CONSENT AGENDA (All items on the Consent Agenda are routine items and may be approved with one motion; however, should any member of the City Council or any individual wish to discuss any item, said item may be removed from the Consent Agenda by motion of the City Council.) 5 Minutes of the regular City Council meeting held July 6, 2015, and the Special City Council meeting held July 13, 2015. 6 An ordinance amending Chapter 13 of the City Code pertaining to sign regulations within designated district gateways, creating canopy displays as a new sign type and prescribing time, manner and place regulations for the same. 7 Authorize the Mayor to execute a Third Amendment to Communications Facilities License with Dallas MTA, L.P., d/b/a Verizon Wireless, to add additional equipment and replace wireless communication antennas located on the City s Service Center Tower. 8 Authorize the City Manager to execute an Interlocal Cooperation Contract with the Texas General Land Office to deliver natural gas to the Municipal Complex on a unit basis, equal to the Waha First of the Month Index Price, as published by Platts Gas Daily, plus a Market Demand Factor of $0.47 per MMBtu, in accordance with Section 104.2545 of the Texas Utilities Code, for a term of three years commencing on October 1, 2015, and ending on September 30, 2018. PUBLIC HEARINGS 9 Conduct a public hearing to receive citizen input on the proposed 2015-16 budget. City of Mesquite, Texas Page 2

10 Conduct a public hearing and consider an ordinance for Application No. 1461-148-2015, submitted by Kathy Zibilich for Verizon Wireless, for a rezoning from R-1, Single-Family Residential to R-1, Single-Family Residential with a Conditional Use Permit to allow a telecommunications tower with less than the required separation from a residential subdivision on property located at 3300 LaPrada Drive. (Three letters in favor and 29 letters in opposition to the proposed amendment have been received. Six persons appeared in opposition to the proposed amendment before the Planning and Zoning Commission. The Planning and Zoning Commission recommends denial of the application. This item was postponed at the March 16, 2015, April 6, 2015, and May 18, 2015, City Council meetings.) THE APPLICANT HAS REQUESTED FURTHER POSTPONEMENT UNTIL SEPTEMBER 21, 2015. STAFF RECOMMENDS APPROVAL OF POSTPONEMENT. 11 Conduct a public hearing and consider possible action for Application No. 1031-20-2015, submitted by Mike Alturk for Kentex Global Holdings, Inc., for a rezoning from R-2, Single-Family Residential to Planned Development - Townhomes, to develop 68 lots at a developable density of 9.3 units per acre on an undeveloped 9.7-acre tract located at 1401 New Market Road. (Three letters in opposition to the proposed amendment have been received. The Planning and Zoning Commission recommends denial of the application. This item was postponed at the April 6, 2015, May 18, 2015 and June 1, 2015, City Council meetings.) 12 Conduct a public hearing and consider an ordinance for Application No. 974-11-2015, submitted by Pankaj Patel, for a rezoning from Commercial and Mesquite Arena/Rodeo Entertainment (MARE) Overlay District to Commercial and MARE Overlay District with a Conditional Use Permit for a limited service hotel on a 2.5-acre undeveloped tract located at 500 Rodeo Center Boulevard. (One letter in opposition to the proposed amendment has been received. The Planning and Zoning Commission recommends approval of the application with certain stipulations.) 13 Conduct a public hearing and consider an ordinance amending the Gateways element of the Mesquite Comprehensive Plan pertaining to the Big Town Gateway. (The Planning and Zoning Commission recommends approval of the amendment.) 14 Conduct a public hearing and consider an ordinance for Zoning Text Amendment No. 2015-01, (1) to create a new zoning classification to be known as the Skyline Logistics Hub Overlay District, or similar, which contains new or amended standards for site design and regulations affecting, without limitation, gateways, parking for heavy load vehicles, screen walls for outdoor storage, buffering, landscaping within gateways, truck access, truck stops and other permitted, restricted or prohibited uses, and defining a Truck Stop, and (2) to approve a change of zoning by adding the new Skyline Logistics Hub Overlay to an area bounded on the west by the western city limits of Mesquite; on the north by Interstate Highway 30; on the east along a line formed by East Meadows Boulevard, U.S. Highway 80, Forney Avenue, South Town East Boulevard, Skyline Drive, Interstate Highway 635, the Union Pacific Railroad, and the easternmost boundary of Skyline Industrial Village Subdivision Sections 2 and 3; and on the south by Military Parkway. (Five letters in favor and ten letters in opposition to the proposed text amendment have been received. Two letters were received requesting additional information. 15 Conduct a public hearing and consider an ordinance for Zoning Text Amendment No. 2015-02 amending Sections 2-300, 4-950, and 6-100 of the Mesquite Zoning Ordinance regulating and defining requirements for the amount of masonry required on the exterior of older dwellings. (The Planning and Zoning Commission recommends approval of the proposed amendment.) APPOINTMENTS TO BOARDS AND COMMISSIONS 16 Consider appointment of a principal member to the STAR Transit Board of Directors for a term to expire on June 30, 2019. 17 Consider appointment of one regular member to the Parks and Recreation Advisory Board and Tree Board for terms to expire October 21, 2016. Personnel Matters: Pursuant to Section 551.074 of the Texas Government Code, the City Council may consider the appointment, evaluation, employment, reassignment, duties, discipline or dismissal of the City Manager, City Attorney, Municipal Court Judge, City Secretary, members of the various City boards and commissions, and City officers or other employees. Discuss the appointment of a City Manager. 18 Discuss extension of full paid leave up to January 25, 2016, for injuries sustained by City of Mesquite Firefighter, Craig Bess, on June 25, 2013, as provided in Section 143.073, Line of Duty Illness and Injury Leave of Absence, of the Texas Local Government Code. Economic Development: Pursuant to Section 551.087 of the Texas Government Code, the City Council will meet in closed session to consider commercial or financial information regarding business prospects or projects. The following subject may be discussed: 19 Consider economic development incentives for a business prospect located on East Glen Boulevard. Following discussions in executive session, the City Council will reconvene in open session where any final action regarding executive session items will be taken.
