DISTRICT OF COLDSTREAM BYLAW NO. 1731, 2018 A BYLAW TO EXEMPT CERTAIN PROPERTY IN THE DISTRICT OF COLDSTREAM FROM TAXATION FOR THE 2019 TAXATION YEAR WHEREAS the Community Charter provides authority for Council to exempt certain properties from taxation on land and improvements; AND WHEREAS Council deems it in the public interest to exempt certain properties from taxation; NOW THEREFORE the Council of the District of Coldstream ENACTS AS FOLLOWS: TITLE 1 This Bylaw may be cited as "DISTRICT OF COLDSTREAM PERMISSIVE TAX EXEMPTION BYLAW NO. 1731, 2018. INTERPRETATION 2 Unless otherwise provided in this Bylaw, words and phrases used herein have the same meanings as in the Community Charter, Local Government Act and the Interpretation Act as the context and circumstances may require. 3 A reference to an Act in this Bylaw refers to a statute of British Columbia, and a reference to any statute, regulation, bylaw or other enactment refers to that enactment as it may be amended or replaced from time to time. 4 Words in the singular include the plural, and words in the plural include the singular. 5 Headings are for convenience only and must not be construed as defining or limiting the scope or intent of the provisions. SEVERABILITY 6 If any part of this Bylaw is held to be invalid by a court of competent jurisdiction, the invalid part is severed and the remainder of the Bylaw continues to be valid.
DISTRICT OF COLDSTREAM PERMISSIVE TAX EXEMPTION BYLAW NO. 1731, 2018 Page 2 EXEMPTIONS 7 2019 TAX EXEMPTIONS are granted to the following properties: (1) The following properties registered in the name of the City of Vernon and located within The Corporation of the District of Coldstream for the year 2019, on land and improvements: (a) That part of Lot 23, Plan 455 shown on Plan B4067, Section 22, Township 9, ODYD, commonly referred to as the Vernon Creek Control Gate and located adjacent to Westkal Road; (c) Parcel C (Plan B4047) of Lot 21, Plan 455, Section 22, Township 9, ODYD, commonly referred to as Kal Lake Pumphouse and located adjacent to Westkal Road; Parcel A (Plan B4047) of Lot 21, Plan 455; and that part of Lot 21, Plan 455 said to contain 2 acres more or less as shown on Plan B4048; all of Section 22, Township 9, ODYD, commonly referred to as the City of Vernon Water Reservoir and located adjacent to Reservoir Road; Lot 1, Plan 6417, Section 22, Township 9, ODYD, commonly referred to as the Kal Lake Pump House and located adjacent to Westkal Road. (2) The following properties registered in the names of not-for-profit organizations within The Corporation of the District of Coldstream for the year 2019, on land and improvements: (a) (c) That part NE 1/4, Section 23, being a 1.369 acre portion more or less shown on Plan B5453, Township 6, ODYD, except Plans 23213 and KAP53289, registered in the name of the Lavington Community Association, commonly referred to as the Lavington Community Hall site and having a civic address of 9775 School Road; Lot 5, Plan 10026, Section 24, Township 9, ODYD, registered in the name of the Canadian Mental Health Association, commonly referred to as a care facility and having a civic address of 9604 Shamanski Drive; Lot 6, Block 2, Plan KAP9714, Section 21, Township 9, ODYD, registered in the name of Kindale Developmental Association, commonly referred to as a care facility and having a civic address of 8105 Lakeview Drive; Lot 7, Plan 2122, Sections 24 and 25, Township 9, ODYD, registered in the name of Kindale Developmental Association, commonly referred to as a care facility and having a civic address of 10306 Middleton Drive;

(3) The following properties used for the worship of God within the boundaries of The Corporation of the District of Coldstream for the year 2019: (a) Lot 1, Plan EPP18765, DL 57, ODYD, commonly referred to as the Coldstream Christian Church and having a civic address of 9904 Kalamalka Road; Lots 1 and 2, Plan 3026, Section 24, Township 9, ODYD, commonly referred to as the Ukrainian Episcopal and having civic addresses of 10110 and 10114, respectively, Middleton Drive; (c) Parcel A (DD 149196F and Plan B6907) of Lot C, Plan 1998, Section 23, Township 6, ODYD, commonly referred to as the Lavington Fellowship Baptist Church and having a civic address of 9681 School Road, except for the manse, both building and land footprint on which it sits, and shown generally on Schedule "A", attached hereto and forming part of this bylaw; Lot 1, Plan 40254, Section 24, Township 9, ODYD, commonly referred to as the Roman Catholic Church and having a civic address of 10102 Middleton Drive.
