In reviewing those papers, Plaintiffs counsel noted four errors in the Proposed Order. A corrected Proposed Order in two forms clean (Attachment A) and redline (Attachment B) approved by counsel for all parties, is attached hereto and filed herewith.

On Page of the Proposed Order, Linda Sample was incorrectly listed as a proposed class representative. Because she owned a NewGen machine, she is not a proper class representative and, instead, she supports the class settlement and has agreed to settle her individual claims on a non-class basis.. On Page, the address of the courthouse (where the fairness hearing will occur) was incorrectly listed (it gave the address of the Santa Ana courthouse where this case previously was pending, rather than the Los Angeles courthouse).. The same mistake was made on Page, where the Order provided the courthouse address to which objections should be sent that is, the Order said Santa Ana when it should have said Los Angeles.. Elsewhere on Page, the Proposed Order recited that All claims for Future Overheating Events must be submitted by 0 after days after [sic] the Overheating Event, and the Overheating Event must itself occur within two years of the Notice Date. In addition to the typographical error ( after days after ) pursuant to the terms of the Settlement Agreement, Future Overheating Events must occur within 0 years of purchase or years after the Notice Date, whichever is later.
