Docket No. PL-5- PPL-05-2003 OAH Docket No. 15-2500-17136-2 Dear Dr. Haar: Minnesota Pipe Line Company ("MPL") respectfully submits this letter to object to the exceptions to the Administrative Law Judge's ("ALP) Findings of Fact, Conclusions, and Recommendation filed by Laura and John Reinhardt ("Reinhardts'"). Jason Giesen. Allen Frechette, and Minnesota Public Interest Research Group ("MPIRG"). MPL submits this letter for the sole purpose of pointing out that the above-referenced exceptions have been filed in violation of Minnesota statutes and rules, and not to address any of the substance of the comments filed. Under clear Minnesota law. only panics adversely affected by a report of an ALJ may file exceptions and present argument. Minn. R. 7829.2700 ; subp. 1 (2005); see also Minn. Stat. >j 14.61. subd. 1 (2006). None of the above-referenced individuals or entities is a party to this proceeding. Accordingly, these exceptions should not be received into the record. MPL notes thai the Commission's November 22. 2006 Notice setting the deadline for filing exceptions to the ALJ's Report indicated that participants may also file exceptions. However. MPL respectfully points out that the Commission's rules of practice and procedure draw clear distinctions between parties and participants and do not provide for exceptions by participants. If the Commission nonetheless allows exceptions from participants, MPL points out that only MPIRG is a non-party participant in this proceeding. Accordingly, the exceptions filed by Mr. Frechette, the Reinhardts. and Mr. Giesen should not be allowed under any circumstance.

MPL simply notes that, in addition to being improperly filed, in several instances the exceptions go beyond the record of and could be rejected for that reason as well.
