NORTH RIDGEVILLE CITY COUNCIL MEETING MINUTES AUGUST 6, 2018 CALL TO ORDER: 7:30 p.m. President Corcoran called the Monday, August 6, 2018 Council meeting to order. INVOCATION: Led by President Corcoran. PLEDGE OF ALLEGIANCE: Led by President Corcoran. ROLL CALL: Present were Council members Dennis Boose, Robert Chapek, Martin DeVries, Michelle Hung and President Kevin Corcoran. President Pro-Tem Bruce Abens and Gregg Westover were excused. Also present was Mayor David Gillock, Law Director Brian Moriarty, Safety-Service Director Jeff Armbruster, Auditor Jeff Wilcheck, City Engineer Daniel Rodriguez, Assistant Clerk of Council Tara Peet and Clerk of Council Nancy Linden. MINUTES - Corrections (if any) and approval: President Corcoran asked for any corrections or additions to the City Council meeting minutes of July 16, 2018. No discussion was offered. The minutes stand approved. President Corcoran noted Council received the Civil Service Commission meeting minutes of July 20, 2018, the Parks and Recreation Commission meeting minutes of June 27, 2018, the Records Commission meeting minutes of July 26, 2018 and the Streets, Sidewalks and Bridges Committee meeting minutes of July 16, 2018. LOBBY: President Corcoran opened the lobby session. He stated there will be just one lobby session. He asked anyone that would like to speak to come to the podium and state their name and address for the record. He further added each person will be given three minutes to speak. Albert Krage, Sugar Ridge Road: asked about the charges for the storm water utility and how it was calculated. President Corcoran stated the legislation will be sent to Committee and a discussion will be had. He further stated they don t have the answers to those questions yet.

NORTH RIDGEVILLE CITY COUNCIL 2 ADMINISTRATORS REPORTS: A. Mayor: Mayor Gillock stated the Service Department will begin milling and prepping Leafy Mill Lane, Fern Tree Lane and Gate Moss Oval starting Tuesday, August 7 with paving to follow. The schedule is subject to change depending on the weather. The annual Corn Festival will be taking place starting Friday, August 10 at 6:00 p.m. until Sunday, August 12 at 6:00 p.m. Bainbridge Road will be closed between Root Road and Route 83 beginning at 1:00 p.m. on Thursday and will reopen by 7:30 a.m. on Monday, August 13 to allow ample time for set up and tear down. For a complete listing of Corn Festival activities, visit their website at www.nrcornfest.org. Mayor Gillock announced the summer concert series at South Central Park will host the sounds of Southern Cross Band on Friday, August 17. The concerts are free and take place at the gazebo from 7:00 p.m. to 9:00 p.m. The last movie to be held at South Central Park at the gazebo at dusk is Black Panther on Friday, August 24. The movie and concert are subject to cancellation because of weather conditions. Safety-Service Director: Safety-Service Director Armbruster stated he was on vacation last week. The crack seal crews are out sealing from the Service Department. C. Engineer: Engineer Rodriguez stated the I-480 eastbound and Lorain Road Signal Upgrade Project work will restart the week of August 13th. During the week of August 13th drivers will begin to see the maintenance of traffic items put out and survey marks being placed. He noted there will be lane closures the week of August 20th. Engineer Rodriguez updated City Council on the US 20/Center Ridge Road Widening. He stated traffic along US 20 will flip to the new north side lanes of US 20 on or around August 9th, weather permitting. Engineer Rodriguez stated the City has received the final set of plans for the Boulder Drive Water Main Replacement Project. The Engineering Department will put the project out to bid within the next week. After the bidding process is complete that should put the start of construction around the end of September or the beginning of October. Engineer Rodriguez stated that his RPR, Shane Taylor, will now be in the Building Department as a zoning inspector. Engineer Rodriguez wished Mr. Taylor good luck. D. Auditor: Auditor Wilcheck stated the CAFR will be completed by the end of the month. The issues with the change in depositories last year have been worked out and everything is moving forward.

NORTH RIDGEVILLE CITY COUNCIL 3 E. Other Reports: President Corcoran noted Council received the July 2018 Parks and Recreation Director s report, the June 2018 Mayor s Court report and the June 2018 Police Support Car report. COUNCIL COMMITTEE REPORT(S): STREETS, SIDEWALKS AND BRIDGES COMMITTEE REPORT dated July 16, 2018 which recommends City Council adopt T 53-2018 as amended. (Council action required) Moved by Chapek and seconded by Boose to accept the Streets, Sidewalks and Bridges Committee report dated July 16, 2018. CORRESPONDENCE: Clerk of Council Linden stated a letter received on July 23, 2018 from the Ohio Division of Liquor Control notifying City Council that all liquor permits not yet renewed will expire October 1, 2018. OLD BUSINESS: None. NEW BUSINESS: A final plat approval for Meadow Lakes Subdivision 15 in a PCD. (Council action required to either approve, disapprove or modify the final development plan per 1279.11[b]) Moved by President Corcoran and seconded by Boose to approve the final plat for Meadow Lakes Subdivision 15 in a PCD. A final plat approval for Lifestyles of Meadow Lakes Phase No. 2 in a PCD. (Council action required to either approve, disapprove or modify the final development plan per 1279.11[b]) Moved by Boose and seconded by DeVries to approve the final plat for Lifestyles of Meadow Lakes No. 2 in a PCD. RECESS: Moved by Boose and seconded by DeVries to dispense with recess.

NORTH RIDGEVILLE CITY COUNCIL 4 FIRST READINGS: Ordinance and Resolution submittal(s) Clerk of Council Linden: T 89-2018 AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH RIDGEVILLE TO ENTER INTO A FAIR MARKET VALUE LEASE AGREEMENT WITH R & K TECHNOLOGIES, INC. FOR MULTI- FUNCTION PRINTERS. (Introduced by Mayor Gillock) Moved by Mayor Gillock and seconded by Boose to dispense with the second and third reading for T 89-2018. President Corcoran asked for any comments or questions. Councilman Boose stated this was a fair market lease and not a dollar buy out. At the end of the lease, the City will not own the equipment. The City will be able to purchase it if they wanted at a fair market value. Councilman Boose asked Mr. Rollins what the useful life was for the copiers. Tim Rollins, 7065 Avon Belden Road, President of R&K Technologies: stated about five to six years. Councilman Boose asked if they cover the maintenance of the copiers and toner. Mr. Rollins stated that was all included in the price. Councilman Boose asked if a unit was unserviceable, would they provide something in the interim. Mr. Rollins stated yes. President Corcoran asked Auditor Wilcheck if the copiers were connected to the City network. Auditor Wilcheck stated that was correct. Councilman Boose asked what the interest rate was. Auditor Wilcheck stated the interest rate is 7.5%. It is not tax exempt. Councilman Boose asked if that was renegotiated.

NORTH RIDGEVILLE CITY COUNCIL 5 Auditor Wilcheck stated they will have to work on that. Mr. Rollins stated they used the GSA rates and the lease factor rate. They negotiated lower than 7.5%. Councilman Boose asked what the effective rate will be. Mr. Rollins stated he could provide that answer tomorrow. Councilman Boose asked if the current lease rate will be less that what was quoted before them. Mr. Rollins stated no that the rate was locked in. It is lower than the regular contract rate. Safety-Service Director Armbruster stated he thought the rate was 6.5%. Mr. Rollins stated he would provide an answer in the morning. Councilman Chapek stated Mr. Rollins took the time to make certain the City won t be overcharged for copies actually used. Councilman Boose asked about the deadline the Ordinance needed to be approved. Safety-Service Director Armbruster stated the current contract is up in October. It will take time to get the new equipment ordered, tested and installed. He recommended getting the Ordinance in place this evening. Safety-Service Director Armbruster noted he notified the current company they will not be renewing the lease. Mr. Rollins stated that would be enough time if it were adopted this evening. A voice vote was taken on the dispensing of the second and third readings and the motion carried. Moved by Boose and seconded by DeVries to adopt T 89-2018. Moved by Boose and seconded by DeVries to add the emergency clause to T 89-2018 in order to address the timing issues and get the equipment ordered and in place before the other contract expires. A voice vote was taken on the emergency clause and the motion carried. President Corcoran asked the Clerk to call the roll vote on the adoption of T 89-2018 with the emergency clause.

NORTH RIDGEVILLE CITY COUNCIL 6 A roll call vote was taken and the motion carried. T 89-2018 becomes Ordinance number 5567-2018. Council Clerk Linden: T 90-2018 AN ORDINANCE CREATING A NEW CHAPTER ENTITLED STORM WATER UTILITY AS PART OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE OF THE CITY OF NORTH RIDGEVILLE CODIFIED ORDINANCES. (Introduced by Mayor Gillock) President Corcoran referred T 90-2018 to the Utilities Committee. Clerk of Council Linden: T 91-2018 AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH RIDGEVILLE TO TRANSFER A REMNANT PARCEL OF LAND TO THE RINI REALTY COMPANY. (Introduced by Mayor Gillock) Mayor Gillock stated during the acquisition phase of the Center Ridge Road project, property needed to be acquired in the front of Giant Eagle. In negotiating the value, the corner of the bank came into play and by ODOT rules, that offer was made to Rini as part of the compensation to them. SECOND READINGS: None. THIRD READINGS: Clerk of Council Linden: T 81-2018 AN ORDINANCE TO APPROVE THE EDITING AND INCLUSION OF CERTAIN ORDINANCES AND RESOLUTIONS AS PARTS OF THE VARIOUS COMPONENT CODES OF THE CODIFIED ORDINANCES; TO APPROVE, ADOPT, ENACT AND PUBLISH NEW MATTER IN THE UPDATED AND REVISED CODIFIED ORDINANCES; AND TO REPEAL ORDINANCES AND RESOLUTIONS IN CONFLICT THEREWITH. (Introduced by President Corcoran; First reading 07/02/2018; Second reading 07/16/2018) Moved by Boose and seconded by Hung to adopt T 81-2018. President Corcoran asked the Clerk to call the roll vote. Clerk of Council Linden took a roll vote and the motion carried and becomes Ordinance number 5568-2018.
