Minutes of the Regular Meeting of the Township Council of the Township of East Hanover held on Monday, June 11, 2012 at 7:00 P.M. in the Municipal Building, 411 Ridgedale Avenue, East Hanover, New Jersey. The Mayor called the meeting to order. Present: Councilmen Peluso, DeMaio, Martorelli, Council President Jandoli, and Mayor Also Present: Joseph Tempesta, Jr., Administrator Matthew O Donnell, Township Attorney Kenneth Huelbig, Chief Financial Officer Paula Massaro, Township Clerk The Mayor led the Pledge of Allegiance and Council President Jandoli gave the Invocation. The Mayor read the Public Announcement in which he stated that the meeting had been advertised, the press notified, and the notice posted on the bulletin board in the Municipal Building. Mayor welcomed Senator Richard Codey and Assemblywoman Mila Jasey of the 27 th Legislative District. They briefly commented on pending legislative issues; i.e., state budget, environmental, education funding, and energy tax receipts. Both the Senator and Assemblywoman stressed that their district office was always available for assistance and support. OLD BUSINESS: Public Hearing: Ordinance No. 8-2012 ~ Amend, Revise and Supplement Chapter 38, Personnel Policies and Procedures Manual, of the Township Code The Clerk announced that she had Ordinance No. 8-2012, entitled AN ORDINANCE TO AMEND, REVISE, AND SUPPLEMENT CHAPTER 38, PERSONNEL POLICIES AND PROCEDURES MANUAL, OF THE CODE OF THE TOWNSHIP OF EAST HANOVER. The Mayor stated they would now hold a public hearing on Ordinance No. 8-2012. Motion by Councilman DeMaio, seconded by Councilman Martorelli that the public hearing be closed. Motion by Councilman Martorelli, seconded by Council President Jandoli that Ordinance No. 8-2012 be adopted on second and final reading.

Ayes: Councilmen Peluso, Martorelli, DeMaio, Council President Jandoli, and Mayor The Mayor advised that Ordinance No. 8-2012 has been duly adopted and a notice of same shall be published according to law. Public Hearing: Ordinance No. 9-2012 ~ Amend Chapter 207, Solid Waste Collection The Clerk announced that she had Ordinance No. 9-2012, entitled AN ORDINANCE TO AMEND CHAPTER 207, SOLID WASTE, ARTICLE I, PROOF OF COLLECTION SERVICES, SECTION 207-3, REGULAR COLLECTION REQUIRED, ITEM C, COMMERCIAL OR INSTITUTIONAL BUILDING OR STRUCTURE, SUB-SECTION (2) OF THE TOWNSHIP OF EAST HANOVER CODE. The Mayor stated they would now hold a public hearing on Ordinance No. 9-2012. Motion by Councilman Peluso, seconded by Council President Jandoli that the public hearing be closed. Motion by Councilman DeMaio, seconded by Councilman Peluso that Ordinance No. 9-2012 be adopted on second and final reading. The Mayor advised that Ordinance No. 9-2012 has been duly adopted and a notice of same shall be published according to law. PUBLIC INPUT: Erin Cirelli, 52 Grant Avenue, expressed thanks and gratitude to the community for their support at the 4 th Annual Hemophiliac Walk for her son Nicholas. Motion by Councilman Peluso, seconded by Councilman DeMaio that the public hearing be closed. COUNCIL INPUT: Councilman Peluso announced that the summer concerts sponsored by Novartis would commence on July 10 th at Lurker Park. He commented on the Memorial Day parade. 2

Councilman Peluso requested that the Administrator provide him with a list of roads slated for repaving. Councilman DeMaio was pleased of a large community support at the Hemophiliac Walk for Nicholas Cirelli. He reminded everyone that school was out and to drive safely. Councilman Martorelli congratulated the Hanover Park Girls Softball team on their victory. He wished everyone a safe summer. Council President Jandoli stated she had the honor of presenting the Mayor s Scholarships at Hanover Park High School. She expressed good wishes to all graduates in the community. Mayor likewise congratulated the graduates and wished everyone a happy and safe summer. CONSENT AGENDA: Matters listed within the Consent Agenda have been referred to members of the Township Council for reading and study, are considered to be routine, and will be enacted by one motion of the Township Council with no separate discussion. COMMUNICATIONS & DISCUSSION ITEMS: Communication Re: Pool Installed in Township Easement (11 Lent Street) The Administrator gave a brief explanation of a pool that had been previously installed in a Township easement. In these matters, Mr. Tempesta noted that it was Township procedure to have the Attorney prepare a Hold Harmless Agreement, which would absolve the Township of any liability in the future. Furthermore, at the request of the Engineer and Zoning Official, the homeowner would be required to go before the Land Use Planning Board because of pool equipment in close proximity to the adjacent property. Mr. Tempesta stated that this issue would need to be resolved prior to the homeowner s execution of a hold harmless agreement. The Council unanimously agreed. NEW BUSINESS: Introduction: Ordinance No. 10-2012 ~ Bond Ordinance Appropriating $1,647,300 Providing for Various Capital Improvements The Clerk stated that the Supplemental Debt Statement was filed in her office as of June 11, 2012. The Clerk announced that she had Ordinance No. 10-2012, entitled BOND ORDINANCE PROVIDING FOR VARIOUS CAPITAL IMPROVEMENTS OF THE TOWNSHIP OF EAST HANOVER, IN THE COUNTY OF MORRIS, NEW JERSEY, APPROPRIATING THE AGGREGATE AMOUNT OF $1,647,300 THEREFOR AND AUTHORIZING THE ISSUANCE OF $1,564,935 IN BONDS OR NOTES OF THE TOWNSHIP TO FINANCE PART OF THE COST THEREOF. Motion by Councilman DeMaio, seconded by Councilman Martorelli that Ordinance No. 10-2012 be introduced by title, adopted on first reading, placed on file in the Clerk s office, and set down for public hearing on July 9, 2012. Introduction: Ordinance No. 11-2012 ~ Bond Ordinance Appropriating $276,500. Providing for Various Utility Improvements The Clerk stated that the Supplemental Debt Statement was filed in her office as of June 11, 2012. The Clerk announced that she had Ordinance No. 11-2012, entitled BOND ORDINANCE PROVIDING FOR VARIOUS UTILITY IMPROVEMENTS IN AND BY THE TOWNSHIP OF EAST HANOVER, IN THE COUNTY OF MORRIS, NEW JERSEY APPROPRIATING $276,500 THEREFOR AND AUTHORIZING THE ISSUANCE OF $276,500 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING THE COST THEREOF. 4

The meeting reconvened at 8:15 Present: Councilmen Peluso, DeMaio, Martorelli, Council President Jandoli, and Mayor Introduction: Ordinance No. 12-2012 ~ Private Sale of Certain Municipal Property Owned by the Township (Portion of Block 21, Lots 1 & 14) The Clerk announced that she had Ordinance No. 12-2012, entitled AN ORDINANCE OF THE TOWNSHIP OF EAST HANOVER AUTHORIZING THE PRIVATE SALE OF CERTAIN MUNICPAL PROPERTY OWNED BY THE TOWNSHIP OF EAST HANOVER NOT REQUIRED FOR PUBLIC PURPOSES PURSUANT TO N.J.S.A. 40A:12-13(B)(5). Motion by Councilman Martorelli, seconded by Councilman DeMaio that Ordinance No. 12-2012 be introduced by title, adopted on first reading, placed on file in the Clerk s office, and set down for public hearing on July 9, 2012. 99-2012 Resolution Re: Tax Appeal Settlement for 2007 & 2008/Target Motion by Councilman Martorelli, seconded by Councilman DeMaio to adopt said resolution. 5
