People who are dissatisfied with decisions of the Board of Directors may have the right of review of that decision by a state court. The District has adopted Section 1094.6 of the Code of Civil Procedure, which generally limits to 90 days the time within which decisions of the District s Board and agencies may be judicially challenged in state court. *MANDATORY ADJOURNMENT. Pursuant to Section 3.18 of Ordinance No. 93, if consideration of all matters on the agenda is not complete by 10:30 p.m., the President shall adjourn to the next regular meeting, at which time those matters shall be taken up for consideration first; except that upon motion of the Board, the meeting may be extended beyond 10:30 p.m. to a stated time. Item I- Resolution 2014_-draft A RESOLUTION OF THE BROOKTRAILS TOWNSHIP COMMUNITY SERVICES DISTRICT AUTHORIZING THE SUBMITTAL OF ORDINANCE 147 TO THE QUALIFIED ELECTORS OF THE BROOKTRAILS COMMUNITY SERVICES DISTRICT FOR AN ELECTION TO BE CONDUCTED ON OR ABOUT WHEREAS, the Board of Directors of Brooktrails Township Community Services District (the District ) has determined that an Ordinance should be adopted imposing a special tax pursuant to Government Code 53978 for fire protection and prevention, including ambulance service; WHEREAS, the Board of Directors wishes that the question of approval of said Ordinance should be submitted to the qualified electors of the District election to be conducted on June 2014; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BROOKTRAILS TOWNSHIP COMMUNITY SERVICES DISTRICT as follows: 1. The question of approving Ordinance No., imposing an increase in the District s Special Fire Tax and determining the amount thereof, shall be submitted to the qualified electors of Brooktrails Township Community Services District at an election to be held on June 2014, which election is hereby called. 2. The question to be presented to the qualified electors at said election shall be as follows: Shall Ordinance No. of the Brooktrails Township Community Services District increasing the Special Tax for Fire Protection and Prevention, including emergency medical response, commencing with the Fiscal Year beginning be approved; and the District s Appropriation Limit be raised by the amount collected hereunder? 3. The election so called is to be held at the Consolidated District Election to be held on at the election precincts, polling places and officers of election within the area of this District shall be the same as those selected and designated by, County Clerk of the County of Mendocino and set forth, or to be set forth in the Order, if and when made, of the County Clerk designating the precincts and polling places for said election and on file in her office, to which order reference is hereby made for the designation of the precincts, polling places and officers of the election hereby called. 4. The District agrees to pay its proportionate share of the cost charged by the County of Mendocino for conducting such election. BROOKTRAILS TOWNSHIP COMMUNITY SERVICES DISTRICT ORDINANCE No. Amending Ordinances 29 and 126 (FIRE PROTECTION SPECIAL TAX INCREASE) WHEREAS, District Ordinance No. 29 adopted in 1981 established a Special Fire Tax; and WHEREAS, District Ordinance No. 29 was approved by the electors of the District at a District election on June 2, 1981; and WHEREAS, District Ordinance No. 126 adopted in 2004 increased the Special Fire Tax; and WHEREAS, District Ordinance No. 126 was approved by the electors of the District at a special District election by mail on August 31, 2004; and WHEREAS, the costs and expenses incurred by the District for the provision of fire prevention, protection and suppression services have increased substantially, and the revenue generated by the Special Fire Tax is no longer sufficient to meet the cost of providing these services; and WHEREAS, the District must find an immediate solution to provide adequate funding for its fire services in order to ensure the health, safety, and general welfare of its residents and members of the public; and WHEREAS, the Board of Directors has determined that an increase to the parcel tax across all parcel categories is required immediately; and WHEREAS, the Board of Directors elects to submit the question of an increase to the special tax for fire protection to the electorate residing within the boundaries of the District, seeking a two-thirds approval.

Now, Therefore, BE IT ORDAINED by the Board of Directors of Brooktrails Township Community Services District (the ADistrict@) as follows: 1. Paragraph 3.01 of Ordinance No. 29 and Paragraph 1 of Ordinance No. 126 shall be amended to provide for the following annual parcel tax to be levied effective immediately for the Fiscal Year 2013-14 tax bills: Single family $99 Duplex $150 Triplex $200 Fourplex $250 Multiplex $275 Commercial $200 Hotel motel $300 Vacant land $99 2. All tax funds received shall be specifically segregated in account(s) designated only for purposes of a comprehensive fire prevention program, operations, capital improvements, and reserves. All new tax revenue shall be designated for the funding of fire department operations (exclusive of salaries) capital improvements, depreciation, fire hazard abatement programs, fire prevention programs and reserves.. 3. This Ordinance will take effect if the Ordinance is approved by a twothirds vote of the electorate residing in Brooktrails Township Community Services District, and shall upon such approval take effect immediately, and be applied on County tax bills beginning with those issued for Fiscal Year 2013-14. 4. If any article, section, subsection, sentence, phrase, or clause of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this Ordinance. The voters of the District hereby declare that they would have adopted the remainder of this Ordinance, including each article, section, subsection, sentence, phrase or clause, irrespective of the invalidity of any other article, section, subsection, sentence, phrase or clause. * * * * * * * * * * * * * * * * * * * * * Introduced and adopted this at a regular meeting of the Board of Directors of the Brooktrails Township Community Services District by the following vote:
