May 12, 2015 Press Release Freehold: At its regularly scheduled meeting held Monday evening, May 11, 2015, the Freehold Borough Board of Education unanimously passed a resolution activating a public comment period on the board s verified petition to the New Jersey Commissioner of Education to issue construction bonds for facility additions and renovations. The resolution allows for a written public comment period from all interested persons. Comments are limited to 10 written pages with the original and one copy for the Commissioner and one other copy to the Freehold Borough Board Secretary. The 20-day comment period will remain open until June 8, 2015. The board action was guided by a letter from the New Jersey Department of Education to the district dated May 1, 2015 which outlined the required actions to activate the official comment period. In the letter, the Office of Controversies and Disputes noted that the verified petition from the district was deemed complete and that prior to the Commissioner forwarding a request to the Director of the Office of Administrative Law to conduct an uncontested hearing, that comments from interested persons must be obtained. Once the comment period is complete and all interested persons have submitted their written comments, it is anticipated that the Commissioner will ask the Office of Administrative Law to appoint a hearing officer. Details of those future proceedings will be made public when known. The verified petition prompting public comment is entitled: IN THE MATTER OF THE APPLICATION OF THE BOARD OF EDUCATION OF THE BOROUGH OF FREEHOLD, MONMOUTH COUNTY, FOR AN ORDER DIRECTING ISSUANCE OF BONDS PURSUANT TO N.J.S.A. 18A:7G-12, AGNECY DKT. NO. 42-3/15. The verified petition is one of two initiatives taken by the district to address instructional space shortfalls since the two failed referenda in 2014. At its regular meeting on January 29, 2015, the board approved a resolution stating it was unable to comply with the State of New Jersey s constitutional mandate of a thorough and efficient education for each of its students because it lacked adequate school facilities. The board authorized the of Schools to sign and file a letter to the New Jersey Commissioner of Education, requesting that the New Jersey legislature appropriate funds, pursuant to N.J.S.A. 18A:7G-5(k), for this purpose. The board also authorized the filing of a verified petition requesting the New Jersey Commissioner of Education to authorize school bonds, pursuant to N.J.S.A. 18A:7G-12, to fully fund bond financed capital improvements that were rejected by the voters on September 30, 2014 and December 9, 2014. It is from this second initiative that this current comment period pertains. 1

This public comment period is an important step in the overall process to decide the outcome of the district s instructional space needs, said Rocco Tomazic, Freehold Borough. When I took up my position two years ago there were 1,523 students in district. Now there are 1,645 students in district and demographic studies confirm that enrollment growth will continue. I urge all interested persons to take advantage of this written comment period to express their views on this critical issue. Below is the full text of the board resolution approved May 11, 2015: RESOLUTION OF THE BOARD OF EDUCATION OF THE BOROUGH OF FREEHOLD IN THE COUNTY OF MONMOUTH, AUTHORIZING A THE ANNOUNCEMENT AND PUBLICATION OF A COMMENT PERIOD, REGARDING AN APPLICATION TO THE COMMISSIONER OF EDUCATION FOR AN ORDER DIRECTING THE ISSUANCE OF BONDS Whereas, the Board of Education of the Borough of Freehold in the County of Monmouth, New Jersey (the Board, when referring to the governing body, and the School District, when referring to the legal entity and its territorial boundaries) is a Type II school district organized under the New Jersey school laws, pursuant to N.J.S.A. 18A:8-1 et seq.; and Whereas, the Board authorized a resolution on January 29, 2015 petitioning the New Jersey Commissioner of Education (the Commissioner ) for an order directing the issuance of school bonds, pursuant to N.J.S.A. 18A:7G-12, to fully fund bond-financed capital improvements that were rejected by the voters on September 30, 2014 and December 9, 2014; and Whereas, such petition was filed in the New Jersey Department of Education s Bureau of Controversy and Disputes (sometimes referred to herein as the Bureau ) on or about March 3, 2015; and Whereas, the Bureau notified the School District on May 1, 2015 that the New Jersey Department of Education s Office of School Facilities completed its review of the petition and it determined that the petition contained the necessary information for the Board to seek an order of the Commissioner directing the issuance of bonds, pursuant to the requirements of N.J.S.A. 18A:7G-12; and 2

Whereas, prior to the Commissioner sending the petition to the Director of the Office of Administrative Law to conduct an uncontested hearing, written comments from interested persons must first be obtained; and Whereas, N.J.A.C. 6A:26-3.7(h)(2)(ii)(1) and (2) requires that the Board authorize the publication and announcement of a written comment period so that any person with interest in the petition may submit such written comments to the Commissioner; and Whereas, such written comments cannot exceed 10 pages in length and must filed in duplicate the original and one copy with the New Jersey Commissioner of Education, to the attention of the New Jersey Department of Education s Bureau of Controversy and Disputes; and Whereas, a third copy of the written comments must also be concurrently filed with the Secretary of the Board; and Whereas, all written comments must be filed with the Commissioner, and by inference with the Secretary of the Board, no later than June 8, 2015; and Whereas, the Board will also publish in the Asbury Park Press and the Newark Star Ledger the following public notice no later than May 18, 2015: Public Notice of the Board of Education of the Borough of Freehold in the County of Monmouth, NJ, Regarding a Petition to the New Jersey Commissioner of Education Seeking an Order Directing the Issuance of Bonds This Public Notice is being published by the Board of Education of the Borough of Freehold in the County of Monmouth, New Jersey in conjunction with its filing a petition (the Petition ) seeking an order from the New Jersey Commissioner of Education to authorize the issuance of bonds. The order is being sought because the voters of the Freehold Borough School District rejected on September 30, 2014 and again on December 9, 2014 bond referenda that would authorize the Board of Education to finance (i) building additions at the Park Avenue Elementary/Middle School, consisting of classrooms, gymnasium, girls locker room, library, and cafeteria; (ii) building additions to the Freehold Learning Center, consisting of new classrooms and a cafeteria addition; and (iii) numerous health and safety at both schools. 3

The total cost of the improvements in each the referenda was $32,902,400. The improvements were to be funded, in part, with debt service aid from the State of New Jersey at the rate of 66.89% of a project s eligible costs and bonds of the Freehold Borough School District in the amount of $32,902,400. At the time of the second referendum, the amount of bonds to be authorized would have used $4,872,240.21 of the $27,307,268.90 borrowing margin of the Borough of Freehold previously available for other improvements. The Board of Education has determined that the school improvements are necessary for the Freehold Borough School District to provide a thorough and efficient education. Any interested person wanting to submit written comments about the Petition (which can be found on the Freehold Borough School District s website or by requesting a copy from the Secretary of the Board) must submit an original and a copy of such comments, which cannot exceed 10 pages in length, to the following office: New Jersey Commissioner of Education c/o Bureau of Controversies and Disputes 100 Riverview Plaza P.O.
