CONTRACT SUPPORT COSTS WORKPLAN In the Explanatory Statement accompanying the Consolidated Appropriations Act, 2014 (Act) Congress directed the Indian Health Service (IHS) and the Bureau of Indian Affairs (BIA) to consult with the Tribes to formulate long-term accounting, budget, and legislative strategies to address the funding of Contract Support Costs (CSC). Each agency is requested to consider a standardized approach that streamlines the contract negotiation process, provides consistent and clear cost categories, and ensures efficient and timely cost documentation for the Departments and the Tribes. Within 120 days of enactment of the Act, the agencies are to develop work plans and announce consultation with Tribes on this issue. IHS wants to ensure broad opportunity for Tribal input and discussion regarding a long-term solution and has developed a layered approach to consultation to accomplish this. IHS will engage Tribes in consultation in multiple forums, some that will allow for general input and for generating ideas, others with specific groups for more in-depth discussion, and finally with designated workgroup chairs for final deliberation and prioritization of recommendations. The diagram below outlines the groups and forums involved and a schedule of events follows. GENERAL INPUT/IDEAS GENERATED Joint Sessions with BIA Self-Governance Conference National Congress of American Indians Mid-Year Conference IHS National Meetings Direct Service Tribes Annual Meeting IHS Listening Sessions 12 Area sessions General Input On-going input submitted to consultation@ihs.gov These forums will allow for broad input and thoughts about a long-term solution for funding CSC. All forums will be structured to provide an overview of the guidance received from the Committees and to allow for updates from previous forums/meetings to open the discussion, with the intent to remind participants of the parameters involved and build upon previous input. In addition, based upon recommendations from the IHS Tribal Self-Governance Advisory Committee (TSGAC), the joint consultation sessions with the BIA will be split between input specific to IHS and input specific to BIA. The IHS TSGAC made this recommendation because

of the clear differences between how CSC are calculated and paid between the two agencies. All comments will be captured and provided to the workgroups/committees below to review and discuss. IN-DEPTH DISCUSSION Tribal Budget Formulation Workgroup Provides recommendations on the IHS budget request Has key insight regarding how CSC funding fits into the overall budget priorities Tribal Self-Governance Advisory Committee (TSGAC) Provides advice and assistance to the IHS Director on issues and concerns pertaining to Tribal Self-Governance Has key insight into how CSC impacts program operations for compacting Tribes Direct Service Tribes Advisory Committee (DSTAC) Provides advice and assistance to the IHS Director on policy development that impacts the delivery of health care for Tribes, particularly Direct Service Tribes Has key insight into how CSC funding affects Direct Service Tribes IHS CSC Workgroup Provides recommendations on the IHS CSC Policy and its implementation Has key insight into how CSC is calculated and the factors affecting CSC need Each group will consider the input captured from the general forums as of that point in time. These meetings are not chronological so each workgroup may have a different set of comments to consider. In addition, each workgroup may be presented with specific areas to focus on or specific decision points to discuss which will be consistent with the workgroup s area of expertise and related to the development of a standardized approach that streamlines the contract negotiation process, provides consistent and clear cost categories, and ensures efficient and timely cost documentation for the Departments and the Tribes. The intended outcome is a set of specific recommendations from each group that goes beyond the broad input and addresses the feasibility and operational aspects of the recommended approaches. FINAL PRIORITIZATION and TIMEFRAME The Chairs of the workgroups mentioned above will review and prioritize the recommendations from each group. The results will be presented to and discussed with the Director, IHS, and coordination with other entities, such as the Department of Interior/BIA, will

occur as necessary depending on the outcomes of the consultation a final report issued for use in the formulation and appropriations processes. A schedule of the various forums for general input and in-depth discussion follows. The IHS intends to wrap up the final set of recommendations in September 2014.
