CORPORATION OF THE TOWNSHIP OF MELANCTHON th The Council of the Corporation of the Township of Melancthon held a meeting on the 16 day of November, 2017 at 5:00 p.m. in the Council Chambers. Mayor D. White, Deputy Mayor J. Elliott, Councillor D. Besley, Councillor W. Hannon and Councillor J. Webster were present. Denise Holmes, CAO/Clerk and Wendy Atkinson, Treasurer/Deputy Clerk were also present. Mayor White presided and called the meeting to order. Announcements Additions Deletions Approval of Agenda Moved by Elliott, Seconded by Webster that the agenda be approved as circulated. Carried. Disclosure of Pecuniary Interest and the General Nature Thereof Mayor White advised that disclosure of pecuniary interest can be declared at this time or anytime throughout the meeting. Minutes Moved by Elliott, Seconded by Besley that the minutes of the November 2, 2017 Council meeting be adopted as circulated. Carried. Business Arising from Minutes Point of Privilege or Personal Privilege Public Question Period A question was asked about the Keating Drain and Staff were directed to contact the Drainage Superintendent about it. Public Works Planning Applications to Permit There were no applications for approval for this meeting. Strada Status Report, dated November 9, 2017 Chris Jones, Township Planning Consultant reviewed his Report with Council. Moved by 1

Hannon, Seconded by Besley that the Application for Official Plan Amendment and Zoning By-law Amendment submitted by Strada Aggregates be scheduled for a public meeting in accordance with Sections 17, 22 and 34 of the Planning Act. Carried. The public meeting will be held Thursday, December 21, 2017. Other There was no other planning business to be discussed. Police Services Board Mayor White advised that information has been sent to the PSB s about the purchase of a set of scales. Denise Holmes advised that the information would be on the next PSB meeting Agenda for discussion and recommendation to Council. A concern was raised by Councillor Besley regarding the Police Checks that the Board members for the North Dufferin Community Centre are required to have. He advised that the person at the Detachment who does them, is on two weeks holidays, so it will be 30 days before they can get them. The members need their police checks before a meeting can be held. Mayor White to speak to Mayor Mills about having the first meeting without the police checks. County Council Update Mayor White reported that the County Budget has passed with a 1.9% increase. The Election of the Warden will be held at the next meeting on December 14, 2017. Centre Dufferin Recreation Complex Meeting - September 27, 2017 Moved by Webster, Seconded by Elliott that the Board and Committee Minutes Correspondence Item # 1, be received as information. Carried. * Items for Information Purposes 1. Resolution from Township of Sioux Narrows - Nestor Falls, in support of Township of Montague Resolution sent to Honourable Kathleen Wynne, Premier of Ontario, dated November 7, 2017, Re. Bill 148, Fair Workplaces, Better Jobs Act 2017 2. AMO Communications - Policy Update - Thursday November 2, 2017 3. Resolution from the Town of Mono, in support of Township of Montague Resolution, sent to Honourable Kathleen Wynne, Premier of Ontario, dated September 19, 2017, Re. Dufferin County Council endorsement of the Association of Municipalities of Ontario s submission on Bill 148 - Fair Workplaces, Better Jobs Act 2017 Moved by Besley, Seconded by Hannon that Correspondence Items 1-8 for information purposes be received as information except item 5 for discussion. Carried. Discussion ensued and this item was deferred to the next meeting as Councillor Hannon 2

would like to look into getting more information on it. Delegations 5:30 p.m. A Public Meeting had been called for an Official Plan Amendment and Zoning Bylaw Amendment to implement provisions of the approved Source Water Protection Plans for South Georgian Bay Lake Simcoe and Grand River in accordance with the Clean Water Act. Chris Jones, Township Planning Consultant and Ryan Post, Risk Management Official were in attendance to speak to the proposed amendments. Several persons were in attendance for the public meeting as a result of the public notice. Mayor White opened up the meeting and explained the purpose of the public meeting and the format of the meeting. Denise Holmes, CAO advised of the method for giving notice of the public meeting which were via the Township s website, the Dundalk and Shelburne newspapers and circulated to the public bodies as prescribed under Ontario Planning Act Regulation. She advised that she received the following written submissions: Harvey Lyon, Janet and Brent Pendleton, Garry Hunter and Associates on behalf of Rutledge Farms and Leo Blydorp. It was noted that a public open house was held on Tuesday, November 14, 2017. Mr. Jones presented a power point presentation on Source Water Protection and Mr. Post spoke on the well head protection areas and tried to ease the concerns of the people by advising that only the properties in the red area with a score of 10 vulnerability is where the policies would apply. The properties in the yellow area are not applicable, as the vulnerability score is not high enough for the policies to apply, but he did encourage best management practices. The following persons provided oral comments at the meeting: Brian Horner on behalf of Robert Coutts who was unable to attend the meeting; Rick Wallace; Bill Barton, Garry Hunter on behalf of Rutledge Farms and Gord Grant, Ontario Federation of Agricultural. The next steps in the process are that the Planner and RMO will review the submissions and report back to Council with any recommended changes to the amendments. The public meeting concluded at 6:38 p.m. and Council took a break and reconvened at 6:55 p.m. 6:55 p.m. - Moved by Elliott, Seconded by Webster that we adjourn Council to go into Committee of Adjustment and reconvene as Council. Carried. * Items for Council Action 1. Resolution from Shelburne and District Fire Board Meeting, dated November 8, 2017, Re. Bill 148 2. Motions passed at the Shelburne and District Fire Board Meeting, Re. 2018 Operating Budget and increase for the 2018 Capital Budget 3. Notification for the Maintenance and Repair of the Coutts Drain, signed by Levi Bowman - Part Lots 278 and 280, Concession 2 SW # 1 - item deferred as there are some amendments coming to Bill 148. # 2 - Moved by Hannon, Seconded by Besley that we approve the SDFB 2018 operating budget in the amount of $489,772.00 which is a 7.9% increase. Carried. # 3 - Moved by Besley, Seconded by Hannon that we accept the notification for the maintenance and repair of the Coutts Drain under Section 79 of the Drainage Act, 1990 signed by Levi Bowman owner of Part of Lots 278-280, Concession 2 SW. We direct the Drainage Superintendent to investigate and report back to Council on the findings and recommendations. Carried. General Business Notice of Intent to Pass By laws A By-law imposing special annual drainage rates upon land in respect of which money is borrowed under the Tile Drainage Act. Moved by Webster, Seconded by Elliott that leave be given to introduce a By-law imposing 3

special annual drainage rates upon land in respect of which money is borrowed under the Tile Drainage Act and it now be read a first and second time. Carried. By-law numbered 54-2017 and read a first and second time. Road Widening By-Law, East Part of Lot 18, Concession 3 OS as in MF18050, Township of Melancthon, County of Dufferin (PIN 34140-0005) Moved by Besley, Seconded by Hannon that leave be given to introduce a By-law for the acquisition of lands described as the East Part of Lot 18, Concession 3 OS as in MF18050 and it now be read a first and second time. Carried. By-law numbered 55-2017 and read a first and second time. A By-law to provide direction for the Parking in the Township of Melancthon Re-tabled motion from November 2, 2017 - Moved by Webster, Seconded by Hannon that leave be given to introduce a By-law to Provide for the Parking in the Township of Melancthon and it be hereby read a first and second time. Carried. By-law numbered 56-2017 and read a first and second time. A By-law to appoint officials from December 1, 2017 to November 30, 2018 Moved by Elliott, Seconded by Webster that leave be given to introduce a By-law to appoint officials from December 1, 2017 to November 30, 2018 and it now be read a first and second time. Carried. By-law numbered 57-2017 and read a first and second time. A By-law to constitute and appoint a Committee of Adjustment Moved by Hannon, Seconded by Besley that leave be given to introduce a By-law to constitute and appoint a Committee of Adjustment and it now be read a first and second time. Mulmur Melancthon Fire Department - 2018 Budget Deferred to next meeting. Centre Dufferin Recreation Complex - 2018 Budget Moved by Besley, Seconded by Hannon that the 2018 Draft Budget for the Centre Dufferin Recreation Complex be approved with Melancthon s levy being $46,235.00. Carried. Closed Session 7:34 p.m. - Moved by Hannon, Seconded by Besley that Council move into Closed Session pursuant to Section 239 of the Municipal Act, 2001, as amended for the following reason(s): 4

a proposed or pending acquisition or disposition of land by the municipality or local board & the receiving of advice that is subject to Solicitor/Client privilege, including communications necessary for that purpose - Lot 86, Plan 23A - Argyle Street, Corbetton. Carried. 7:41 p.m. - Moved by Hannon, Seconded by Besley that we rise from Closed Session with report. Carried. Report as per the directives in Closed Session. Third Reading of By-laws Moved by Elliott, Seconded by Webster that By-laws 54-2017, 55-2017, 56-2017, 57-2017, 58-2017 and 59-2017 now be read a third time, signed by the Mayor and Clerk, sealed and engrossed in the By-law Book. Notice of Motion Confirmation By-law Moved by Elliott, Seconded by Webster that leave be given to introduce a By-law to confirm the proceedings of the Council of the Corporation of the Township of Melancthon at its meeting held on November 16, 2017 and it be given the required number of readings.
