit including inverter and its batteries.

22. FORCE MAJEURE If, at any time during the continuance of this contract, the performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of any war, hostility, acts of the public enemy, civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restrictions, strikes, lock outs or acts of God (hereinafter referred to as events), provided notice of happening of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof, neither party shall by reason of such event, be entitled to terminate this contract nor shall either party have any claim for damages against the other, in respect of such non performance or delay in performance; and deliveries under the contact shall be resumed as soon as practicable, after such event has come to an end or ceased to exist, and the decision of the purchasing officer as to whether the deliveries have been so resumed or not shall be final and conclusive, provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days, either party may at its option terminate the contract, provided also that if the contract is terminated under this clause, the purchaser shall be at liberty to take over from the contractor at a price to be fixed by the purchasing officer, which shall be final and all the unused, undamaged and acceptable materials, bought out components and stores in course of manufacture in the possession of the contractor at the time of such termination or such portion thereof, as the purchaser may deem fit accepting such material, bought out components and stores as the contractor may with the concurrence of the purchaser elect to retain. 23. PERIOD OF VALIDITY OF CONTRACT The contract shall be valid for six months from the date of acceptance of tender. The department may give repeat order for the supply of material during this period, if required. 24. SETTLEMENT OF DISPUTES a. It will be the responsibility of the tenderer to prove beyond doubt his liability for any exemption from paying the Earnest Money Deposit and/or Security Deposit wherever applicable. The tenderer should produce relevant document/certificate from the competent authority in such case. b. All the disputes between indenting agencies and the supplier shall be settled by the undersigned. However, the disputes between the contractor and the undersigned or the appeal against the decision of undersigned in disputes referred to him, shall lie with the Secretary/Principal Secretary of the Department of Animal Husbandry, Government of Maharashtra. c. Judicial proceedings if any, will be under the jurisdiction of Pune Court. 25. REMOVAL OF DIFFICULTY a. The undersigned shall take such decision to remove difficulties due to ambiguity of provisions in the tender documents or due to provisions which are inconsistent with the objective of this tender. b. Annexure A Technical Specifications for Setter cum Hatcher (Poultry Mini Hatching Unit) Egg Capacity: Setter & Hatcher capacity of 400-410 eggs Egg Setting Trays: Capacity - 400-410 eggs, made up of heat resistant high density plastic (HIPS ) Hatching Tray: Heaters: Fan: Humidity Control: Temperature Control: Capacity - 400-410 eggs, made up of Poly propylene co-polymer (PPCP) Material for the purpose of easy handling and cleaning Vertical straight heaters of 200 watt capacity two in number fitted on back panel of machine. Heaters shall be manufactured out of high temperature resistance chrome nickel steel tube to withstand a surface temperature up to 600 o C. Each element shall be provided with two adjustable fixing brackets. Heaters shall be adjustable to maintain a temperature level of 98-100 degree Fahrenheit as per the requirement inside the incubator at all the times. This is to ensure that eggs get proper moisture in the air to get the suitable hatching condition and for appropriate embryonic growth development. Appropriate water tank should be attached as water source for humidity control. Maintaining proper temperature inside the incubator is very crucial and important to get high percentage of hatchability. 98 to 100 degree Fahrenheit temperature is maintained inside the incubator at all times for proper hatching of eggs. Temperature sensor shall be provided to measure the temperature. It should display & control the temperature automatically.

A suitably sized inverter and batteries shall be provided along with the incubator to provide backup power in case grid power is not available.
