January 9, 2017 The Board of Ellis County Commissioners met in regular session at 5:07 p.m., Tuesday, January 9, 2017, in the Commission Chambers, at the Administration Center, 718 Main Street, Hays, Kansas. Chair Dean F. Haselhorst called the meeting to order. The meeting opened with everyone standing and saying the Pledge of Allegiance. Commissioners present: Chair Dean F. Tony Rohr stated that he has served the Wheatland Township Board as Treasurer for several years and Ernie Binder will be taking over this position. He thanked the Commissioners. Rohr was also thanked for his years of service as Wheatland Township Treasurer. REGISTER OF DEEDS MORTGAGE REGISTRATION FEE Register of Deeds Rebecca Herzog addressed a 2004 mortgage registration fee that was collected and the document was recorded and processed involving sixteen counties. Then in December 2016 the Company, with their attorney s advisement, paid the mortgage registration fees again. The company has now filed with the Kansas State Board of Tax Appeals for a refund on the mortgage registration fees paid in December 2016. Register of Deeds Herzog will be working on a response to the Kansas State Board of Tax Appeals and will not be requesting a hearing. REORGANIZATION APPOINTMENT OF ELLIS COUNTY COMMISSION AND RESOLUTION ON COMMISSION DISTRICT APPOINTMENT OF CHAIR OF THE ELLIS COUNTY COMMISSION Motion: McClelland Second: Haselhorst To nominate Barbara Wasinger as Chair of the Ellis County Commission for 2017. COMMISSION DISTRICTS County Administrator Phil Smith-Hanes stated that the Commission is to review the Commission Districts every three years. Smith-Hanes states that no major changes have occurred in the population figures in the districts and per Kansas State Statues these districts, by population, will be reviewed every three years. RESOLUTION 2017-1 RESOLUTION OF THE BOARD OF ELLIS COUNTY COMMISSIONERS WHEREAS, K.S.A. 19-204 requires boards of county commissioners to redistrict, and states that boards of county commissioners are subject to alteration at least once every three years ; and WHEREAS, K.S.A. 19-204 requires the board of county commissioners to redistrict into districts that are compact and equal in population; and WHEREAS, case law and Kansas attorney general opinions require that redistricting meet the legal concept of one person, one vote, which occurs through districts of equal population; and WHEREAS, case law and Kansas attorney general opinions require that redistricting be based on the most recent population numbers in order to accomplish equal populations within the districts; and WHEREAS, the U.S. census occurs every ten years and population data is updated annually with certified population numbers reported to the Kansas Secretary of State; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ELLIS COUNTY, KANSAS, that it has complied with K.S.A. 19-204 in that it has relied upon the most recent population data to redistrict following the 2010 U.S. census; that there has been no significant population changes among the
districts within the last three years; and that the Board of County Commissioners districts are compact and equal population as much as possible. This Resolution is effective upon its adoption. McClelland, Commissioner 2017 COUNTY AGREEMENT TO TREAT NOXIOUS WEEDS FOR THE KANSAS DEPARTMENT OF TRANSPORTATION Gary Haas, Weed Control Supervisor, presented the 2017 County Agreement to treat noxious weeds yearly for the Kansas Department of Transportation (KDOT). Haas has increased the labor cost from $30 to $32 per hour using the 2.5 ton or ¾ ton spray truck. On equipment rates, Haas asked to charge $32 per hour for the ¾ ton spray truck and $36 per hour for the 2.5 ton spray truck which are FEMA equipment rates. KDOT noted that they do not want colored dye used in the treat of noxious weeds on their properties. Motion: McClelland Second: Haselhorst To approve the agreement to treat noxious weeds for the Kansas Department of Transportation (KDOT) with changes on the labor cost from $30 to $32 with the ¾ ton spray truck guidance and rate controller, $36 per hour equipment cost with the 2.5 ton spray truck and no colored dye to be used. MONTHLY FINANCIAL REPORT The December 2016 Financial Report will be available at the January 16, 2017 meeting. COUNTY COUNSELOR REPORT (COUNTY COUNSELOR BILL JETER) County Counselor Bill Jeter reported that he is finishing up the title work for the sale of the Tholen Building and will be scheduling a time with Chair Wasinger to complete the closing of the sale on the Tholen Building. COUNTY ADMINISTRATOR REPORT (COUNTY ADMINISTRATOR PHILLIP SMITH-HANES) No report by the County Administrator Smith-Hanes. COUNTY COMMISSION REPORTS McClelland reported that she attended the ceremony on the Oath of Office for the elected officials at 8:30 a.m. today at the Courthouse. No other reports were presented.
