SAIPAN AND NORTHERN ISLANDS LEGISLATIVE DELEGATION Seventeenth Northern Marianas Commonwealth Legislature Saipan Local Law 17-05 THIRD SPECIAL SESSION, 2010 HOUSE LOCAL BILL NO. 17-21. D2 A LOCAL BILL FOR AN ACT FOR THE THIRD SENATORIAL DISTRICT To make amendments to the Saipan Cockfighting Act of 1994. BE IT ENACTED BY THE THIRD SENATORIAL DISTRICT DELEGATION PURSUANT TO CHAPTER 4, DIVISION 1, TITLE 1 OF THE COMMONWEALTH CODE: I Section 1. Findings and Purpose. The Seventeenth Saipan and Northern Islands 2 Legislative Delegation finds that there is a need to amend the Saipan Cockfighting Act of 1994 3 by lengthening the period a licensee may hold an operators license. Over the years since the 4 enactment of SLL 9-8, the various past operators have found that the annual license fees paid 5 coupled with the duration of the licensed period is not long enough for the operator to re-coup 6 their investment and to enhance and upgrade their arenas because of a legitimate fear of 7 loosing the licensing rights at the next year's bidding. 8 Section 2. Amendment. Title 10 CMC 3602 is hereby amended to read as follows: 9 " 3602. Cockpit Board. 10 "There is hereby established a Saipan Cockpit Board, which shall consist of the five II members to be appointed by the Mayor of Saipan." 12 Section 3. Amendment. Title 10 CMC 3608 is hereby amended to read as follows. 13 " 3608. Bid Proposal. 14 "A bid proposal for the operation of a cockpit shall be submitted to the offce of 15 the Mayor of Saipan any day within a period of 10 days from the date fixed in the

Each bid shall be accompanied by a 2 nonrefundable deposit of $+00 $500 payable to the Commonwealth Treasury. All bids 3 submitted must be sealed and will be publicly opened five days after the deadline date 4 for the submission of bids at the time and place stated in the bid notice. The minimum 5 bid which can be received and accepted by the Mayor of Saipan and the cockpit board 6 shall be the sum of $19,000 ; O,OOO per vear, which shall be paid no later than 24 7 hours following the bid award". 8 Section 4. Amendment. 10 CMC 3610 is hereby amended to read as follows. 9 " 3610. Duration of License. 10 "A cockpit license shall be issued for a period of en five year,ii, commencing 11 on July I of the first tl year, and shall end on June 30 of the felsvi fifth year, 12 tms elee fe a resa Is pe sf ti 9y th lr and shall be 13 payable armually on or before July 1st and subject to license revocation if payment is 14 not made on or before said date. Should the 1st of July fall on a weekend, payment 15 must be made on the first work day of the week". 16 Section 5. Amendment. 10 CMC 3604 and 3618 are hereby amended to read as 17 follows: 18 " 3604. Rules and Regulations. 19 "The Mayor of Saipan and the cockpit board ma shall promulgate, 20 in consultation with cockpit operators, reasonable and necessary 21 rules and regulations for the board to carry out the intent and purposes 22 of this chapter, within 60 davs of this Act becoming law, a copy of 23 24 'Which shall be provided to the Chairman of the Saipan and Northern Islands Legislative Delegation." 25 " 3618. "(2) No person or individual shall engage or participate in cockfighting. at a time and place where a fee is charged for admission or betting takes place. unless that gaming activity is licensed pursuant to this chapter. "(3) No licensee shall permit any person under 18 years of age to attend or be present. unless with parental or adult supervision, under anv circumstances to wager at a licensed (;oekpit. 11 "(b) Penalties. Any person or individual who willfully or 12 13 14 15 knowingly violates any provision of this chapter or any rule or regulation duly promulgated aele is by the board pursuant to this chapter. sliall be guilty of a misdemeanor, and upon conviction shall be fine not more th $600, or imprisoned not more th three months, or both." 16 Section 4,2. Severability. If any provision of this Act or the application of any such 17 provision to any person or circumstance should be held invalid by a court of competent 18 19 20 21 22 jurisdiction, the remainder of this Act or the application of its provisions to persons or circumstances other than those to which it is held invalid shall not be affected thereby. Section e 1. Savings Clause. This Act and any repealer contained herein shall not be construed as affecting any existing right acquired under contract or acquired under statutes repealed or under any rule, regulation or order adopted under the statutes. Repealers contained 23 in this Act shall not affect any proceeding instituted under or pursuant to prior law. The 24 25 enacunent of the Act shall not have the effect of terminating, or in any way modifying, any liability, civil or criminal, which shall already be in existence on the date this Act becomes 26 effective.
