CHAPTER 207 An Act for the Prevention and Suppression of Disease among Bees SHORT TITLE Short title 1 This Act may be cited as The Apiaries Act. R.S.S. 1930, c.165, s.1; R.S.S. 1940, c.207, s.1. INTERPRETATION Interpretation 2 In this Act, unless the context otherwise requires, the expression: Apiary 1. Apiary means any place where bees are kept; Beekeeper 2. Beekeeper means a person who owns bees or has bees in his possession; Disease 3. Disease means foul-brood (American foul-brood, Bacillus larvae, and European foul-brood, Bacillus pluton), bee moths (Galleria mellonella and Achroea grisella), or any other disease or pest from time to time declared by any rule or regulation made under this Act to be a disease within the meaning of this Act; Minister 4. Minister means the Minister of Agriculture. R.S.S. 1930, c. 165, s. 2; R.S.S. 1940, c.207, s.2. Certificate of registration 3(1) Every beekeeper shall, before the first day of May in each year, make application to the minister, on a form to be furnished by him, for a certificate of registration under this Act, and, subject to the provisions of section 4, such certificate shall be granted without charge, to every beekeeper who makes a satisfactory application and declaration in the forms prescribed by the minister. (2) Any person procuring or coming into possession of bees shall, within ten days thereafter, make application to the minister for a certificate of registration. (3) Subject to the foregoing provisions, no person shall own bees or have bees in his possession unless he is the holder of a certificate of registration for the current year. Agreement by applicant 4 No person shall be granted a certificate of registration without having first agreed in writing not to import into Saskatchewan, any bees on comb, brood combs, extracting combs, or any second hand part of equipment which has been used in an apiary outside the province. 4 c. 207 APIARIES Power of minister to declare quarantine 5 For the better prevention of foul-brood, the minister may at any time declare a quarantine of bees in any portion of the province and may fix the duration and conditions thereof. R.S.S. 1930, c.165, s.5; R.S.S. 1940, c.207, s.5. Immovable frame hives prohibited 6 No beekeeper shall have any bees dwelling in a box or immovable frame hive. Inspection of apiaries 7 The minister may at any time order an inspection of an apiary, and an inspector appointed for the purpose shall, while discharging his duties, have free access to any bees or premises where bees are kept. Notification of disease 8 Every beekeeper or other person who is aware of the existence of disease, either in his own apiary or elsewhere, shall immediately notify the minister thereof. Certain sales prohibited 9 No owner or possessor of diseased bees or person who has had bees destroyed for foul-brood shall sell or offer for sale any bees, hives or appurtenances of any kind before being authorized by the minister so to do, or expose in his yard, or elsewhere, any comb or honey or other thing infected with foul-brood, or conceal the fact that such disease exists among his bees. Exposing honey or comb 10 Every person who leaves or permits or causes any honey or comb to be left or exposed where bees can gain access to the honey or comb, except within a hive where bees are kept, shall be guilty of an offence under this Act. Destruction of diseased bees 11 The minister may order any owner or person in charge of an apiary or place where beekeeping equipment is kept, which is known to be infected with disease, to destroy the bees or equipment or both or to take such steps as may be necessary, in the opinion of the minister, to eradicate the disease; and every owner or person who fails to comply with such an order forthwith after receiving the same shall be guilty of an offence under this Act. APIARIES c. 207 5 Penalty 12(1) A person who violates any provision of this Act or any rule or regulation thereunder, shall be guilty of an offence and liable on summary conviction to a fine of not less than $1 nor more than $25. (2) In a prosecution for failing, neglecting or refusing to comply with an order of the minister, the convicting magistrate shall, in addition to any fine imposed, direct that the order of the minister be carried out at the expense of the party in default. Rules and regulations 13 The minister may from time to time make such rules and regulations as he deems necessary for carrying out the provisions of this Act, and such rules and regulations shall from the date of their publication in The Saskatchewan Gazette, or from such later date as may be named for the purpose, have the same force and effect as if incorporated herein.
