Queensbury Union Free School District Board of Education Meeting Monday, March 12, 2018-7:00 p.m. Elementary School Cafeteria Amended Agenda I. Pledge to the Flag II. Presentations NYS Athletic Championships Awards - Dr. Huntley Budget Presentation - Scott Whittemore III. Open Forum Public participation is encouraged. There will be two specific open forums at each regular Board of Education meeting to provide the opportunity to address the Board of Education. We ask participants who wish to speak during the first Open Forum to both sign in and identify themselves verbally, and if applicable, the organization they are representing so that they may be recognized by the Board President. For clarity, we ask that all speakers identify the school related matter/topic to be discussed. In order to conduct business in a smooth, orderly, and timely manner, Open Forum is limited to a maximum of 30 minutes with 3 minutes allocated to each speaker. All participants will be asked to speak into a microphone during open forums. The Board of Education appreciates public attendance and participation at meetings. IV. Business Items - Assistant Superintendent for Business A. MOTION to approve the following resolution: WHEREAS, the District had previously created an employee retirement contributions reserve fund, which has a balance of $1,527,686 as of June 30, 2017; and WHEREAS, the District s Assistant Superintendent for Business has certified that the District does not need to have any funds in such employee retirement contributions reserve fund to satisfy any obligations during the 2017-18 fiscal year; and

WHEREAS, the District currently has liabilities for pending tax certiorari proceeds brought against the District in the amount of approximately $2,480,913; NOW, THEREFORE, IT IS HEREBY RESOLVED, that the District hereby schedules April 9, 2018 at 7:00 p.m. in the District s Elementary School Cafeteria for a public hearing regarding the proposed transfer of the funds in the retirement contributions reserve fund to the District s tax certiorari reserve fund. MOTION to approve the annual meeting resolution: NOTICE IS HEREBY GIVEN that a Budget Hearing of all those qualified to vote in the Queensbury Union Free School District, in the Town of Queensbury, Warren County, New York will be held on May 7, 2018 at the Queensbury Elementary School, 431 Aviation Road, Town of Queensbury, Warren County, New York at 6:30 p.m. E.D.S.T. AND NOTICE IS ALSO GIVEN that the Annual Meeting for the purpose of a vote of all those qualified to vote at School District meetings in said District will be held at the Queensbury Elementary School, 431 Aviation Road, in the Town of Queensbury, New York in said School District, on the 15th day of May 2018, and the polls will be open from 10:00 a.m. until 8:30 p.m., E.D.S.T. At such time on May 15, 2018, the voters of the District will vote upon the following matters: 1. Proposition # 1 - Annual budget 2. Proposition # 2 - School Bus Purchases Shall the following resolution be adopted: RESOLVED, that the Board of Education of the Queensbury Union Free School District is hereby authorized to purchase one (1) 72-passenger school bus and three (3) 42-passenger wheelchair buses at a total cost not to exceed $488,740 and that the sum of $488,740 or such thereof as may be necessary shall be raised by the levy of a tax upon the taxable property of said School District and collected in annual installments as provided by the Education Law and the Local Finance

Law, and in anticipation of such tax, obligations of said School District shall be issued. 3. Annual election to the Board of Education AND NOTICE IS ALSO GIVEN that a copy of the statement of the amount of money which will be required for the ensuing year for school purposes, exclusive of public monies, may be obtained by any taxpayer in the District during the fourteen (14) days immediately preceding the annual meeting, except Saturday, Sunday or holidays at the following school location, in which school is maintained, during the hours of designated: Queensbury School Administration Center, 429 Aviation Road, Queensbury, New York, 8:00 a.m. to 4:00 p.m. E.D.S.T. AND NOTICE IS ALSO GIVEN that the petitions nominating candidates for the office of member of the Board of Education must be filed with the Clerk of the District no later than the thirtieth (30th) day preceding the election at which the candidates so nominated are to be elected. The following vacancies are to be filled on the Board of Education: 1 Term - Five years - Name of last incumbent - Amy Molloy 1 Term - Five years - Name of last incumbent - Michael Shea Each petition must be directed to the Clerk of the District, must be signed by at least twenty-five (25) qualified voters of the District, and must state the name and residence of the candidate. AND NOTICE IS ALSO GIVEN that the application for absentee ballots for election of members of the Board of Education may be applied for at the office of the Clerk of the District, and that a list of all persons to whom absentee ballots shall have been issued will be available in the said office of the Clerk on each of the five (5) days prior to the day of election, except Saturday, Sunday or holidays, and that such list will also be posted at the polling place at the election of members of the Board of Education. AND NOTICE IS ALSO GIVEN that the District Board of Registration shall meet to prepare the register of the District in the High School on May 7, 2018 from 1:00 p.m. until 7:00 p.m. E.D.S.T., and that any person shall be entitled to have his/her name placed upon such register, provided that at such meeting of the Board of Registration,

he/she is known or proven to the satisfaction of such Board of Registration to be then or thereafter entitled to vote at this election and that the register prepared pursuant to Section 2014 of the Education Law will be filed in the office of the Clerk of the District and that such register will be open for inspection by any qualified voter of the district during the five (5) days immediately preceding the election, except Saturday, Sunday or holidays, and on the day of the election, between the hours of 8:00 a.m. and 4:00 p.m., E.D.S.T. MOTION to approve the following resolution: RESOLUTION DATED MARCH 12, 2018 QUEENSBURY UNION FREE SCHOOL DISTRICT S BOARD OF EDUCATION SEQRA RESOLUTION REGARDING THE 2018 CAPITAL PROJECT INVOLVING THE COMMUNICATION SYSTEM AND GENERATOR. WHEREAS, the Board of Education has had the opportunity to review the 2018 Capital Project (hereinafter the Project ) proposed for the Queensbury Union Free School District. This Project includes the following: (1) District wide communication system replacement, including telephone, public address, intercommunication, and clock program; and (2) Purchase and installation of a generator adjacent to the Middle School; and WHEREAS, the Board of Education has had an opportunity to review the Project with regard to its classification under the State Environmental Quality

Review Act (hereinafter referred to as SEQRA ) and whether it will have any significant adverse environmental impacts; NOW, THEREFORE, BE IT RESOLVED THAT, pursuant to 6 NYCRR Part 617.5(c)(2), (7), and (8), the Board of Education hereby declares that this Project be classified as a Type II Action under SEQRA because it consists of routine activities of an educational institution, is a replacement, rehabilitation or reconstruction of a structure or facility, in kind, and includes construction of an accessory structure involving less than 4,000 square feet, and it is therefore exempt from SEQRA. Motion to approve the following resolution: RESOLUTION DATED MARCH 12, 2018 WHEREAS, the Office of the State Comptroller has issued an audit report on some aspects of the District s Extraclassroom Activity Fund released on January 19, 2018 and WHEREAS, it is required pursuant to the Regulations of the Commissioner of Education that the District file a Board-approved corrective action plan within 90 days of receipt of that report, it is therefore RESOLVED, that the Board of Education approves the Corrective Action Plan, as attached, to be submitted to the State Education Department and the Office of the State Comptroller. MOTION to approve the following resolution: RESOLUTION DATED MARCH 12, 2018 WHEREAS, Sections 532, 534, and 542 of the Real Property Tax Law currently authorizes the payment of ad valorem taxes to the Queensbury Union Free School District on real property owned by New York State; and WHEREAS, Governor Cuomo has proposed in the Executive Budget to cap the amount of such taxes by introducing a state calculated payment in lieu of taxes; and WHEREAS, Governor Cuomo s proposal represents a radical departure from the current method of determining the amount of real property taxes paid by New York State to our District; and WHEREAS, the Board of Education opposes Governor Cuomo s proposal because it would adversely impact our District and other Districts in which New York State owns real property; NOW, THEREFORE, it is hereby RESOLVED, that the Board of Education of the Queensbury Union Free School District hereby opposes Governor Cuomo s proposal in the Executive Budget to modify the method of calculating the ad valorem taxes paid to the District on real property owned by New York State; and it is further RESOLVED, that the Board of Education of the Queensbury Union Free School District respectfully requests Governor Cuomo to direct the Division of Budget to delete the above-referenced payment in lieu of tax proposal and tax cap proposal from the Executive Budget.
