Day One: Committee of the Whole Highways, Planning & Corporate Minutes - February 8, 2012 GODERICH, ONTARIO

COMMITTEE OF THE WHOLE DAY 1 Goderich, Ontario February 8 th, 2012 The Committee of the Whole Day 1 met in the Court House Council Chambers in Goderich on the 8 th of February, 2012. All members of Council were present. Councillor B. Dowson attended the meeting at 9:08 a.m. Chair J. Grace called the meeting to order at 9:04 a.m. Declarations of Pecuniary Conflict of Interest and the General Nature Thereof: There were no declarations of pecuniary conflict of interest. Moved by: Councillor G. Robertson and Seconded by: Councillor T. Hessel: The Committee of the Whole Day 1 Agenda for February 8 th, 2012; be accepted and all Reports included in the Agenda; be received. Councillor s Issues: Councillor Shewfelt reminded everyone about the Goderich is Kraft Hockeyville competition. The last day for voting is March 3 rd. Councillor Dietrich questioned the tree cutting along County roads that is currently going on. Director of Public Works Dave Laurie gave an explanation about the tree cutting along County roads and that select trees have been identified as hazards in the front slope of a ditch. Trees should be planted at the property line. Councillor Dowson expressed concerns about the lack of signage for the narrowing of the roadway to a single lane of traffic at the bridge on Highway 83. Director of Public Works Dave Laurie advised that the contractor is working on the bridge and the bridge may be temporarily narrowed as required to accommodate the construction. For anyone with a permit to travel with an oversized load, they would have been made aware of the bridge narrowing to a single lane.

Page 2 of 11 Councillor Dowson reported there is a concern with the Lower Tiers paying firefighters to assist EMS calls requiring lifts. CAO Adams will take this concern to David Lew, Chief, Emergency Services. Warden MacLellan advised he is bringing the draft Budget to COTW Day 2 on February 15 th. Moved by: Councillor Klopp and Seconded by: Councillor Van Diepenbeek: The 2012 Budget meetings; be held in March at the Committee of the Whole meetings; allowing the department heads to review their budgets following their respective Committee meetings. Warden MacLellan updated Council on the organizational review performed by Mr. Cuff and Mr. Hoffman. Mr. Cuff is very pleased with the responses from everyone during the interview process. Mr. Cuff and Mr. Hoffman will be returning for one more week to do follow up interviews and then a third trip back to present the organizational review report to County Council. Warden MacLellan reported he has been doing some research into a reserve fund that has a substantial amount of money in it for the Health Unit. Moved by: Warden B. MacLellan and Seconded by: Councillor D. Shewfelt: A report and motion be included on the COTW Day 2 Agenda for February 15 th, 2012 regarding the hold back money in a reserve fund for the Health Unit. 5.1 Donation of $200 for the Transportation Expense of a Fire Truck to Bird Cove, Nfld. Moved by: Councillor J. Steffler and Seconded by: Councillor P. Gowing: The Council of the County of Huron; agrees to donate $200 for the expenses of transporting a fire truck that is being donated by the Municipality of Central Huron to the Municipality of Bird Cove, Nfld.;

Page 3 of 11 AND FURTHER The Council of the County of Huron; requests each lower tier municipality in the County of Huron to assist with the transportation expense of the fire truck that the Municipality of Central Huron is donating to the Municipality of Bird Cove, Nfld. by forwarding a donation of $200 to the Municipality of Bird Cove, Nfld. 6. Report of the Agricultural Economic Development Advisor OMAFRA: Jane Muegge, Agricultural Economic Development Advisor, Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) delivered a presentation for the information of the Committee. Jane Muegge s title has changed to Agriculture and Rural Economic Development Advisor. 7. Public Works Department: 7.1 Information Report: Dave Laurie, Director of Public Works and Mike Alcock, Civil Engineering Technologist presented the following reports for the information of the Committee. 7.2 County Road 12 (Brussels Line) Walton to County Road 87 Line (22.2 km.) for Cold In-place Recycling (CIR) and Surface Asphalt: Moved by: Councillor N. Vincent and Seconded by: Councillor P. Gowing: The recommendation of Mike Alcock, Civil Engineering Technologist, Public Works Department; that the County of Huron award the tender for Contract 12-301; to Lavis Contracting Company Limited; in the amount of $3,048,642.50 (based on estimated quantities and excluding HST); be approved; Motion Con t. on Page 4.

Steffler and Seconded by: Councillor N. Vincent: The recommendation of Mike Alcock, Civil Engineering Technologist, Public Works Department; that the County of Huron award the tender for Contract 12-302; to Lavis Contracting Company Limited; in the amount of $1,302,732.50 (based on estimated quantities and excluding HST); be approved; AND FURTHER The recommendation of Mike Alcock, Civil Engineering Technologist, Public Works Department; that an additional $134,255.23; be allocated for HST; and additional $125,000 be allocated for asphalt cement, fuel escalation and contingencies; an additional $35,000 be allocated for County related costs; an additional $150,000; be allocated for shoulder gravel and culvert repairs to be completed by County forces; for a total budget allocation of $1,501,987.73; be approved. 7.4 Two Half Ton 2wd Extended Cab Pickup Trucks (HC-2012-01): Walter Johnston, Fleet Manager, Public Works/Highways Department prepared a report entitled 2 - Half Ton 2wd Extended Cab Pickup Trucks (HC-2012-01); for the information of the Committee. Dietrich: The recommendation of Walter Johnston, Fleet Manager, Public Works/Highways Department that the County of Huron award the tender for three new Kverneland TA 2620 disc mowers for use by Public Works; to C.G. Equipment; in the amount of $27,052.20 (includes cost of HST); be approved. 8. Planning and Development: 8.1 Consents: The authority to grant or refuse to grant consents is delegated to the Committee of the Whole under By-law No. 5-2009. Decisions become effective upon a carried motion of the Committee of the Whole. County Council is notified for information and appeal purposes only. There are no Consents for this Committee meeting. 8.2 Delegated Consents: The authority to grant undisputed consents is delegated to the Director of Planning and Development under By-law No. 5-2009. The report lists the applications which received provisional consent approval since the last report. County Council is notified for information and appeal purposes only. There are no Delegated Consents for this Committee meeting. 8.3 Official Plans: 8.3 a) County Official Plan, Amendment 3, Five Year Review: The Five Year Review of the County Official Plan received approval from the Minister of Municipal Affairs and Housing on January 4, 2012 with modifications. The appeal period expired on January 24, 2012 and the Ministry reported that one appeal was received. County Council adopted the Five Year Review on June

Page 7 of 11 2, 2010, and County Council approved the Ministry s proposed modifications on June 1, 2011. The Municipality of Central Huron s letter of appeal dated January 23, 2012 appeals section 2.3.15 (renewable energy) and section 5.3.12 (commercial water taking), and any further matter the Council may advise. The specific sections under appeal are included below. Staff will consult with the Ministry and the County lawyer and bring back a report. 2.3(15) Renewable energy systems such as wind, solar and biomass facilities are permitted in agricultural areas in accordance with provincial legislation. The County encourages the Province to regulate renewable energy systems to address local issues and ensure the appropriate protection of the public, settlement areas and the natural environment. In agricultural areas these systems should be designed and constructed to minimize negative impacts on agricultural operations and encourage the preservation of prime agricultural lands. 5.3(12) Commercial scale water taking for human consumption is considered a land use and may be permitted in extractive and agricultural designations, subject to Section 2.3.4. (Minister s Modification 26) 8.4 Zoning By-laws: Zoning By-laws and amendments are circulated to the County from local municipalities. These By-laws are reviewed for conformity with the County Official Plan and with the local Official Plan. Moved by: Councillor J. Ginn and Seconded by: Councillor J. Dietrich: The recommendation of Scott Tousaw, Director of Planning and Development; that no objections be lodged further to the Zoning By-laws submitted with the Report of January 23 rd, 2012; be approved. 8.5 Clean Water Project: The Clean Water Project Review Committee is proposing revisions to the Clean Water Project grant categories. The report outlines the proposed changes and additions.
