2 ESIC Model Hospital, Rajajinagar, Bangalore is a 500 bed Hospital and a Medical College and Post Graduate Research Institute is also attached with it. This Hospital invites sealed quotations under single bid systems from registered and reputed agencies for removing Non Bio Medical Wastes on contract basis. Sealed tenders are invited for removing Non Bio Medical Wastes (Garbage) daily from ESIC Model Hospital, Rajajinagar, Bangalore. 2. Eligible agencies may visit/inspect the site and verify the entire quantum of work before quoting. They may visit/inspect the site on any working day from between 09.00 AM to 04.00 PM by contacting the General Branch in ESIC Model Hospital Rajajinagar, Bangalore 10 I. ELIGIBILITY CRITERIA 1. The Agency must have experience of handling the s i m i l a r k i n d o f work in reputed organizations/ Govt. Institutions/ Hospitals. Certificate of satisfactory performance from such client(s) is also to be enclosed. 2. The Tenderer should have the Registered / Branch Office in Bangalore. 3. The Tenderer should have a valid license issued by the BBMP & appropriate Government authorities for removal of garbage and general waste (Non bio medical waste) II. INSTRUCTIONS TO TENDERERS 1. Sealed quotations are invited from the reputed agencies for removing the Non Bio Medical Wastes from ESIC MH, MC & PGIMSR, Rajajinagar, Bangalore - 10 on contract basis. 2. The sealed envelope for the bid should contain the following: a) Tender form b) Tender fee of Rs.100/- (Non refundable) in the form of Demand Draft/Pay Order from a commercial bank drawn in favor of ESIC Fund A/c-1, payable at Bangalore. c) Earnest Money Deposit of Rs. 7,500/- in the form of Demand Draft/Pay Order from a commercial bank drawn in favor of ESIC Fund A/c-1, payable at Bangalore. d) Copy of PAN Number e) Copy of valid licence issued by the BBMP & Appropriate Government authorities f) The declaration in the prescribed proforma (Annexure A) enclosed should be submitted along with the Bid. g) Any other registration which is mandatory for running such Agency prescribed by the concerned authority from time to time h) The envelope should be superscribed as Tender for removing Non Bio Medical Wastes from ESICMH, Rajajinagar, Bangalore 10 3. The Bid should be accompanied by an Earnest Money Deposit (EMD) of Rs.7,500/- in the form of Demand Draft/Pay Order from a nationalized/ commercial bank drawn in favor of ESIC Fund A/c No.1 payable at Bangalore. It should have been issued after the date of advertisement of tender. In the absence of EMD, the tender shall be rejected summary. The earnest money shall be refunded to the unsuccessful tenderers after finalization of the contract. It shall be refunded to successful Tenderer on the receipt of performance security deposit. No interest is payable on the EMD. 4. All entries in the tender form should be legible and filled clearly. Any overwriting or cutting which is unavoidable shall be signed by the authorized signatory.
4 5. All pages in the tender form should be signed by the bidder in token of reading and accepting all the terms and conditions of the bid. 6. The bid shall be valid for 180 (One Hundred Eighty) days from the date of opening. 7. Tender incomplete in any form will be rejected outright. 8. Conditional Tenders will be rejected outright. 9. The closing date and time for receipt of tenders will be on 07/11/2014 at 14.00 Hrs. 10. The Bid shall be opened at 14.30 Hrs on 07/11/2014 in the ESIC Model Hospital Rajajinagar in the presence of the authorized representatives of tenderers, who wish to be present at the time. 11. No Tenderer will be allowed to withdraw after submission of the tenders within the bid validity period otherwise the EMD submitted by the tendering firm would stand forfeited. 12. In case the successful Tenderer declines the offer of Contract, for whatsoever reasons(s), his EMD will be forfeited. 13. A formal contract shall be entered into with the successful tenderer. In this contract, the successful tenderer shall be defined as Contractor. 14. The successful tenderer will have to deposit a Performance Security Deposit of Rs.25,000/- (Rupees Twenty five thousand only) in the form of Demand Draft / Pay Order from a Scheduled / Commercial Bank drawn in favour of ESIC Fund A/c No. 1 payable at Bangalore - 10. EMD amount is adjustable towards the Performance Security in case of successful tenderer. 15. The successful Tenderer will have to deposit the Performance Security Deposit and commence the work within 15 days of acceptance of tender. Otherwise the contract will be canceled and EMD will be forfeited. 16. Each page of the Tender document should be signed and stamped by authorized representative of Tenderer in acceptance of the terms and conditions laid down by ESIC. 17. Rates quoted shall be firm and fixed. No escalation of whatsoever nature shall be payable. 18. Tenders received and found deficient on account of registrations, documents or required information are liable to be rejected summarily. 19. Tender containing false, misleading information will be rejected and may also be liable for consequences for submitting false information. The Medical Superintendent, ESIC Model Hospital, Rajajinagar, Bangalore does not bind himself to accept the lowest or any tender and reserves the right to accept or reject any or all the tenders, either in whole or in part, without assigning any reasons for doing so. 20. The competent authority reserves the right to withdraw/relax any of the terms and conditions mentioned. 21. The competent authority reserves the right to reject all or any tender in whole, or in part, without assigning any reason thereof. 22. For finalization of contract, the Tenderer whose rates are the lowest in comparison to other tenderers will be considered as the Lowest Tenderer.

The contract shall initially be valid for period of One years and may be extended further for a period of One year subject to satisfactory performance, on the same Rate, Terms and Conditions. 24. The Tenderer who have submitted tender for the notification dated 19/09/14 (Tender opened on 14/10/14) need not apply again as the previous bid submitted by them will be included in this Tender. III. S c o p e o f w o r k a n d s e r v i c e s o f t h e p r e m i s e s 1. Removal of Non Bio Medical Waste from the premises of the Hospital daily and safe, hygienic transporting and dump/recycle/dispose the same at the approved place of the BBMP/Concerned authorities as per the guidelines of BBMP/Appropriate Government as per the requirement of the Hospital on daily basis (twice daily morning and evening) through vehicle from the ESIC Model Hospital, Rajajinagar, Bangalore 10. All statutory rules and regulations and legal requirements are to be followed at each stage. 2. All accumulated garbage is to be removed twice daily morning before 12.00 Noon and evening before 07.00 PM and clearance should be made. 3. The tenderer may quote amount payable for daily removal of waste per trip basis morning and evening. 4. The tenderer has to segregate the garbage itself as liquid, solid, degradable, non degradable etc., 5. The contractor should remove and treat, collection, receiving, storing, transportation and disposal of all Non Bio Medical Waste generate regularly on daily basis. IV. GENERAL TERMS AND CONDITIONS OF CONTACT 1. This annual Rate Contract is entered into for collection, receiving, storing, transportation, treatment and disposal of Non Bio Medical Waste generated from ESIC Model Hospital, Rajajinagar on annual Rate Contract basis. 2. This Rate Contract shall be valid for a period of one year from the date of issue and it will also be continued till the end of calendar month in which the one year period expires. 3. The ESIC Model Hospital, Rajajinagar will give its Non Bio Medical Waste properly packed in colour coded bags as per Pollution Control Board regulations for treatment and final disposal to the contractor. The waste shall be given at one single point by ESIC Model Hospital, Rajajinagar during normal working hours of hospital at given time to the contractor. 4. In case of non collection of waste as agreed to by the contractor for any reason will attract legal action and no payment shall be made for the day of non collection. 5. No payment will be made to contractor for the day of default 6. The Non Bio Medical Waste accumulated due to non lifting shall be collected and disposed by the contractor free of cost on the succeeding day. 7. The contractor shall ensure transport of Non Bio Medical Waste in a vehicle as specified by the Pollution Control Board or other competent authority from time to time. 8. It is responsibility of the contractor to take all precautionary steps to avoid leakage / spillage of Non Bio Medical Waste from the site of collection during transportation, to storage area shall be properly protected / disinfected and fenced according to the rules specified. 9. The contractor shall not sublet the contract.
6 10. The Hospital will not be responsible for any violation of rules and regulations committed by the contractor. 11. The contractor will be responsible for all incidental and accidental cost incurred for collection, transportation and disposal. 12. The contractor must undertake to train and retrain hospital personnel concerned free of cost so as to ensure proper segregation as per rules. 13. To make compliance to relevant the provisions of the appropriate statutory Laws. 14. The contractor has to indemnify the ESIC against all claims, damages or compensation under the provisions of Central Minimum wages Act and other Labor laws in force from time to time and Payment of Wages Act, 1936; Minimum Wages Act,1948; Employer s Liability Act, 1938; the Workman Compensation Act, 1923; Industrial Disputes Act, 1947; Maternity Benefit Act, 1961; Bonus Act; Contract Labor (R & A) Act 1970, or any modification thereof or any other Social Security benefits including prescribed number of leave / holidays and prescribed hours of work Schedule to its employees deployed in the hospital and all laws related to Social Security (ESI & P.F. etc), Service Tax wherever applicable & other Labor legislations, and such statutory orders from time to time. ESIC will not own any responsibility in this regard. And the Contractor will be liable for any consequences resulting from violation of any such rule / provision. 15. The Medical Superintendent, ESIC Model Hospital, Rajajinagar shall be at liberty to cancel without assigning any reasons thereof, the contract either wholly or in part. The contractor will not be entitled for any compensation what so ever in respect of such cancellation. 16. In matters of dispute regarding the work inconformity with the approved quality or performance of the terms and conditions of the contract the decision of the Medical Superintendent, ESIC Model Hospital, Rajajingar shall be final and binding. 17. The Medical Superintendent, ESIC Model Hospital, Rajajingar will have the right to extend the period of this contract for another One year beyond the stipulated period, if necessary, and it will be binding on the contractor to carry on the work with the same terms and conditions as mentioned there in during the extended period also on mutual agreement. 18. All disputes to this tender are subject to the jurisdiction of the court in Bangalore only. 19. In case of violation of any of the agreed conditions of this agreement by the contractor the Medical Superintendent, ESIC Model Hospital, Rajajingar will have the right to impose penal provisions. V. Period of Contract : The contract is for one year from the award of the contract renewable for another one year on mutual consent. VI. Payment Procedure 1. Payment will be made within ten working days on submission of the bill for every month after getting satisfactory work completion certificate by the concerned/nominated persons in this regard by the Medical Superintendent. 2. The statutory tax applicable shall be deducted from the bill before passing. VII. Penalty clause 1. Non clearance of Non Bio Medical Waste on any day will attract penalty of Rs. 2000/- for each occasion will be imposed.

In case of breach of any terms and conditions attached to the contract, the Performance Security Deposit of the Contractor will be liable to be forfeited by ESIC besides the annulment of the contract. VIII. Risk Clause ESIC reserve the right for termination of the contract at any time by giving one month written notice, if the services are found unsatisfactory and also has the right to award the contract to any other selected tenderers at the cost, risk and responsibilities of Contractor and excess expenditure incurred on account of this will be recovered by ESIC from the Contractor Security Deposit or pending bill or by raising a separate claim. IX. TERMINATION OF AGREEMENT 1. The Medical Superintendent, ESIC Model Hospital, Rajajinagar, Bangalore shall at his sole and absolute discretion, be entitled to terminate this agreement forthwith by written one month notice without assigning any reason and without payment of any compensation 2. In case of gross breach of any terms and conditions attached to the contract, the Performance Security Deposit of the Contractor will be liable to be forfeited by The Medical Superintendent ESICMH & PGIMSR, Rajajinagar, Bangalore 10 besides annulment of the contract and also blacklisting of the contractor for further five years. X. STAMP DUTY The successful bidder is required to enter into a contract in a stamp paper of Rs.200/- as per the proforma available in this office and the expenditure in this regard shall be borne by the contractor. XI. Dispute Settlement It is mutually agreed that all differences and disputes arising out of or in connection with this Agreement shall be settled by mutual discussions and negotiations if such disputes and differences cannot be settled and resolved by discussions and negotiations then the same shall be referred to the Sole Arbitrator appointed by the Medical Superintendent, ESI Model Hospital, Rajajinagar, Bangalore whose decision shall be final and binding on both the parties.
