MINUTES FROM A REGULAR MEETING OF THE COUNCIL OF MUSCLE SHOALS, ALABAMA, HELD June 1, 2009 The Council of Muscle Shoals, Alabama met at the City Hall in said City at 6:30 p.m. on st the 1 day of June 2009 being the regularly scheduled time and approved place for said meeting. The meeting was called to order by David Bradford, Mayor of the City. The invocation was given by Bill Howard. On roll call the following members were found to be present or absent, as indicated: PRESENT: ABSENT: JOE PAMPINTO, JERRY KNIGHT GRISSOM, NEAL WILLIS, ALLEN NOLES, DAVID H. BRADFORD JAMES HOLLAND Richard Williams, City Clerk, was present and kept the minutes of the meeting. David Bradford, Mayor of the City, presided at the meeting and declared that a quorum was present and that the meeting was convened and opened for the purposes of transaction of business. Upon motion duly made by Council Member Pampinto, seconded by Council Member Willis and unanimously adopted, the Council waived the reading of the minutes of the previously held regular meeting and work session of May 18, 2009 and approved the minutes as written. Mayor Bradford announced that the next item of business was a public hearing to consider the issuance of a Lounge Retail Liquor License - Class I (Package) to D. M. Kumar Inc. nd dba Shoals Package Store, 3695 E. 2 Street. Mayor Bradford noted that proper notice of the date, time and place of said hearing had been given and the matter was before the Council. Mayor Bradford stated that the Council would hear from those persons in support of the issuance of the license as well as those opposed. There being no one wishing to speak, Mayor Bradford stated that approval of the license application was before the Council. All those in favor of the application would indicate so by voting aye and those opposed would indicate by voting nay. Upon said question being put to a vote, a roll call was had and the vote recorded as follows: AYES: Council Member Pampinto, Council Member Willis, Council Member Grissom Council Member Noles, Mayor Bradford NAYS: None Mayor Bradford announced that the license had been approved.

Mayor Bradford announced that the next item of business was consideration of a resolution declaring certain property surplus and authorizing its disposal. Council Member Willis introduced the following resolution in writing in the meeting and moved for its adoption STATE OF ALABAMA COLBERT COUNTY RESOLUTION NUMBER 2400-09 WHEREAS, the City Council has been informed by the Procurement Agent that certain items of property as shown and described on Exhibit A attached hereto are no longer used in the performance of city business and are no longer required for use by the City; and WHEREAS, the City Council is informed that the said items of property have been replaced and are no longer in service in the performance of city business; and WHEREAS, the City Council has determined that the said items of property are surplus property and the City has no further use for said items of property due to their age and condition and it is not economical for the City to retool or refit the said items of property in order that they be able to be placed in service in the performance of city business; now THEREFORE, BE IT RESOLVED the City Council of the City of Muscle Shoals, Alabama does hereby determine that the following items of property be declared surplus property and be disposed of by the Procurement Agent of the City by listing for sale said items on the GovDeals website, and in the event of an unsuccessful sale, in a manner that will require no further expenditure by the City nor expose the City to any liability in the further use of or operation of said items of property; and the Council does hereby authorize the Procurement Agent of the City to dispose of said items of property in such manner, and THEREFORE, BE IT FURTHER RESOLVED, that with the exception of the following items of surplus property identified as: 1997 Ford Crown Victoria - VIN: 2FLP71W1VX162349 and 2002 Ford Crown Victoria - VIN: 2FAFP71WO2X137371 be sold to the City of Tuscumbia for a purchase price of $1,000.00 for each said item of identified surplus property; and THEREFORE, BE IT FURTHER RESOLVED that in the event the City of Tuscumbia shall choose not to purchase the identified surplus property, that the Procurement Agent be authorized to dispose of said items of property in such manner as all other items identified in Exhibit A. The Council states that the following items of property are surplus property: See Exhibit A attached hereto and made a part hereof as if set out in full.

Mayor Bradford announced that the Resolution had been approved. Mayor Bradford announced that the next item of business was consideration of an ordinance allowing for the sale of draft or keg beer in the city. Council Member Noles introduced the following resolution which was presented in the meeting and moved for its adoption: ORDINANCE NUMBER 1415-09 WHEREAS, the City Council of the City of Muscle Shoals, Alabama is desirous of approving the sale of draft or keg beer or malt beverages for on-premises consumption by retail licensees of the Alabama Beverage Control Board within the City of Muscle Shoals, Alabama and its police jurisdiction; and

WHEREAS, the City Council of the City of Muscle Shoals, Alabama is desirous of approving the sale of draft or keg beer or malt beverages for off-premises consumption by retail licensees of the Alabama Beverage Control Board within the City of Muscle Shoals, Alabama and its police jurisdiction; BE IT ORDAINED by the Council of the City of Muscle Shoals, Alabama as follows: Section 1. Pursuant to the provisions of Act # 2009-659, same being duly adopted by the Alabama Legislature in its 2009 Regular Session, the City Council of the City of Muscle Shoals, Alabama does hereby approve of the sale of draft or keg beer or malt beverages for onpremises consumption by retail licensees of the Alabama Beverage Control Board within the City of Muscle Shoals, Alabama and its police jurisdiction. Section 2. Pursuant to the provisions of Act # 2009-659, same being duly adopted by the Alabama Legislature in its 2009 Regular Session, the City Council of the City of Muscle Shoals, Alabama does hereby approve of the sale of draft or keg beer or malt beverages for offpremises consumption by retail licensees of the Alabama Beverage Control Board within the City of Muscle Shoals, Alabama and its police jurisdiction. Section 3. All resolutions and ordinances relating to the sale, consumption and possession of bottled or canned beer shall apply to draft or keg beer or malt beverages. Section 4. The Ordinance, and its provisions, shall become upon publication or posting pursuant to law or as otherwise provided for by law. Council Member Noles moved that unanimous consent be given for immediate consideration of and adoption of said Ordinance, which motion was seconded by Council Member Grissom and, upon said motion being put to a vote, a roll call was had and the vote was recorded as follows: AYES: Council Member Pampinto, Council Member Willis, Council Member Grissom, Council Member Noles, Mayor Bradford NAYS: None Mayor Bradford announced the vote and declared that the motion for unanimous consent for immediate consideration had been approved. Council Member Noles then moved that the said Ordinance be finally adopted, which motion was seconded by Council Member Grissom and, upon said motion being put to a vote, a roll call on final approval was had and the vote recorded as follows: AYES: Council Member Pampinto, Council Member Willis, Council Member Grissom, Council Member Noles, Mayor Bradford NAYS: None Mayor Bradford thereupon declared said motion carried and the Ordinance was adopted. Mayor Bradford announced the appointment of Richard Davis to the Planning Board for the remainder of the unexpired term of Joel Quillen who resigned. The term expires in December, 2011.

Mayor Bradford announced that the next item of business was the rescheduling of the th July 6, 2009 Council meeting. Council Member Grissom moved that the meeting be rescheduled to Monday, July 13, 2009 at the regular time and place. Council Member Pampinto seconded the motion and upon said motion being put to a vote, all voted AYE and NAYS were none. Mayor Bradford announced that the motion had been approved. There being no further business to come before the meeting, upon the motion duly made, seconded and unanimously carried, the meeting was adjourned.
